Penelitian ini bertujuan untuk mengetahui proses penanganan tindak pidana pembakaran hutan di Kabupaten Enrekang pada Tahun 2019 dan untuk mengetahui kendala yang dihadapi dalam memberantas praktik pembakaran hutan di Kabupaten Enrekang. Metode penelitian yang digunakan adalah penelitian kualitatif dengan pendekatan normatif empiris. Teknis pengumpulan data menggunakan studi kepustakaan dan wawancara. Analisis data dilakukan secara kualitatif deskriptif. Hasil penelitian menunjukkan bahwa penanganan tindak pidana pembakaran hutan di Kabupaten Enrekang sepanjang tahun 2019 ditangani oleh Polisi Kehutanan UPT KPH Mata Allo dan Penyidik Satuan Reserse Kriminal Kepolisian Resort Enrekang sudah sesuai denagn tupoksinya berdasarkan Peraturan Menteri Kehutanan Nomor: P.75/Menhut-II/2014 Pasal 4 ayat (2). namun, masih terkendala karena Pengadilan Negeri Enrekang belum menerima taksiran kerugian dari saksi ahli yaitu pihak Polisi Kehutanan terkait kerugian negara yang ditimbulkan. Adapun kendala yang dihadapi dalam memberantas tindakan pembakaran hutan di Kabupaten Enrekang yaitu keterbatasan sarana dan prasarana, situasi dan kondisi wilayah yang terbakar, jumlah tenaga produktif Polisi Kehutanan, estimasi perhitungan kerugian negara akibat kebakaran hutan dan tingkat kesadaran masyarakat yang masih rendah untuk tidak melakukan pembakaran pada lahan pertanian atau perkebunan. This study aims to determine the process of handling forest burning crimes in Enrekang Regency in 2019 and to determine the obstacles faced in eradicating forest burning practices in Enrekang Regency. This study was conducted at the UPT KPH Mata Allo, Enrekang Regency. The research method used is an empirical research method, namely by using literature studies, interviews and giving questionnaires to respondents. The results of the study indicate that the Handling of Forest Burning Crimes in Enrekang Regency throughout 2019 was handled by the Forestry Police of the UPT KPH Mata Allo and the Criminal Investigation Unit Investigators of the Enrekang Resort Police. The handling carried out by the Forestry Police is in accordance with its duties and functions based on the Regulation of the Minister of Forestry Number: P.75 / Menhut-II / 2014 Article 4 paragraph (2). Meanwhile, the handling of Forest Burning Crimes handled by the Enrekang Resort Police is in accordance with the police report from the Forestry Police, but the case is still constrained until now because the public prosecutor of the Enrekang District Court has not received an estimate of the losses explained by the expert witness, namely the Forestry Police regarding the state losses incurred. The obstacles faced in eradicating the practice of forest burning in Enrekang Regency are limited facilities and infrastructure, the situation and condition of the burned area, the number of productive Forestry Police personnel, the estimated calculation of state losses due to forest fires and the level of public awareness which is still low not to burn agricultural or plantation land.
