Abstract

The right of access to public information is a constitutional right of citizens as stipulated in Article 28F of the 1945 Constitution of the Republic of Indonesia and implemented through Law Number 14 of 2008 concerning Public Information Disclosure to create an open, accountable, and participatory government. However, its implementation still faces various challenges, such as low compliance of public institutions, closed bureaucratic culture, and weak execution of Information Commission decisions. This normative legal research aims to analyze the regulation of the right of access to public information as a constitutional right and examine its implementation in government practice. The approaches used include statutory, conceptual, and case approaches, with primary, secondary, and tertiary legal sources analyzed qualitatively through literature study. The results show that the right of access to public information has a strong legal foundation, both in the constitution and the Public Information Disclosure Law, so this right must be respected, protected, and fulfilled by the state. However, its implementation is still constrained by broad interpretations of exempted information, low compliance of public bodies, weak enforcement of Information Commission decisions, and a bureaucratic culture that has not been fully open.
