Abstract

This study analyzes the dialectics of Islamic law during the New Order period, focusing on the enactment of Law Number 1 of 1974 concerning Marriage and Presidential Instruction Number 1 of 1991 concerning the Compilation of Islamic Law (KHI). The study employs a normative legal research method and a historical approach to Islamic law to understand Islamic law as a product of the interaction among fiqh principles, social transformations within Muslim society, and state policy. The findings indicate that the enactment of Law Number 1 of 1974 and the KHI represented an integration of Islamic law into the national legal framework. This process involved interactions among the state, ulama’ (Islamic scholars), Islamic organizations, and the Muslim community within the context of legal modernization and the national development goals of the New Order period. The state did not merely accommodate Islamic law but also implemented standards and codification through the legislative process. The resulting dialectics influenced the authority of Islamic law, elevated the standing of the Religious Courts, and fostered the development of a more formal, administrative, and cohesive Islamic legal system within Indonesia’s national legal framework
