Abstract

Penelitian ini mengkaji hukum investasi syariah, saham syariah, dan trading online dalam perspektif hukum ekonomi syariah. Perkembangan ekonomi digital yang pesat melahirkan berbagai instrumen investasi baru yang menuntut kajian hukum Islam secara komprehensif. Tujuan penelitian ini adalah mendeskripsikan konsep dan prinsip dasar investasi syariah, menganalisis mekanisme Daftar Efek Syariah (DES), serta menentukan status hukum trading onlinemeliputi saham, cryptocurrency, dan forex berdasarkan perspektif hukum ekonomi syariah. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan konseptual dan perundang-undangan, melalui teknik studi kepustakaan terhadap sumber primer berupa Al-Quran, hadis, fatwa DSN-MUI, dan regulasi OJK, serta sumber sekunder berupa literatur akademik yang relevan. Hasil kajian menunjukkan bahwa investasi syariah wajib memenuhi prinsip bebas dari riba, gharar, maisir, penipuan, dan usaha haram. Saham syariah yang terdaftar dalam DES dan diperdagangkan sesuai Fatwa DSN-MUI No. 80/2011 dinyatakan halal, sedangkan forex trading spekulatif dengan leverage berbasis bunga dinyatakan haram. Trading cryptocurrency masih diperdebatkan, namun mayoritas ulama kontemporer menghendaki kehati-hatian ketat. OJK, BEI, dan DSN-MUI memainkan peran strategis dan saling melengkapi dalam pengawasan ekosistem investasi syariah di Indonesia.

Abstract

Sharia-based entrepreneurship continues to develop along with the increasing public awareness of business practices that align with Islamic principles, making the need for risk management based on sharia teachings increasingly urgent. This study aims to analyze the types of risks commonly encountered in sharia-based entrepreneurship, explain the implementation of risk management based on Islamic principles, describe the integration of sharia values in the processes of risk identification, analysis, evaluation, and mitigation, and formulate mitigation strategies that are able to maintain sharia compliance while enhancing business sustainability. This study employs a library research method by reviewing various scholarly literatures related to sharia entrepreneurship, risk management, maqasid al-shariah, and Islamic value-based business concepts. The findings indicate that sharia-based entrepreneurs face financial, operational, market, regulatory, and sharia compliance risks that require high levels of accuracy in the application of contracts and transaction mechanisms. Other findings show that the implementation of sharia risk management is carried out through structured stages grounded in the values of honesty, trustworthiness, prudence, and the avoidance of riba, gharar, and maysir. Risk mitigation strategies can be implemented through strengthening corporate governance, improving operational efficiency, diversifying halal products, fulfilling halal certification regulations, and applying sharia audits as internal control mechanisms. This study concludes that sharia-based risk management is a comprehensive approach that not only functions to protect businesses from uncertainty but also shapes ethical, integrity-driven, and sustainable business practices in accordance with the fundamental objectives of Islamic economics

Abstract

The global halal industry is experiencing rapid growth that requires sharia business actors to continue to adapt through innovation and creativity that do not contradict Islamic principles. Sharia Entrepreneurship exists as an entrepreneurial paradigm that integrates spiritual values, ethics, and sharia obligations in business activities. This research aims to formulate an integrative model between halal innovation and Islamic creativity as the main pillar of sustainable halal business competitiveness. With a descriptive qualitative approach based on literature study, this article examines fundamental concepts, contemporary theories of Islamic economics, maqāṣid al-syarī'ah, as well as relevant current research findings. The results of the study show that halal innovation plays an engine of value creation, while Islamic creativity functions as an engine of differentiation. The integration of the two results in a strong, competitive, adaptive, and maslahah-oriented Sharia Entrepreneurship model. This research provides a theoretical contribution in the form of a new conceptual framework and practical implications for halal MSMEs, sharia startups, governments, and Islamic economic development institutions
