Abstract

The development of digital banking services has made electronic transactions easier for customers, but it also creates risks, particularly transactions made without the customer's authorization. This study aims to examine the responsibility of banks for unauthorized electronic transactions, the evidentiary process in disputes between banks and customers, and the application of the prudential banking principle in preventing such transactions. This research uses a normative juridical method with a statutory and case approach, using legal materials from regulations, books, scholarly journals, and the Decision of the Mojokerto District Court Number 35/Pdt.G/2023/PN Mjk. The results show that a bank's responsibility depends on how the transaction occurred, the security of the system, the authentication procedures, and whether negligence occurred on the part of the bank or the customer. Customer protection also needs to be supported by the application of the prudential banking principle, stronger system security, data protection, and effective complaint mechanisms.
