Abstract

Abstract Humans are social creatures who do not escape forgetting, one of which is accidentally dropping their belongings during their activities. We often encounter incidents like this in society. Many people want to take and control it as if they have the right to it all, even though in Islam this is the rule that applies in protecting their brother's property. This event is called Luqathah. The aim of this research is to provide legal knowledge regarding the status of found items and what obligations must be undertaken by the finder if they find an item. Of course, they must carry out their rights and obligations in accordance with the applicable Syara'. The research method used is a qualitative method. The data source used is primary data, namely direct interviews, direct interviews with resource persons. The secondary data used is scientific literature that is relevant to the object under study. As well as using a normative approach based on the Qur'an and hadith, the thoughts of fiqh scholars are taken in a book written by Imam An-Nawawi, namely the book Al-Majmu' and a book written by Ibn Qudamah, namely Al-Mughni. which can later be explained using known language rules such as fiqh rules. The conclusions obtained are permissible according to Imam Abu Hanifah, makruh according to Imam Malik and a group of Hanabilah, while according to Ulama' Hanafiyah and Syafi'iyah it is based on 'illat law. If the Inventor is able to uphold the trust then the law is recommended, if he breaks it then the law remains Haram. Keywords: Luqathah, Methods, opinions of scholars'
