Abstract

This paper examines the minimum age limit for filing a marital dispensation focused on the Central Java Religious Courts. This paper examines the judge's policy in the marital dispensation in religious courts in Central Java regarding the marital age limit by using anthropology approach. by reviewing the judges' decisions in the marital dispensation cases focusing on the tendency of the brides' ages to see the minimum age to have marital dispensation in each region. The research shows that the lowest age to file a marital dispensation in Central Java is 12 years 9 months for female, and 15 years 10 months for male. The majority of judges do not consider the age of the parties, but rather the reasons and conditions of the party submitting.Artikel ini membahas batas usia minimum untuk mengajukan dispensasi perkawinan yang berfokus pada Pengadilan Agama Jawa Tengah. Makalah ini membahas kebijakan hakim dalam dispensasi perkawinan di pengadilan agama di Jawa Tengah mengenai batas usia perkawinan dengan menggunakan pendekatan antropologi. dengan meninjau keputusan hakim dalam kasus dispensasi perkawinan yang berfokus pada kecenderungan usia pengantin untuk melihat usia minimum untuk memiliki dispensasi perkawinan di setiap wilayah. Penelitian menunjukkan bahwa usia terendah untuk mengajukan dispensasi perkawinan di Jawa Tengah adalah 12 tahun 9 bulan untuk perempuan, dan 15 tahun 10 bulan untuk laki-laki. Mayoritas hakim tidak mempertimbangkan usia partai, melainkan alasan dan kondisi dari partai yang mengajukan.

Abstract

This paper examines the response and attitude of the Indonesian Ulema Council (MUI) to practice interfaith marriage and study the influence of MUI in the development of the rules of interfaith marriage. Research data is taken through online media accessible in the news online, website and fatwa MUI as well as other supporting sources. This paper argues that MUI keep trying to assert the prohibition of marriage between religions through their fatwas and through responses in the media to the proliferation of interfaith marriages. Other responses are also in presented by the Indonesian Ulema Council through information when asked for opinions in the Judicial Review and when asked for the same opinion on social media. MUI's attitude is also shown through the lawsuit against the Surabaya District Court for granting interfaith marriage. This paper found that the effect of MUI on marriage rules was different from religion can be seen clearly by issuing rules regarding interfaith marriage, through Circular Letter Number 2 of 2023 concerning the prohibition of judges from granting a marriage of different faiths so that the Indonesian Ulema Council seems to provide the influence on law is particularly high in interfaith marriages in Indonesia.

Abstract

The government, in ensuring children's identity rights, has issued a policy regarding the issuance of family cards for unregistered marriages. This policy facilitates access to birth certificate registration for children from unregistered marriages. However, in practice, the implementation of this policy has sparked issues among judges and marriage registrars. The research was to analyze the debates surrounding the state legal policy on the issuance of family cards for couples in unregistered marriages in an effort to protect the civil rights of Muslim children. The study was an empirical legal research with a socio-legal approach. Primary data was obtained from legal officials from the KUA and religious courts in Kediri to describe the debates surrounding this regulation, which were then analyzed using the theory of contestation. The findings of this study indicated that children's rights in Islamic families include administrative rights as citizens and inherent rights as members of the Muslim family. The policy regulating the issuance of family cards for couples in unregistered marriages has become a polemic among Islamic legal officials, such as religious court judges, headmen, and KUA officials because it is seen as conflicting with the established Islamic family marriage rules in Indonesia. The meeting point between the two has not yet fully matured, as Islamic legal officials seek clearer regulations, emphasizing that couples in nikah siri should immediately conduct isbat nikah at the Religious Court.

Abstract

The issue of interfaith marriage is an interesting topic to be discussed again. Because the rules regarding interfaith marriage in Indonesia make multiple interpretations of permissibility or not. Couples want to carry out interfaith marriages can carry out marriages abroad or submit requests to court judges. The judge has full authority to grant or refuse. This study focuses on two cases that were submitted to the district court, No 122/Pdt.P/2020/PN.Pti and 42/Pdt.P/2014/PN.Ung. The author's reason for studying the two decisions is the similarity of the beliefs of the parties, namely men who are Muslims and women who adhere to Christianity. The focus of the first study was to dig up witness statements and the consent of the parents of both parties. Second; whether the authentic evidence presented at trial is a major consideration. The results of this study reveal that the strength of witness testimony and parental consent as well as authentic evidence that can be presented in court makes the judge grant the request.  [Isu Pernikahan beda agama menjadi topic yang menarik untuk diperbincangkan kembali. Karena aturan mengenai pernikahan beda agama di Indonesia menjadikan multitafsir tentang kebolehan atau tidak. Pasangan yang hendak melakukan pernikahan beda agama dapat melakukan pernikahan di luar negeri atau mengajukan permohoann kepada hakim pengadilan. Hakim mempunyai kewenangan penuh untuk mengabulkan atau menolak. Kajian ini memfokuskan pada  kepada dua kasus yang diajukan kepada pengadilan negeri yaitu Nomor 122/Pdt.P/2020/PN.Pti dan 42/Pdt.P/2014/PN.Ung. Alasan penulis mengkaji dua putusan tersebut adalah kesamaan kepercayaan para pihak yaitu laki-laki beragama Islam dan perempuan menganut agama Kristen. Fokus kajian pertama yaitu menggali Keterangan Saksi dan izin orang tua kedua belah pihak. Kedua; apakah bukti autentik yang dihadirkan dalam persidangan menjadi pertimbangan utama. Hasil penelitian ini mengungkapkan bahwa kuatnya kesaksian saksi dan izin orang tua serta bukti autentik yang dapat dihadirkan dalam persidangan membuat hakim mengabulkan permohonan.]

Abstract

Abstract: This paper examines the legal considerations used by judges in the case of marriage dispensation at the Makassar Religious Court. This paper focuses on two things, first, the judge's consideration in deciding the marriage dispensation case, while the second focus is on the age of youngest couple who applied for a marriage dispensation. The marriage dispensation decision at the Makassar Religious Court is used as the primary source, while the secondary sources are collected from interviews and scientific works related to the topic of this research. Legal pluralism is applied as an approach to determine which law is more dominant in granting marriage dispensation in Makassar. The results revealed that majority of judges use customary law as a legal consideration in granting marriage dispensation cases at the Court. The judge used customary law as a consideration to granting a marriage dispensation application. It is reported that the youngest age in the marriage dispensation was 13 years for women and 14 years for men. The author found that 13 of the 16 cases of marriage dispensation stated that the child of the applicant who filed the marriage dispensation case was not pregnant. Abstrak: Paper ini mengkaji tentang pertimbangan hukum yang digunakan oleh hakim dalam memutuskan perkara dispensasi nikah di Pengadilan Agama Makassar. Tulisan ini berfokus pada dua hal, pertama, pertimbangan yang digunakan hakim dalam memutuskan perkara dispensasi nikah. Kedua fokus pada berapa usia pasangan termuda yang mengajukan dispensasi nikah. Putusan dispensasi nikah di Pengadilan Agama Makassar penulis gunakan sebagai sumber primer, sedangkan sumber sekunder penulis dapatkan dari wawancara dan karya ilmiah yang berkaitan dengan topik penelitian ini. Pluralisme hukum diterapkan sebagai pendekatan untuk menentukan hukum mana yang lebih dominan dalam pemberian dispensasi perkawinanPengadilan Agama Makassar. Hasil penelitian menunjukkan bahwa mayoritas hakim menggunakan hukum adat sebagai pertimbangan hukum dalam mengabulkan perkara dispensasi nikah di Pengadilan. Hakim menggunakan hukum adat sebagai pertimbangan untuk mengabulkan permohonan dispensasi nikah. Penelitian ini mengungkapkan bahwa usia termuda dalam dispensasi perkawinan adalah 13 tahun untuk perempuan dan 14 tahun untuk laki-laki. Penulis menemukan bahwa 13 dari 16 kasus dispensasi nikah menyatakan bahwa anak pemohon yang mengajukan dispensasi nikah tidak hamil.

Abstract

This paper examines the provisions of the minimum age of marriage by considering regulations in various Muslim countries. Besides, this paper also discusses why Indonesia experienced resistance in changing the rules of the minimum age. Using a sociological approach, this paper examines the minimum age limit in various Muslim countries and efforts in renewal the minimum age limit in Indonesia. Data collection is done through literature review, decisions, and related journals. This data is supported by the information from interviews on the judge’s attitude and response. The author interviewed 6 judges of the Bantul and Wonosari Religious Courts. This paper confirms that efforts made by several institutions to raise the minimum age of marriage have been made. One of them is the submission of Judicial Review No. 30-74 / PUU-XI / 2014 to the Constitutional Court, which was unfortunately rejected. One of the legal considerations of the Constitutional Court Judge is that the application is considered contrary to the 1945 Constitution. The prevailing customary law and cultural diversity in Indonesia have significant influence in increasing the minimum age, because one community has different views with others on the minimum boundary age of marriage. Besides, the Constitutional Court judges consider that raising the minimum age does not have a significant influence on reducing child marriages and some other adverse effects, but that influence emerges from the internet. The study also argues that these changes are considered not in harmony with all the different interests of society. This was also in line with the response of 6 judges in the Bantul and Wonosari Religious Courts.
