Abstract

The issue of legal representation in the Tax Court is significant due to the complexity of tax law and the high number of disputes filed each year. The special requirement for legal representatives namely, that they must be either licensed advocates or certified tax consultants is stipulated in Articles 34 and 36 of the Tax Court Law. This regulation aims to uphold professionalism and competence in dispute resolution. However, this approach also raises concerns regarding fairness, especially for small and individual taxpayers who struggle to obtain qualified legal assistance. This study employs a normative legal method with statutory and conceptual approaches to analyze the rules and legal implications of this regulation. The findings indicate that out of 14,709 cases in 2022, there were only about 3,200 active legal representatives who met the qualifications, revealing a significant imbalance. Additionally, varying interpretations of the qualifications for legal representatives in practice have led to legal uncertainty. The study highlights the need for policy adjustments and the establishment of legal aid schemes to ensure equal access to justice

Abstract

The rapid growth of vehicles has made traffic law enforcement a critical issue in urban areas. This normative legal research examines the implementation of the e-ticketing system in handling traffic violations in Denpasar City. The study finds that the implementation of e-tilang has a strong and multi-level legal foundation, primarily based on Law Number 22 of 2009 concerning Traffic and Road Transportation, supported by other regulations such as the ITE Law and the Personal Data Protection Law. However, the research also identifies significant legal consequences, including a shift towards objective liability for vehicle owners and challenges related to the protection of constitutional rights, such as the right to be heard and data privacy. While the system aligns with the principles of good governance, particularly in transparency, accountability, and efficiency, its full success depends on massive socialization, clear complaint mechanisms, and affirmative policies for the technologically vulnerable. The study concludes that e-tilang is a legitimate instrument for law enforcement in the digital era, provided it is balanced with a strong commitment to data protection and all principles of good governance.

Abstract

Criminal acts that threaten human life and property are categorized as serious crimes in the Indonesian criminal law system. These crimes directly affect the fundamental rights of individuals, namely the right to life and the right to own property. The Indonesian Criminal Code regulates various forms of crimes against life and property along with criminal sanctions for the perpetrators. This research aims to examine the legal regulation related to crimes against human life and property as well as to analyze the criminal liability imposed on perpetrators according to the provisions of the new Criminal Code. This study applies normative legal research using statutory and conceptual approaches. The results indicate that the new Criminal Code provides a clearer framework regarding the elements of criminal acts and the sanctions imposed on offenders. Criminal liability can be imposed on individuals who intentionally commit acts that cause harm to another person's life or property. Effective law enforcement is necessary to ensure justice, legal certainty, and protection for the community
