Abstract

Land grants are one form of transfer of land rights carried out voluntarily and without compensation from the donor to the recipient. In its implementation, a deed of grant is required to be made by a Land Deed Official (Pejabat Pembuat Akta Tanah/PPAT) as an authentic legal instrument to provide legal certainty and protection for the parties involved. This study aims to examine the role of PPAT in the making of land grant deeds, the forms and implementation of legal protection for the parties, as well as the supporting and inhibiting factors faced by PPAT in providing legal protection during the process of making land grant deeds. The research method used is empirical legal research with a qualitative approach. Data were collected through interviews with PPAT officials, grantors, grantees, and witnesses, supported by literature studies of relevant laws and regulations and legal literature. The collected data were then analyzed using descriptive qualitative analysis. The results show that the Land Deed Official (PPAT) plays an important role in the preparation of land grant deeds by examining the identities of the parties, land certificates, and supporting documents, verifying the legal status of the land, explaining the legal consequences of the grant, and preparing and reading the deed before the parties and witnesses. Legal protection is provided through the fulfillment of formal and material requirements and the registration of the transfer of land rights, while supporting factors include complete documentation and cooperation between the parties. The obstacles encountered include incomplete documents, limited public understanding of grant procedures, and family objections or disputes. These findings indicate that the application of the principle of prudence by PPAT plays an important role in ensuring legal certainty and protection for the parties involved in land grants.
