Abstract

This study examines the tradition of uang panai' in customary marriage in Tonrokassi Village, Tamalatea District, Jeneponto Regency, from the perspective of 'urf. It aims to identify how the local community understands this tradition, examine its impact on the continuity of marriage, and analyze its standing within the framework of 'urf in Islamic law. Using a qualitative field research design with a normative-sociological approach, data were gathered through semi-structured in-depth interviews with customary leaders, religious figures, married couples, and village officials, complemented by participant observation and documentation, and analyzed through an interactive model of data reduction, display, and conclusion drawing. The findings show that uang panai' is understood as a form of respect toward the bride's family and a marker of the groom's seriousness, distinct from the mahar. While the tradition offers genuine benefits financing weddings and strengthening family ties an excessively high amount, often driven by social prestige rather than economic capacity, can lead to debt, delayed marriage, or cancellation. Based on this analysis, the study argues that uang panai' may be classified as 'urf ṣaḥīḥ when it generates benefit (maṣlaḥah) and remains proportionate to the couple's economic capacity, but shifts toward 'urf fāsid when it produces hardship (mafsadah), pointing to the need for its practice to be reconstructed toward greater deliberation and economic fairness.
