Abstract

This research aims to find out how the legal status of termination of employment (PHK) on the grounds of company efficiency as stipulated in Law Number 13 of 2003 concerning Manpower and Law Number 11 of 2020 concerning Job Creation, and also to find out how the impact of violating these rules on the existence or existence or legal status of the company or business entity. This research is a normative legal research which is a procedure for finding truth based on scientific logic from the normative side. The approach used in this research is a statutory approach and comparative approach, which is an approach carried out by comparing laws in one country with other countries or laws from a certain time and laws from another time. The results show that companies or employers who violate the provisions of Article 164 paragraph (3) of the Manpower Law and Constitutional Court Decision Number 19/PUU-IX/2011, both the decision letter of termination of employment (PHK) and the existence or existence of the company are declared null and void and contrary to the 1945 Constitution. Followed by the existence of a norm vacuum regarding the legal consequences if the company is not permanently closed, what is not clearly regulated in the new regulations, namely the Job Creation Law and Government Regulation Number 35 of 2021. The norm vacuum also occurs regarding the process of closing companies that carry out layoffs on the grounds of efficiency. It can be said that neither the old laws and regulations, nor the latest laws and regulations provide legal certainty for the parties.DOI: https://doi.org/10.26905/mlj.v3i1.7927

Abstract

The problem raised in this research is regulating workers' rights and their protection in the Law. This study uses normative legal research methods with several approaches, namely the statutory and conceptual approaches. The results of this study state that the rights of workers/laborers are essential to implement because if workers and laborers are not given rights that are by human rights, then the work carried out by workers will not be able to run correctly. Whereas the contents of the manpower articles in the Law still have several normative problems, namely not yet providing guarantees of legal certainty for guarantees for the protection of workers' rights, such as determining proper wages and eligibility for severance pay. Likewise, with the provisions regarding layoffs, the Law only accommodates the interests of employers so that it can have implications for unilateral termination of employment relations with workers. Abstract

This article identifies and analyzes the authority of provincial regionalgovernments in issuing mining permits based on Law Number 23 of 2014concerning Regional Government and Abuse of authority by Provincial Regional Governments in issuing mining business permits. The research method used is a normative legal research method. The results show that the authority to issue mining permits based on Law Number 23 of 2014 concerning Regional. Government is divided between the Regional Government and the Provincial Government. The authority to issue mining permits based on the concept of regional autonomy is more appropriate if it is owned by the regional government because the local government understands and knows their respective regions better. Furthermore, regarding licensing in the mineral and coal mining sector in the era of regional autonomy with the issuance of Law Number 22 of 1999 and updated with Law Number 32 of 2004 concerning Regional Government, Law Number 11 of 1967 concerning the principal principles of mining was originally is centralized and then adapts to the Regional Government Law to become decentralized. So that the government’s policy on licensing aspects in the mining sector in its implementation becomes overlapping between the authority of the Minister and the authority of the regent in granting permits for mining activities, resulting in misuse by the mining permit mafia by buying and selling permits, which in the end many permits are issued without following forest protection or sustainability rules. environment.

Abstract

The legal product in the form of a Regent's Regulation issued by the West Kutai Regency Government which specifically regulates Guidelines for the Implementation of Corporate Social Responsibility is a form of control function over companies operating in the West Kutai Regency area by the West Kutai Regency Government. Based on the description above, this article examines and analyzes the Implementation of the Social Responsibility Obligations of Limited Liability Companies in the Natural Resources Sector Law Number 40 of 2007 concerning Limited Liability Companies in West Kutai Regency and the factors that hinder its implementation. The research method used in this research is an empirical legal research method. Trubaindo Coal Mining in implementing the Regulations on Limited Liability Company Social Responsibility Obligations in the field of natural resources based on Law Number 40 of 2007 concerning Limited Liability Companies in West Kutai Regency has implemented the company's corporate social responsibility in accordance with the program required by the people of Muara Begai Village. Meanwhile, the inhibiting factors that arise in implementing implementation are not being able to differentiate between needs and desires, there are several groups that prioritize personal interests rather than the people at large, of course this will interfere with the company in grouping the right groups that require Corporate Social Responsibility. The lack of Human Resources (HR) cannot be denied as an inhibiting factor and unforeseen things such as natural disasters such as floods, make it impossible to carry out scheduled Corporate Social Responsibility programs.

Abstract

Kasus anak yang berkonflik dengan hukum, menurut data dari Direktorat Jenderal Pemasyarakatan Kementerian Hukum dan Hak Asasi Manusia, menunjukkan tren peningkatan pada periode 2020 hingga 2023. Per 26 Agustus 2023, tercatat hampir 2.000 (dua ribu) anak berkonflik dengan hukum. Sebanyak 1.467 (seribu empat ratus enam puluh tujuh) anak di antaranya berstatus tahanan dan masih menjalani proses peradilan, sementara 526 (lima ratus dua puluh enam) anak sedang menjalani hukuman sebagai narapidana, Unit PPA memiliki peran vital dalam memberikan pelayanan dan perlindungan hukum terhadap ABH, termasuk melalui pencegahan, penanganan kasus ramah anak, dan rehabilitasi. Penelitian ini dilakukan secara yuridis empiris yang bertempat di Unit Perlindungan Perempuan dan Anak (PPA) Kepolisian Resort Malang Kota. Dengan rumusan masalah Bagaimana peranan Unit PPA dalam penyelesaian kasus tindak pidana anak yang berhadapan dengan hukum?. Hasil penelitian menunjukkan bahwa Unit PPA berperan aktif dalam memberikan edukasi dan sosialisasi, menangani kasus dengan pendekatan ramah anak, serta bekerja sama dengan instansi terkait untuk melindungi hak-hak anak. Studi ini diharapkan memberikan gambaran komprehensif tentang operasional Unit PPA dan tantangan yang dihadapi dalam menjalankan tugasnya.

Abstract

This study evaluates 97 countries from 2012 to 2022 using a dynamic panel data approach with a threshold model, which allows for analyzing how the impact of key variables may change over time and differ across countries depending on specific conditions or thresholds This study considers the variables Total Hotel Guests, Work Participation, World Justice Project Index, and CO2 emissions. The study discovered that the quality of fair legislation significantly influences hotel performance growth, employee engagement, and environmental sustainability. The factors’ influences differ before and after attaining the World Justice Project Index threshold value, as indicated by the threshold value 1.223. When the value of the World Justice Project Index falls below the cutoff, the relationship between Total Hotel Guests and other variables is weaker. However, when the World Justice Project Index value exceeds the threshold, the relationship between Total Hotel Guests and these variables strengthens. A high World Justice Project Index reflects a strong legal system, human rights protection, and good civil justice. Countries with high World Justice Project Index values tend to attract more tourists. Work participation contributes to an increase in total hotel guests. A good World Justice Project Index creates a conducive business environment, promotes economic growth, and increases employment opportunities. Any increase in CO2 emissions will reduce the total hotel guests. A low World Justice Project Index can impact environmental quality, including air pollution. A poor environment can reduce the attractiveness of a destination and hinder tourism growth. Fair laws significantly impact the tourism and hospitality industry.

Abstract

Legal void of interfaith marriages in Indonesia to date has not offered legal certainty and sense of fairness to couples of differing religions. Particularly, their rights to form a family and to freedom of religion are unprotected; whereas those rights are guaranteed by the 1945 Constitution of the Republic of Indonesia. Furthermore, the Constitutional Court's ruling had rejected Judicial Review on Article 2 section 1 of Law No. 1 of 1974 against the 1945 Constitution of the Republic of Indonesia. The consideration provided by the Bogor District Court regarding the rejection was that the judge's interpretation of article 2 section 1, yielded the assertion that marrying couples should have been of the same faith. The judge also took into consideration the religious values embraced by the prospective applicant who happened to be a Catholic widow while the prospective groom was a Muslim. A similar consideration was made by the Constitutional Court where in, among others, it was stated that the constitutional rights of marriage entailed the obligation to respect the constitutional rights of other people. Therefore, to avoid any conflicts in the implementation of those constitutional rights, it is necessary to have a regulation on the implementation of constitutional rights conducted by the state. Consequently, the juridical implications of interfaith marriage legal norm void give rise to the judges' differing interpretations which are unfavorable to interfaith couples. The validity of these marriages cannot be accomplished, resulting in the marriages to be deemed invalid, implicating the status and position of women and children as well as heritance issues.

Abstract

The issuance of Supreme Court Circular Letter (SEMA) Number 2 of 2023 concerning Guidelines for Judges in Adjudicating Cases on Applications for Registration of Marriages between People of Different Religious Beliefs has caused problems regarding interfaith marriages in Indonesia. Both conceptually and in practice, interfaith marriages have long been controversial. Using a human rights approach, this article analyzes SEMA's position in the hierarchy of laws and regulations and the impact of SEMA Number 2 of 2023 on the independence of judges and the practice of interfaith marriages in Indonesia. The results of the analysis indicate that SEMA Number 2 of 2023 is contrary to human rights principles, especially the principles of religious rights, the right to choose a partner and the right to get married. Although the content of SEMA should only be related to technical matters of court processes, SEMA Number 2 of 2023 targets the substance of citizens’ rights; it asks judges to reject requests for the validation of interfaith marriages, even though the issue is clearly regulated by the Law on Population Administration. As a result, the chances of validating interfaith marriages through court decisions are closed. This policy not only limits the independence of judges in deciding such cases but also violates the human rights of citizens.
