ABSTRACT International trade requires compliance with fair competition principles, including the prohibition of dumping practices that harm domestic industries. The WTO DS622 dispute began when the European Union imposed definitive anti-dumping duties on fatty acid imports originating from Indonesia, despite fundamental changes in the conditions underlying its investigation. This article aims to analyze the conformity of the EU's anti-dumping measures with the normative provisions of the WTO Anti-Dumping Agreement (ADA). The research method applied is normative-juridical with a case study approach to the DS622 dispute, examined through library research on international legal instruments and official dispute documents. The results identify two main findings. First, the EU's application of the Constructed Normal Value methodology based on Product Control Numbers (PCN) strongly indicates a deviation from Articles 2.2, 2.2.1.1, and 2.2.2 of the ADA, as it tends to disregard exporters' actual cost records and risks undermining the fair comparison principle. Second, the EU's decision to continue the investigation following the withdrawal of the complaint and the shift in domestic industry support raises significant normative tension with the standing requirements under Articles 5.4 and 5.8 of the ADA, although its validity under international law still depends on how the DS622 Panel interprets whether such requirements are static or dynamic in nature. In conclusion, the EU's domestic legal legitimacy for continuing the investigation does not automatically reflect compliance with its international WTO obligations, leaving significant legal questions regarding the EU's conformity with the ADA in this dispute.
