Abstract

The transformation driven by artificial intelligence technology has given rise to digital rights with economic value. However, Islamic jurisprudence lacks a clear classification regarding the ownership and inheritance of accounts, data, generative works, and platform access rights. The core issue lies in distinguishing between māl (wealth/property), milk (ownership), ḥaqq (right), manfaʻah (usufruct/benefit), and contractual licenses, as well as determining which digital rights may constitute part of the tirkah (estate). This study aims to classify the legal status of family digital assets, examine the validity of qiyās (legal analogy)—by identifying the aṣl (original case), farʻ (branch case), ḥukm al-aṣl (ruling on the original case), and ʻillah (legal cause)—and determine the limits of their inheritance. This normative legal research employs uṣūl al-fiqh (principles of Islamic jurisprudence), conceptual, and analytical approaches, drawing upon naṣṣ (scriptural texts from the Qur’an and Hadith) regarding inheritance, literature on qiyās, jurisprudence concerning māl and ḥuqūq (rights), as well as fatwās and digital regulations. The analysis involves mapping the characteristics of each asset, comparing the ʻillah with concepts of usufruct, intellectual property rights, and intangible assets, and testing the applicability of the original legal ruling to the digital object. The findings indicate that accounts and access rights are not uniform as objects of inheritance, as some are personal in nature and subject to platform contracts; economically valuable personal data can be the subject of rights, subject to limitations on control and transfer; generative works are inheritable provided the deceased held economic rights; and usufruct rights and licenses are inheritable only to the extent permitted by the nature of the right and contractual terms. An ʻillah based solely on economic value is insufficient; recognized utility, lawful control, transferability, and the continuity of economic rights serve as determining factors. Qiyās is valid only to a limited extent, specifically when the ʻillah in the farʻ corresponds to that of the aṣl. These findings underscore the need for a digital jurisprudence that distinguishes between ownership, usage rights, and licenses regarding the deceased’s estate.

Abstract

The curriculum is a fundamental element in the educational process that influences the trajectory and caliber of schooling. This study seeks to examine and comprehend the opinions of school principals concerning curriculum management in both public and private schools, specifically addressing the execution of the independent curriculum. This research employs a qualitative design, specifically a literature review or library study. The data were gathered through a literature examination of books, scientific journals, articles, and pertinent policy papers. The results indicate a significant divergence in the interpretation of the curriculum by school principals. Public school principals prioritize adherence to governmental rules, bolstered by resources and training, yet encounter difficulties in teacher adaptation and managing a substantial student population. Conversely, private school principals saw the curriculum as a malleable domain for innovation, but constrained by financial resources and insufficient continuous training. The perceptions of school principals are shaped by internal and external variables, organizational culture, educational policies, and resource availability. This research advocates for the enhancement of school administrators roles by ongoing training, fostering collaboration among schools, and instituting adaptive policies to ensure optimal curriculum management in each institution. The research findings offer practical contributions to policymakers and education administrators while also enhancing scholarly understanding of educational administration and school leadership in Indonesia

Abstract

This study aims to provide an in-depth understanding of the role of assistive technology in developing an inclusive curriculum by examining the perspectives of teachers and students. The research uses a qualitative method with a literature review approach based on data from Google Scholar and SINTA. The results show that assistive technology plays an important role in supporting the learning process of students with special needs, using the Universal Design Learning (UDL) framework. For students with special needs, this assistive technology can help them appear more confident and increase their independence. For teachers, operating this assistive technology remains challenging, with some obstacles such as a lack of professional training, infrastructure limitations, and administrative burdens hindering the effective use of technology. Therefore, this research emphasizes the need for ongoing training for teachers to ensure that assistive technology-based learning for students with special needs can be evenly accessible to all students with disabilities in Indonesia. The implications of this study suggest that educational institutions and policymakers should prioritize investment in assistive technologies, teacher training, and inclusive learning infrastructures to ensure equitable educational opportunities for students with disabilities. Strengthening these aspects is expected to improve the quality and sustainability of inclusive education practices in Indonesia
