Desa Padelegan terkenal sebagai tempat sentra industry teri crispy yang produknya telah menjadi tuan rumah di negeri sendiri karena tersebar di beberapa wilayah di Indonesia, bahkan juga sudah diekspor ke luar negeri. Keberadaan sentra industri ini menyerap banyak tenaga kerja sehingga dapat secara nyata memberikan kontribusi dalam meningkatkan pertumbuhan ekonomi bagi Desa Padelegan, Kecamatan Pademawu pada khususnya dan Kabupaten Pamekasan pada umumnya. Namun kendala yang dijumpai yaitu ketika melakukan transaksi jual beli antara pelaku usaha teri crispy dan pembeli hanya dilakukan berdasarkan kepercayaan tanpa dibuatnya perjanjian secara tertulis, sehingga berpotensi menimbulkan ketiadaan perlindungan hukum bagi pelaku usaha teri crispy. Kendala ini semakin mengemuka ketika transaksi jual beli teri crispy tidak hanya dilakukan secara offline dimana pelaku usaha teri crispy dan pembelinya bertatap muka secara langsung, melainkan juga secara online melalui jaringan internet. Oleh karena itu berdasarkan permasalahan tersebut dilakukan kegiatan pengabdian masyarakat untuk memberikan pengetahuan terkait pendampingan hukum dalam pembuatan kontrak untuk lebih menjamin perlindungan hukum bagi pelaku usaha.

Terbitnya UUPA 60 Tahun yang lalu, belum menjamin perwujudan tujuan dari peraturan tersebut yakni dapat memberikemungkinan akan tercapainya, fungsi bumi, air dan ruang angkasa, yang sesuai dengan kepentingan rakyat Indonesia.Pendapat ini dapat dilihat dari masih banyaknya rakyat Indonesia yang belum memiliki tanah untuk rumah tinggal sebagaikebutuhan primer setelah kebutuhan pangan. Jumlah tanah di Indonesia tidak diimbangi dengan jumlah penduduk, olehkarena itu perlu dilakukan pemerataan penguasaan tanah agar tidak timbul penguasaan tanah yang melebihi batas maksimumbagi golongan tertentu. Sebagaimana diketahui bahwa pemerintah pernah menerbitkan Kepmen Agraria/Kepala BPN Nomor6 Tahun 1998 tentang Pemberian Hak Milik Atas Tanah Untuk Rumah Tinggal, yang mana dalam aturan tersebut disebutkanbahwa seseorang tidak boleh memiliki lebih dari 5 bidang tanah dengan status hak milik yang seluruhnya meliputi luaslebih dari 5.000 m2, namun praktek di lapangan seseorang dapat memiliki hak milik lebih dari batas yang telah ditetapkan.Kelemahan dalam aturan itu tidak memberikan sanksi apabila ketentuan tersebut dilanggar, dengan demikian banyak oknumyang memanfaatkan kekosongan norma dalam aturan tersebut demi kepentingan pribadi. Pendekatan yang digunakan dalamtulisan ini adalah pendekatan undang-undang, pendekatan sosio legal dan pendekatan kasus. Hasil akhir adalah menemukanmodel pengawasan dan perombakan kembali penguasaan tanah hak milik. Dengan adanya model tersebut maka tujuanpasal 33 ayat (3) Konstitusi Indonesia yaitu meningkatkan kesejahteraan warga negara Indonesia dapat dioptimalkan.

After the issuance of Law Number 23 Year 2014 jo. Law Number 9 Year 2015 on Regional Government, the affairs of local government in the field of land services, especially agriculture and plantations have shifted the authority of regulation which is different from the regulation in Law Number 32 Year 2004. The presence of the regional autonomy-based regulation had established the land agency in the provinces, districts/municipalities which were given authority to hold land affairs. Land affairs was originally the authority of the National Land Agency. These developments cause problems including overlapping authority. If the conflict is not well regulated, in legal perspective, it will emerge the problem of legal uncertainty while in management perspective, it causes inefficiency. Due to the shifting of this land affairs basis, it is necessary to harmonize the land affairs related to regional autonomy so that the authority overlapping is not done simultaneously between the central government and local government. The method used in this research is statute, conceptual and case approach. The research concluded to propose a model of improving land services in agriculture and plantation sectors between central and local government. Abstract The dynamics of land in Indonesia have led to various conflicts, one of which is proof of land rights in the form of land rights certificates. The existing conditions, until 2021, it turns out that many rights subjects do not have land rights certificates; they only rely on evidence in the form of old rights, including girik, pipil, kekitir. The proof of the ancient rights proved to be less able to guarantee legal certainty and legal protection than the certificate of land rights stated in the UUPA. In addition, there is Regulation Number 1 of 2021 concerning Electronic Certificates that must be applied. This situation will be a problem that will be discussed related to land registration which is done manually turning into electronic, which is later expected to make it easier for the community to obtain proof of ownership of their land rights. This activity is part of implementing the Tri Dharma of Higher Education, one of which is community service in the form of legal counseling. Through this activity, it is hoped that the community can play an active role in registering proof of land rights for certification and encourage the achievement of "no land ownership without certificates" that the Government can carry out. The legal system of inheritance in Indonesia is divided into three systems, namely western heirs legal system derived from burgerlijk wetboek (hereinafter referred to as "BW"), the legal system of inheritance of Islam derived from the Qur'an, hadith and ijma, and customary inheritance law. Burgerlijk Wetboek inheritance law governing the possible legacy of someone who would fall into the state and controlled by the state. In certain cases the state on an inheritance from the testator if the testator leaves no heir, and wills, so that the legacy of the heir to the legacy categorized as slipshod heritage (onbeheerde nalatenschap). In this case the Orphan’s Court takes its participation to act as the manager of the neglected. The method used in this research is the approach statute and case approach. The study is in the context of the legal approach doctrinal legal research, but did not rule on the legal interpretation methods can be primarily related to the issues to be investigated. Regulation of Orphan’s Court in Indonesia remains sectoral and still former colonial possessions, so that the necessary regulations concerning Orphan’s Court Law form containing tasks, functions, powers, rights and obligations of the institution.

Based on Law No. 6/2014 concerning Village in Indonesia, in order to increase the utilization of all economic potentials, economic institutions, as well as natural resources and human resources in an effort to improve welfare of the village communities, the village government can form village-owned enterprise (BUMDes). In its practice, implementation of the BUMDes management in several regions is not fully optimized, so that many cases of corruption were found. Thus, good governance practices are needed for optimizing the management of BUMDes to improve the livelihoods of the village. The methods used in this research is statute approach, conceptual approach, and case approach. The conclusions obtained in this research are directed to contribute to the concepts of strengthening the national law related to the management of BUMDes. Hopefully, it can strengthen the village's economy and reduce the level of corruption in Indonesia that is detrimental for the village.

Land is one of the important elements for social lives. Because really that important, the land which was the one of elements of the agrarian in the life of the Indonesian constitutionality has been regulated in Law Number 5 of 1960. This arrangement is intended to ensure a certainty of legal, in which the land was necessary a land registration in order to provide such certainty and legal protection to the rights holders, their rights which later on the outcome of those with registration certificate as a strong evidence. However due to the development of technology that so rapidly now this, then in terms of registering land even until issue certificates have can be done online/electronic. So that with the latest regulation regarding electronic acticity creates a new problem in terms of proof power between conventional certificates and electronic certificates.

AbstractWhen we are talking about the use of land in Indonesia, as an agricultural country, Indonesia has many talented individuals who are more than capable of managing and cultivating the land. Unfortunately, most of these gifted people do not own the land themselves. Indeed, it is not because they do not want to, but because most land already has its owner. On the other hand, there are numerous unused and neglected lands in Indonesia on which the owner cannot manage and cultivate the land themselves. Such an unfortunate situation causes the purpose of the land to achieve prosperity and welfare for the common good of the people to be a meaningless cliché and practically unachievable. For the same situation, the United Kingdom has a concept of land management called the trust of land. This article aims to identify whether the legislators can adopt this concept into the sphere of Indonesian agrarian law where this adoption might achieve the aim of common welfare within Law Number 5 of 1960. This article will provide a conceptual illustration and advice to the legislators to minimise the number of unused and neglected land in Indonesia to actualise Article 33 Clause (3) of the Constitution for the land to be used for the most benefits of the people. AbstrakBanyaknya tanah-tanah telantar yang ada di penjuru Republik Indonesia membuat tujuan penggunaan dan pemanfaatan sumber daya agraria untuk menciptakan kemakmuran dan kesejahteraan bagi seluruh rakyat Indonesia tidak tercapai. Dalam satu sisi, banyak rakyat yang tidak memiliki tanah untuk digarap bahkan untuk ditinggali, padahal mereka merupakan bagian dari bangsa Indonesia. Melihat kondisi di atas, Britania Raya memiliki konsep pengelolaan lahan yang bernama trust of land. Tujuan dari penulisan artikel ini yakni apakah legislator Indonesia dapat mengadopsi konsep trust of land ke dalam sistem hukum agraria di Indonesia, sehingga pemanfaatan sumber daya agraria dapat lebih memberikan manfaat dan berkelajutan seperti yang diharapkan dari ketentuan Undang-undang No. 5 Tahun 1960. Tujuan dari penulisan artikel ini yakni memberikan gambaran serta masukan kepada legislator dalam upaya meminimalisir tanah-tanah terlantar yang ada di Wilayah Republik Indonesia agar dapat dimanfaatkan untuk sebesar-besar kemakmuran rakyat sebagaimana tertuang dalam ketentuan Pasal 33 ayat (3) Konstitusi Indonesia. AbstractInter-religious marriage is not something new in Indonesia. Judging from the diversity of religions that exist, it does not rule out the possibility of inter-religious marriages. However, inter-religious marriage is still a polemic among the public because the Law of the Republic of Indonesia Number 1 of 1974 concerning Marriage, does not explicitly regulate and accommodate the problem of inter-religious marriage, especially after the enactment of Law Number 23 of 2006 concerning Administration Population, the opportunity to legalize inter-religious marriages seems to be wide open, namely with the availability of the option of submitting an application for interfaith marriages to the District Court to issue a stipulation allowing interfaith marriages and instructing Civil Registry office employees to record these interfaith marriages into Register of Marriage Registration. In the end, people often smuggle laws in ways that are not justified, for example by providing false information that they have changed religions and follow the religion of their partners. Or by carrying out marriages abroad which allow marriages of different religions, and then registering them at the civil registry office. This study aims to find out how Indonesian law views inter-religious marriages and how inter-religious marriages are regulated from a comparison of the laws of other countries, such as those in Canada, Singapore, England and the Netherlands. This study uses a statutory approach, namely an approach that is carried out by examining all laws and regulations that are related to the legal issues under study. The results of this study will provide input to Indonesian legislators which can be used as an improvement in regulations, especially provisions related to inter-religious marriage.Keywords: Interfaith Marriage; Reduced Inequalities; Comparative Civil Law; Peace and Justice.
