Abstract

Survey of the Financial Services Authority (OJK) in early 2018 showed sharia financial literacy levels were only 8% based on inclusion rates, for sharia banks themselves reaching highest literacy rates of 6,6% literacy rates and 9% inclusion rates, this was the goal of the banking sharia, of the many obtained in each academic year, must be able to contribute to development of shariah banking literacy levels. Student markets are large for e-commerce and the market. This study looks at the level of financial inclusion of Islamic banking in e-commerce transactions. The instrument test was conducted to test the quality of the instruments used in the study using the classic assumption test, normality test, autocorrelation test, and heteroscedasticity test, the data analysis technique of this study used simple regression analysis. Abstract

The author conducts the research within the scope of the Troubled Financing Settlement Strategy on Mudharabah Agreement at Bank Muamalat Indonesia. Problem financing is a problem that is very influential on bank soundness and almost occur in some banks, not to mention the Bank Muamalat Indonesia classified as experiencing problematic financing sufficient to the spotlight in the 2014 period of 6.55% and 2015 of 7.11%. Facts prove that in 2016 Bank Muamalat Indonesia able to reduce the level of problem financing to 3.83% and in 2017 to 4.7% thus proving that in fact Bank Muamalat Indonesia able to complete financing problem well in the next year with the strategy of financing problem settlement Bank Muamalat Indonesia conducted in the year 2016. However, the current discourse of Bank Muamalat will be acquired by Minna Padi securities company due to lack of capital faced by Bank Muamalat Indonesia caused by high NPF (Non-Performing Finance) factor, more or less influenced by problematic financing including mudharabah financing. This study aims to determine the strategy of financing settlement on mudharabah contract. The results of this study show that in the handling of customers who experienced problematic financing, Bank Muamalat Indonesia using the strategy, revitalization: rescheduling, reconditioning, restructuring and management assistance, then if the customer is not well-settled then the Settlement is settled through the guarantee, Through BAMUI (Arbitration Board Muamalat Indonesia), and settlement by way of Litigation. The results of this study are expected to provide input to the high NPF (Non-Performing Finance) issues currently facing Bank Muamalat Indonesia and target the NPF to fall to 3%.

Abstract

Digitalisasi sektor perbankan di Indonesia telah mendorong inovasi layanan keuangan berbasis syariah. Penelitian ini mengkaji fenomena yang terjadi pada kartu pembiayaan syariah dengan fokus pada BSI Hasanah Card sebagai objek penelitian. Sebagai produk pembiayaan berbasis syariah, BSI Hasanah Card dirancang berdasarkan prinsip-prinsip syariah, seperti bebas dari riba, gharar, dan maysir. Meskipun menawarkan berbagai kemudahan dan fleksibilitas, produk ini menghadapi tantangan signifikan terkait penipuan, khususnya dalam proses pengajuan BSI Hasanah Card. Penelitian ini bertujuan untuk menganalisis fenomena penyalahgunaan dan penipuan yang melibatkan data nasabah dan merumuskan kerangka perlindungan hukum yang efektif bagi pengguna BSI Hasanah Card. Penelitian ini menggunakan metode kualitatif-deskriptif dengan menggunakan pendekatan hukum, ekonomi, dan sosial. Data dikumpulkan melalui wawancara, tinjauan regulasi, dan laporan terkait kasus penipuan. Temuan penelitian mengungkapkan bahwa penipuan muncul karena lemahnya pengawasan data nasabah, kurangnya integritas kerja yang mengakar di kalangan karyawan tidak tetap di BSI, dan terbatasnya literasi keuangan pengguna BSI Hasanah Card. Untuk mengatasi masalah tersebut, rekomendasi strategis yang dapat diberikan adalah meningkatkan proses validasi dan verifikasi data, meningkatkan edukasi literasi keuangan, memperkuat pengawasan internal, dan mendorong koordinasi antar otoritas terkait. Dengan langkah-langkah tersebut, BSI Hasanah Card diharapkan dapat menjadi solusi keuangan syariah yang lebih aman dan terpercaya.

Abstract

KUR Sharia is one of the financing programs aimed at assisting micro, small, and medium enterprises in Indonesia. KUR Sharia is implemented by Islamic banks with the aim of increasing access to financing for micro, small, and medium enterprises that have not yet been reached by the conventional banking system. This financing product uses Sharia principles, which are expected to provide ease for entrepreneurs with lower interest rates and lighter requirements. This type of financing uses the murabahah bil wakalah contract, which is a sale and purchase system based on wakalah. In this sales system, the seller delegates the purchase to the customer, thus the first contract is the wakalah contract, and after the wakalah contract ends, it is followed by the Murabahah Bil Wakalah contract. This research uses a descriptive qualitative method that gathers information through interviews with employees of Bank Syariah Indonesia X. The results of this study indicate that legal risk arises due to the absence of supportive legislation or weaknesses in obligations, such as the failure to meet the valid contract requirements or the imperfect binding of collateral. This legal risk is closely related to financing risk. The impact on Islamic banks is the emergence of problematic financing, one of which is caused by weaknesses in collateral binding. As a result, Islamic banks face difficulties in executing collateral if financing risks occur. Thus, legal risk and financing risk must be identified, measured, monitored, and managed properly.
