Abstract

Penegakan hukum merupakan upaya tegaknya serta berfungsinya nilai-nilai keadilan yang tertuang dalam aturan formal. Namun, yang kerap menjadi penghambat adalah tindakan oknum aparat penegak hukum yang bertentangan dengan prosedur yang ada. Artikel ini membahas penegakan hukum di Indonesia dalam perspektif konstitusi dan asas equality before the law dengan menggunakan metode penelitian yuridis-empiris melalui studi kepustakaan. Hasilnya, terjadinya beberapa penyimpangan dalam proses penegakan hukum yang menjadi hambatan dalam mewujudkan asas equality before the law. Penyebab yang paling mempengaruhi, salah satunya, moralitas dari aparat penegak hukum itu sendiri.

Abstract

Marriage is an inner and outer bond between a man and a woman as husband and wife, with the aim of forming a happy and eternal family based on the One Godhead. The pillars of marriage include prospective husbands, prospective wives, marriage guardians, two witnesses, and consent. The wali adhal case that took place at the Nganjuk Religious Court occurred when the prospective bride's lineage guardian hesitated or even refused to marry her daughter on the grounds that the prospective groom was not yet established in his work or because of problems with Javanese customs calculations, including house directions and calculations wetton. A guardian who does not want to marry off his daughter is called a wali 'adhal. The focus of the problem taken is how the procedure and form of the determination of guardian adhal and the basis for consideration of the panel of judges in granting the determination of the guardian judge to replace wali adhal at the Nganjuk Religious Court. It is a normative legal research, with a case approach and a conceptual approach. Using primary legal materials, secondary legal materials, and non-legal materials. The procedure and form of stipulation of guardian adhal at the Nganjuk Religious Court is in accordance with the applicable laws and regulations. The basis for the consideration of the panel of judges at the Nganjuk Religious Court which granted the determination of the guardian judge to replace the guardian adhal due to customary reasons and economic problems in the determination of 3 (three) cases was not in accordance with syar'i law. The reason does not concern the pillars and conditions for the validity of a marriage as required by syar'i law and the prevailing laws and regulations in Indonesia, so that reason must be set aside and the application granted.

Abstract

The income factor is often the reason for divorce by petition, a phenomenon of high divorce rates in Indonesia. Furthermore, this problem has resulted in various analytical results. It is very embarrassing that all these analyses tend to blame one party, namely that often, the wife is blamed without presenting writings about wise efforts to resolve relationship problems that lead to mutualism. Apart from that, previous researchers were still trapped in understanding the husband-and-wife relationship as a relationship that was nothing more than a matter of the rights and obligations of husband and wife, which were considered absolute. Even though the perspective of interdependence as something prescribed in Islam has begun to be discussed, there has been no study or offer on how to improve the pattern of interdependence in the lives of husbands and wives. This research aims to provide a practical way to create an egalitarian relationship between husband and wife by first uncovering the causes of the difficulty of implementing an egalitarian pattern in husband-and-wife relationships, which is a factor in the increase in divorce cases due to income reasons. This research uses an empirical or psychological phenomenological approach based on Gary Chapman's "Five Main Love Languages" theory. In selecting subjects, researchers used purposive sampling. Researchers conducted interviews with four ex-husband and wife couples in cases of divorce for reasons of livelihood in the jurisdiction of the Kediri City Religious Court. The result is a vacuum of emotional affection between husband and wife, which causes the wife to resist and be unable to give up her desire to fulfill household needs, a form of contextual and egalitarian role division. Instead of creating an egalitarian husband and wife relationship, the relationship ended in divorce. Thus, a sufficient husband and wife's love tank is the primary condition for carrying out their roles contextually and egalitarian.

Abstract

In the modern social context, the practice of unregistered marriage is becoming increasingly prominent as a phenomenon with complex nuances. This is due to a number of external and internal factors which also encourage and influence people to do so. A deep understanding of the factors that drive this phenomenon is very important to develop appropriate strategies to overcome and reduce negative impacts in modern society. This is normative legal research using a conceptual approach. The factors behind the occurrence of unregistered marriages are economic factors, not being old enough, official/work or school ties, the assumption that unregistered marriages are legal according to religion and registration is only an administrative order, pregnancy out of wedlock as an effect of promiscuity, and social. The impacts that cause unregistered marriages in the modern social era are positive impacts, namely avoiding adultery, while negative impacts include legal, economic, sociological, educational, cultural and psychological impacts. The conditions for a valid marriage according to applicable law in Indonesia are that it be carried out according to the laws of each religion and belief, and recorded according to applicable laws and regulations.

Abstract

Marriage is permitted for those who have fulfilled the marriage requirements as regulated in statutory regulations. Among them, the minimum age for marriage for prospective male and female brides is the same, 19 years. For those who do not meet the minimum age requirements, marriage can still take place after receiving a marriage dispensation from the court. Data shows that there are a lot of requests for marriage dispensation in Indonesia, in fact every year there is a significant increase. The Kediri City Religious Court only has 3 sub-districts, in 2022, 69 marriage dispensation cases will be accepted. The reason that is often given is that the relationship between the prospective bridegroom and the female is very close, parents/guardians are afraid and worried that they will increasingly fall into actions that are contrary to morals or religion, and quite a few of the prospective wives are already pregnant. In adjudicating cases regarding requests for marriage dispensation, the court often considers two disadvantages, which occur as a result of early marriage and if the marriage dispensation is rejected. Interesting, knowing the practice and position of children in conflict with the law in cases of requests for marriage dispensation at the Kediri City Religious Court. The practice of marriage dispensation application cases is in accordance with general civil procedural law and statutory regulations, especially Law Number 16 of 2019, Law Number 23 of 2002, and Supreme Court Regulation Number 5 of 2019. The examination is in accordance with the principles -the principle of children dealing with the law, because every case involving children is required to consider the best interests of the child so that the determination must take an approach to the best interests of the child, which is carried out comprehensively.

Abstract

Setiap tahun terdapat perkara permohonan dispensasi kawin yang diajukan ke Pengadilan Agama Kota Kediri, dengan banyaknya kasus pernikahan dini, terlihat bahwa angka perceraian disebabkan oleh pernikahan anak di bawah umur. Perkawinan anak harus dicegah karena melanggar hak asasi manusia dan melanggar hak anak. Penelitian ini termasuk jenis yuridis normatif, menggunakan pendekatan kasus dan pendekatan konseptual. Sumber data diambil dari hasil penetapan permohonan dispensasi kawin di Pengadilan Agama Kota Kediri dan dikuatkan dengan wawancara, kemudian dianalisis dengan metode sadd al-dzari’ah. Hasil penelitian ini terdapat tiga faktor yang melatarbelakangi permohonan dispensasi kawin yaitu sebab hamil di luar nikah, faktor terjalinnya hubungan yang lama, dan faktor budaya. Pertimbangan hakim dalam menetapkan dispensasi kawin sebab hamil di luar nikah telah sesuai dengan tujuan utama sadd al-dzari’ah yaitu mencegah perzinaan lebih lanjut dan menghindari kekosongan status hukum, serta akan terjadi madharat berupa lahirnya anak tanpa ayah dan tidak adanya nafkah untuk ibu hamil tersebut, serta tidak ada nafkah untuk istri yang melahirkan dan menyusui. Pertimbangan hakim dalam mengabulkan sebab terjalinnya hubungan yang lama telah sesuai dengan tujuan utama sadd al-dzari’ah dari segi mashlahah dan mafsadah yang ditimbulkan. Maka, dispensasi kawin diberikan dengan alasan apabila tidak diberikan dapat menimbulkan fitnah dan pelanggaran hukum.

Abstract

Pernikahan dini dan perundungan (bullying) merupakan dua isu yang krusial di kalangan remaja Indonesia. Kedua masalah tersebut memiliki dampak yang signifikan terhadap perkembangan fisik, mental, dan sosial remaja. Dalam upaya mengurangi insiden pernikahan dini dan perundungan pada remaja, diperlukan penyuluhan hukum sebagai upaya preventif. Penyuluhan hukum merupakan kegiatan edukasi yang bertujuan untuk meningkatkan pemahaman masyarakat tentang hukum yang berlaku. Penyuluhan ini sangat penting dalam mencegah pernikahan dini dan perundungan dengan cara meningkatkan kesadaran hukum remaja seperti memberikan informasi mengenai undang-undang perlindungan anak, hak-hak anak, dan konsekuensi hukum dari pernikahan dini dan perundungan. Dimana kegiatan tersebut merupakan wujud nyata pengabdian Fakultas Syariah IAIN Kediri kepada masyarakat dengan metode Participatory Action Reasearch (PAR). Hasil kegiatan ini menyimpulkan bahwa penyuluhan hukum adalah alat yang efektif dalam upaya preventif pernikahan dini dan perundungan di kalangan remaja. Dengan meningkatkan kesadaran hukum dan menyediakan edukasi yang komprehensif, diharapkan insiden pernikahan dini dan perundungan dapat dikurangi secara signifikan.

Abstract

The government, in ensuring children's identity rights, has issued a policy regarding the issuance of family cards for unregistered marriages. This policy facilitates access to birth certificate registration for children from unregistered marriages. However, in practice, the implementation of this policy has sparked issues among judges and marriage registrars. The research was to analyze the debates surrounding the state legal policy on the issuance of family cards for couples in unregistered marriages in an effort to protect the civil rights of Muslim children. The study was an empirical legal research with a socio-legal approach. Primary data was obtained from legal officials from the KUA and religious courts in Kediri to describe the debates surrounding this regulation, which were then analyzed using the theory of contestation. The findings of this study indicated that children's rights in Islamic families include administrative rights as citizens and inherent rights as members of the Muslim family. The policy regulating the issuance of family cards for couples in unregistered marriages has become a polemic among Islamic legal officials, such as religious court judges, headmen, and KUA officials because it is seen as conflicting with the established Islamic family marriage rules in Indonesia. The meeting point between the two has not yet fully matured, as Islamic legal officials seek clearer regulations, emphasizing that couples in nikah siri should immediately conduct isbat nikah at the Religious Court.

Abstract

The presence of SEMA Number 2 of 2019 regarding the fulfillment of women's rights after a divorce, regarding its application at the Nganjuk Religious Court has not been carried out because there are several factors that hinder its implementation. This study uses the type of empirical legal research. This study uses an socio-legal approach, namely by knowing the facts that occur in the field, the source of the data used is primary through interviews with the Nganjuk Religious Court Judges and secondary data, namely SEMA No. 2 of 2019. The results of the research conducted show that the inhibiting factor in the implementation of SEMA No. 2 of 2019 regarding the fulfillment of women's rights after the divorce was contested, namely the absence of the husband when the divorce was contested, causing the rules not to be implemented, the absence of instructions from the head of the court who had to apply SEMA and the lack of knowledge of the divorced wife about the law, as well as the discrepancy between the Compilation of Islamic Law which requires implement the fulfillment of women's rights after a divorce.
