The phenomenon of violence involving children as perpetrators of serious crimes, particularly premeditated murder, has generated significant controversy in the practice of law enforcement in Indonesia. One of the main debates arises when the Public Prosecutor files a demand for the death penalty against a child, which is considered contrary to the principle of child protection as regulated in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, as well as various international instruments, including the Convention on the Rights of the Child (CRC). This study aims to analyze the juridical considerations of the Public Prosecutor in demanding the death penalty for children who commit premeditated murder. The scope of the study includes the legal basis, juridical foundations, and factors influencing prosecutorial considerations in formulating criminal charges, as well as their conformity with the principles of justice and child protection. The research method used is a normative juridical approach by examining legislation, legal doctrines, and case studies of prosecutorial practices. The analysis focuses on the consistency of the prosecutor’s juridical considerations with national legal norms and international standards. The findings reveal that the prosecutor’s juridical considerations in demanding the death penalty for children are often inconsistent with the principle of child protection. Such demands tend to be influenced more by retributive justice and public pressure rather than the rehabilitative objectives mandated by the Juvenile Criminal Justice System. Therefore, a reform of criminal law policy is needed to reaffirm the limitations of prosecutorial juridical considerations so that they align with the principle of child protection and the best interest of the child. AbstrakFenomena kekerasan terhadap anak yang melibatkan anak sebagai pelaku tindak pidana berat, khususnya pembunuhan berencana, menimbulkan polemik dalam praktik penegakan hukum di Indonesia. Salah satu perdebatan utama muncul ketika Jaksa Penuntut Umum (JPU) mengajukan tuntutan hukuman mati terhadap anak, yang dianggap bertentangan dengan prinsip perlindungan anak sebagaimana diatur dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak (SPPA) serta berbagai instrumen internasional, termasuk Konvensi Hak Anak (CRC). Penelitian ini bertujuan untuk menganalisis pertimbangan yuridis Jaksa Penuntut Umum (JPU) dalam menuntut hukuman mati terhadap anak pelaku tindak pidana pembunuhan berencana. Permasalahan yang dikaji meliputi dasar hukum, landasan yuridis, dan faktor-faktor yang memengaruhi pertimbangan jaksa dalam merumuskan tuntutan pidana, serta kesesuaiannya dengan prinsip keadilan dan perlindungan anak. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan menelaah peraturan perundang-undangan, doktrin hukum, dan studi kasus praktik penuntutan pidana. Analisis difokuskan pada konsistensi pertimbangan yuridis Jaksa Penuntut Umum (JPU) dengan norma hukum nasional maupun standar internasional. Hasil penelitian menunjukkan bahwa pertimbangan yuridis jaksa sering kali tidak selaras dengan prinsip perlindungan anak. Tuntutan hukuman mati terhadap anak lebih dipengaruhi oleh aspek keadilan retributif dan tekanan publik, dibandingkan dengan tujuan rehabilitatif sebagaimana diamanatkan dalam Sistem Peradilan Pidana Anak (SPPA). Oleh karena itu, diperlukan pembaharuan politik hukum pidana yang menegaskan kembali batasan pertimbangan yuridis Jaksa Penuntut Umum (JPU) agar selaras dengan prinsip perlindungan anak dan kepentingan terbaik bagi anak (the best interest of the child).
