Abstract

This research aims to analyze the obligation of Notary to analyze the obligations of notaries related to the fulfillment of the requirements for the reading of authentic deeds in the context of communication methods toward deaf visitors and to analyze the legal protection for deaf visitors in enhancing the accessibility of reading authentic deeds. The research method used in this writing is doctrinal legal research with a normative juridical approach. The result of this research by comparing the Indonesian Notary Law with Kōshōninhō, can be analyzed that the Indonesian Notary Law has not specifically regulated sign language interpreters for deaf people. Therefore, Indonesian can adopt the provision in Kōshōninhō, that the Notary is authorized to make authentic deeds for deaf persons accompanied by a certified sign language interpreter. Therefore, by having the notary state that the individual is a deaf visitors person and that a sign language interpreter assists in the reading of the deed, legal protection for deaf visitors can be achieved in the process of making an authentic deed before a Notary.

Abstract

The digitalization of land administration particularly through the implementation of Electronic Land Certificates constitutes a key component of Indonesia’s national land administration reform agenda. However, the success of this policy is not determined solely by technological readiness and regulatory frameworks, but also by the social and legal readiness of the community as the primary users of land services. This article aims to analyze community readiness for Electronic Land Certificates by examining the relationship between public trust and legal literacy. The study employs a descriptive-quantitative approach with interpretative analysis based on questionnaire data collected from residents of Duri Kepa Subdistrict who participated in a community service program organized by the Faculty of Law, Universitas Esa Unggul Jakarta, on 12 August 2025. The findings reveal a structural gap between high levels of public trust in land administration institutions and Land Deed Officials (PPAT) and low levels of procedural understanding regarding land registration, Electronic Land Certificates, and personal data protection risks. This gap indicates the emergence of trust-based compliance, in which acceptance of digital land services relies more on institutional legitimacy than on substantive legal understanding. The article argues that such compliance is inherently fragile and may undermine the sustainability of land administration digitalization if not accompanied by systematic legal education, a human-centered approach, and the strengthened role of Land Deed Officials (PPAT) as legal facilitators in the transition toward a digital land administration system.

Abstract

The purpose of writing this journal is to determine the comparison of the imposition of the doctrine of piercing the corporate veil in a Limited Liability Company between the Board of Directors and shareholders, with a review of Law Number 40 of 2007 concerning Limited Liability Companies (UUPT). The Doctrine of Piercing the Corporate Veil is a doctrine that has long been present in the business world, especially attached to the legal entity of Limited Liability Companies in Indonesia. UUPT as the law governing Limited Liability Companies in Indonesia has set out the rules regarding the doctrine of piercing the corporate veil. The doctrine has historically been widely used in court decisions, the presence of the doctrine of piercing the corporate veil can penetrate the distinctive nature of a Limited Liability Company, namely limited liability. Departing from this inevitability, the author then formulates the problem in writing this journal, namely why there is a doctrine of piercing the corporate veil in a Limited Liability Company and how the comparison of the imposition of the doctrine of Piercing the Corporate Veil in a Limited Liability Company between the Board of Directors and shareholders is reviewed from the Company Law. The research method used is normative legal research, based on sources obtained through literature studies, in the form of primary, secondary, and tertiary legal materials related to the writing of this journal. This research shows that the presence of the doctrine of piercing the corporate veil in a Limited Liability Company is needed as a form of legal protection for the Limited Liability Company entity and its related parties, and there are differences in the imposition of the doctrine on the Board of Directors of the company and the company's shareholders. The difference in the imposition between the Board of Directors and the shareholders of the company is that, if the Board of Directors is required another article in relation to its good faith in running the company (fiduciary duty), while the shareholders of the company are expressly regulated in Article 3 of the Company Law.

Abstract

The legal relationship between creditors and debtors is based on a credit agreement which can be made in the form of a private deed or notarial deed. A credit agreement is a basic agreement that can be supplemented with an accessory agreement in the form of a guarantee agreement, both material guarantees and individual guarantees. The changes to the credit agreement can be made in the form of an addendum to the credit agreement. Changes to credit agreements without involving the collateral provider can give rise to disputes, as happened in the case of Supreme Court decision Number 3464 K/Pdt/2019, where the Creditor and Debtor entered into a private addendum agreement to the working capital credit agreement without the consent of the third party providing collateral. Making an addendum agreement to a working capital credit agreement without approval and an authentic deed raises some questions. Based on this case, the problem that will be discussed in this research is about the validity of addendums to credit agreements without the guarantor's approval as well as preventive legal protection for parties in making credit and guarantee agreements. This research aims to analyze the validity of credit agreement addendums without guarantor approval and legal protection for making credit agreement addendums without guarantor approval. The research method is a doctrinal research method. Based on this, this paper discusses the legal protection of guarantors for making addendums to credit agreements without the guarantor's approval. The results of this research are that making Addendum 1 (first) and Addendum 2 (second) to the quo credit agreement without the guarantor's approval is a valid agreement and the role of the notary in making authentic deeds and legal counseling is a form of preventive protection in a quo case decisions

Abstract

The National Strategic Project (PSN) for the construction of the Padang–Sicincin Toll Road aims to improve connectivity and economic growth in West Sumatra, as regulated under Government Regulation No. 42 of 2021, which governs the implementation of PSN through four stages: planning, preparation, implementation, and handover of results. However, the land acquisition process for this project has given rise to various legal issues affecting community rights, including the customary land (tanah ulayat) of the Minangkabau indigenous people, as widely reported in the mass media. This study aims to analyze the land acquisition practices for the Padang–Sicincin Toll Road from the perspective of the Rechtsstaat in relation to community land rights, and to formulate legal protection for landowners in the land acquisition process for National Strategic Projects from the perspective of the Land Acquisition Law. This study employs a normative legal research method using legislative, conceptual, and case-based approaches. Legal materials were obtained through a literature review and analyzed qualitatively. The results indicate that a number of Rechtsstaat indicators have not been adequately fulfilled, including compensation determinations that do not sufficiently reflect fair market value, public consultations that have not achieved their substantive function, procedural facilitation for National Strategic Projects that has not been balanced by proportional control mechanisms, and the use of consignment (konsinyasi), which is fundamentally not a forum for dispute resolution. Furthermore, legal protection for landowners is formulated through three key measures: strengthening the principle of deliberation (musyawarah) as a mandatory and meaningful mechanism, granting specific recognition and protection to customary (ulayat) land, and affirming that the state's right of control under Article 2 of the Basic Agrarian Law must be interpreted consistently with the principle of Rechtsstaat — namely, directed toward the greatest prosperity of the people under Article 33(3) of the 1945 Constitution, rather than as absolute authority to override the substantive rights of the community.
