Abstract

This study aims to analyze the legal politics underlying the criminalization of cohabitation in the National Criminal Code and examine its implications for the protection and restrictions of human rights in the Indonesian rule of law. This study is a normative legal study with a statutory and conceptual approach, supported by criminological analysis. Primary, secondary, and tertiary legal materials were collected through literature review and analyzed qualitatively using descriptive-analytical and prescriptive methods. The results show that the criminalization of cohabitation is part of a criminal law policy oriented towards strengthening public morality and protecting the family institution as a value considered fundamental in Indonesian society. The formulation of the complaint offense reflects a compromise between protecting social values and respecting citizens' private space.

Abstract

This study aims to evaluate the effectiveness of the prevailing legal framework in the ASEAN region in addressing this crime, while simultaneously formulating more comprehensive, integral policy recommendations. Using a juridical-normative approach with a comparative analysis across ASEAN member states, the study finds that regulatory harmonization across countries is still far from adequate, cross-border law enforcement capacity is very limited, and existing multilateral cooperation is unable to respond to the ever-evolving dynamics of the crime. The main findings of this study indicate the need for a binding regional legal instrument specifically regulating organ trafficking beyond the existing general framework of human trafficking. Furthermore, a more sophisticated system of intelligence information sharing between countries and a joint judicial mechanism to handle cross-jurisdictional cases is needed.

Abstract

Law Number 1 of 2023 concerning the Criminal Code (National Criminal Code) introduces new provisions through Articles 38 and 39 regarding the capacity to be held accountable for perpetrators with mental and/or intellectual disabilities. This article examines the criminal provisions for perpetrators suffering from severe mental disorders under the National Criminal Code and analyzes the application of measures to perpetrators declared incapable of being held accountable in the Indonesian criminal justice system. The research method used was normative legal research with a legislative and conceptual approach. Data was obtained through a literature review of primary, secondary, and tertiary legal materials, analyzed descriptively and qualitatively. The results indicate that the National Criminal Code has provided legal updates that are clearer, more humane, and more human rights-based than the previous Criminal Code. These provisions integrate a legal approach with a medical one through the involvement of psychiatrists in determining the perpetrator's capacity to be held accountable. However, the implementation of these measures still faces obstacles such as limited mental health facilities, a lack of forensic psychiatrists, and suboptimal coordination between law enforcement and medical personnel
