Abstract

The use of electronic signatures in regional government administration is part of a broader transformation of public administration aimed at improving the efficiency and speed of administrative services. However, this raises legal issues when the date stated in a regional head's decree differs from the date recorded in its electronic signature, affecting legal certainty as to when the decree is established and its legal consequences. This research analyzes the legal certainty of electronically signed regional head decrees, using a case study of West Java Governor Decree Number 171.3/Kep.222-Pemotda/2023. This study adopts a normative juridical approach, utilizing both statutory and conceptual perspectives. It analyzes the legal provisions governing the issuance of regional head decrees and the implementation of electronic signatures, with particular reference to West Java Governor Regulation Number 108 of 2020, its subsequent amendments, and other relevant legal instruments. The findings show that such date discrepancies must be analyzed by distinguishing the time of establishment, document authentication, and the decree's effective date. Legal certainty cannot rest solely on the electronic signature's date, but on the legal construction of when the decree is validly established and produces legal effects. This finding underscores the need for clearer regulation and administrative practice on determining dates in electronically signed decrees, to prevent legal uncertainty.
