Abstract

The development of artificial intelligence technology has given rise to algorithmic trading systems that operate automatically within the Indonesian capital market. This phenomenon presents new juridical challenges in the context of sharia compliance, considering the absence of regulations that explicitly govern algorithmic trading within the framework of Islamic economic law. This study aims to analyze the aspects of sharia compliance in algorithmic stock trading activities based on the regulations of the Indonesian Financial Services Authority (Otoritas Jasa Keuangan/OJK), fatwas issued by the National Sharia Council of the Indonesian Ulema Council (Dewan Syariah Nasional Majelis Ulama Indonesia/DSN-MUI), and the principles of fiqh muamalah. Employing a normative juridical approach with descriptive-analytical analysis, this research finds that algorithmic trading contains potential violations related to the prohibitions of gharar, maysir, and market manipulation, all of which contradict sharia principles. Nevertheless, through the implementation of appropriate sharia screening mechanisms and adequate regulatory supervision, algorithmic trading can be integrated into the Indonesian sharia capital market ecosystem. This study recommends the issuance of a specific DSN-MUI fatwa concerning algorithmic trading, as well as the strengthening of OJK regulations to ensure sharia compliance in financial technology innovation

Abstract

The development of the digital economy in Indonesia has introduced various technology-based financial transaction innovations, such as fintech, e-wallets, peer-to-peer lending, and sharia e-commerce. On the other hand, this transformation requires harmonization between sharia principles and national positive law in order to establish legal certainty, consumer protection, and sharia compliance. This article aims to analyze the integration of sharia principles into digital economic regulations in Indonesia and to identify the challenges of harmonization between sharia fatwas and state regulations. The research method employs a normative approach through literature studies on statutory regulations, DSN-MUI fatwas, and various scientific journals related to the sharia digital economy. The findings indicate that regulatory harmonization still faces several obstacles, including dualism of authority, normative disharmony, technological developments that progress faster than regulations, and weak supervision of sharia compliance in digital platforms. Therefore, regulatory synchronization among the government, the Financial Services Authority (OJK), Bank Indonesia, and DSN-MUI is necessary to create an innovative digital economic system that remains aligned with sharia principles

Abstract

The development of global digital trade has challenged the classical doctrine of Islamic contract law, particularly the concept of Ittihad al-Majlis in electronic contracts and smart contracts. This normative legal research aims to analyze the validity of the unity of assembly in digital transactions, the harmonization of sharia principles with the UNCITRAL Model Law on Electronic Commerce, and the reformulation of Islamic contract law in Indonesia. Using a descriptive-prescriptive approach and comparative analysis across Islamic schools of thought, this study finds that the concept of Ittihad al-Majlis should be interpreted as unity of time rather than unity of place. The validity of digital transactions may be strengthened through data authentication standards and the modern concept of kitabah as regulated by UNCITRAL and AAOIFI Sharia Standard No. 38. The study further recommends the reformulation of the Compilation of Sharia Economic Law through the recognition of automated execution, the regulation of digital platform liability, and the integration of Digital Khiyar to ensure legal certainty and the protection of property (Hifdz al-Mal). The implications of this study indicate the necessity of developing a more adaptive Islamic legal framework capable of accommodating technological innovation while maintaining sharia compliance, thereby strengthening legal certainty, consumer protection, and the competitiveness of Islamic digital commerce at both national and global levels.
