Abstract

Terrorism is considered an extraordinary crime characterized by organized, covert, and technology-based activities. These characteristics create significant challenges in the evidentiary process, as conventional forms of evidence are often insufficient to reveal the involvement of perpetrators. This study aims to analyze the expansion of evidentiary instruments in proving terrorism offenses following the enactment of Law Number 5 of 2018. The research employs a normative legal method using statutory and conceptual approaches. The findings indicate that Law Number 5 of 2018 expands the scope of admissible evidence, particularly electronic evidence and intelligence information, in the prosecution of terrorism crimes. This expansion is intended to adapt the evidentiary system to modern crimes involving technology and transnational networks. However, the use of electronic evidence and intelligence information still raises legal issues concerning formal legality, authentication, and the protection of human rights within the criminal justice process. Therefore, clearer regulations and proportional implementation are necessary to ensure that the expansion of evidence remains consistent with the principles of due process of law and the negative statutory evidentiary system applied in Indonesia.
