Abstract

The Omar Al-Bashir case is a significant milestone in the development of international criminal law, involving allegations of genocide, crimes against humanity, and war crimes committed in Darfur, Sudan. This study aims to analyze the international legal framework governing international crimes in the Omar Al-Bashir case and to examine the responsibility of a head of state under international law. This research employs a normative legal method using statutory and conceptual approaches. The findings indicate that the alleged acts committed by Omar Al-Bashir fall within the categories of international crimes under the Rome Statute of 1998. Although Sudan is not a State Party to the Rome Statute, the International Criminal Court (ICC) obtained jurisdiction through a referral by the United Nations Security Council. Furthermore, the principle of individual criminal responsibility affirms that the official position of a head of state does not exempt an individual from criminal liability for international crimes. However, accountability before the ICC has not yet been fully implemented because Omar Al-Bashir has not been surrendered to the Court. Therefore, the effectiveness of international criminal law enforcement remains dependent on state cooperation and the commitment of the international community.
