Abstract

This study aims to determine and analyze the effectiveness of mediation in minimizing divorce cases in the Palu Religious Court. The research method used is empirical legal research. The results of the study indicate that the implementation of mediation in the Palu Religious Court has basically been carried out in accordance with the provisions of applicable laws and regulations. However, the effectiveness of mediation in reducing the divorce rate is still not optimal. This can be seen from the high number of divorce cases that still end in divorce decisions compared to cases that are successfully resolved amicably through the mediation process. The lack of effectiveness of mediation is influenced by several factors, including the low desire of the parties to reconcile, long-standing domestic conflicts, economic problems, infidelity, domestic violence, and minimal openness and communication between husband and wife. On the other hand, the success of mediation is also supported by the active role of the mediator, the use of a persuasive approach, and the good faith of the parties to resolve the conflict amicably. Based on the results of this study, it can be concluded that mediation has a fairly important role in efforts to minimize divorce. However, for its implementation to be more effective, it is necessary to optimize the role of mediators, increase public legal awareness, and strengthen the quality of the mediation process at the Palu Religious Court.
