Abstract

Perempuan sering menjadi sorotan dalam masyarakat, dimana perempuan dipandang sebagai makhluk kedua. Patriarki adalah budaya dimana posisi laki-laki dianggap kedudukannya lebih mulia dari kedudukan perempuan. Islam sendiri menghendaki adanya kesetaraan kedudukan antara laki-laki dan perempuan, misal di bidang politik. Terdapat dua ayat dalam Al-Qur’an yang memerintahkan umat Islam agar melakukan musyawarah (QS. al-Syura: 38 dan QS. Ali ‘Imran: 159). Pada tahun 1998, kaum perempuan mulai berani menyuarakan pendapatnya. Muculnya gerakan-gerakan yang menyuarakan kesetaraan kedudukan antara kaum laki-laki dan perempuan. Dalam ranah politik contohnya adalah adanya keterwakilan perempuan dalam pemerintahan. Indonesia telah mengakomodir peran perempuan dalam politik, sebagaimana diamanatkan  UU No. 2 tahun 2008 dan UU No. 7 tahun 2017. Meskipun demikian dalam realitanya justru berbanding terbalik, keterlibatan perempuan dalam bidang politik sebagai anggota legislatif belum terlaksana secara maksimal. Penilitian ini membahas tentang peran perempuan dalam politik kebangsaan dengan metode analisis historis, sebuah analisis yang berdasarkan pada sejarah yang telah terjadi.

Abstract

In social life, women are often seen as second-class humans. This is caused by patriarchal culture that considers men are in hingher position than women. Islam itself wants equality between men and women, for example in political field. There are two verses in Al-Qur’an that instruct muslims to conduct deliberations, ie. (QS Al-Syura: 38 and QS Ali ‘Imran: 159). In 1998, Indonesian women began to have courage to express their opinions marked by the emergence of movements that speak of equality between men’s and women’s positions, particularly in political field such as the representation of women in goverment. Indonesia has accomodated the role of women in politics, as instructed in constitution law No. 2 of 2008 and constitution law No. 7 of 2017. However in reality it is inversely proportional, the women involvement in political field, especially as legislators, has not been carried out optimally. This research will discuss the role of women in building national politics by using historical analysis method, which is in analyzing the data based on the history that has happened.

Abstract

This Research with the title Authority Of State Institutions (Analysis Of Arrangement Authority General Election Organizers In Accordance Normative Proposition) examines the arrangement coordination Election Organizers according to normative proportionality. Based on Law No. 17 of 2017 concerning General Elections. This research is a type of normative or doctrinal legal research, which uses two questions, namely: invitation agreement (statute approach), and accessing history (historical approach). The source of legal material in this study was obtained from legal basis material (legislation) and secondary legal materials (opinions / interviews of related figures). The method of analysis in this study uses systematization of legal material (classification makes it easy to analyze the articles) and uses qualitative descriptive in describing the content of the legislation. The results of the study concluded, First, According to Law No. 7 of 2017 concerning General Elections, the respective authorities are as follows: KPU as Election implementers, Bawaslu as Election Implementation Supervisors, and DKPP as bodies that examine and decide complaints or report the alleged violations a code of ethics which also compensates for the decisions (checks and balances) of the performance of the KPU and Bawaslu. It's just that in practice, Election Organizers are still overlapping. This is by the author, based on a review of the data based on several factors, namely: 1) Understanding of each individual's authority, which is still lacking, 2) There is intervention and pressure from other parties, 3) There is a desire to be superior, 4) Less DKPP stated firmly in every case.
