Abstract

Abstract The national legislation program makes Pancasila the source of all sources of law and as the basis of the state based on the philosophy and values of Pancasila animates and influences the process of legislation formation. In the research, the author using normative legal research method. But the fact that legislation generated through the process of formulating legislation has not provided a guarantee of justice and welfare for the people, so that the resulting law is still far from the goal of realizing  prosperity for all Indonesian people.  Abstrak Program legislasi nasional menjadikan Pancasila sebagai sumber dari segala sumber hukum  dan sebagai dasar negara yang berpedoman Pada falsafah dan nilai-nilai pancasila menjiwai dan     mempengaruhi proses pembentukan legislasi. Di dalam penelitian ini menggunakan metode          penelitian hukum normatif. Hasil penelitian ini menunjukkan bahwa  kenyataannya legislasi yang   dihasilkan melalui proses pembentukan peraturan perundang-undangan belum memberikan jaminan keadilan dan kesejahteraan bagi rakyat, sehingga undang-undang yang dihasilkan masih jauh dari cita-cita yaitu mewujudkan kesejahteraan bagi seluruh rakyat indonesia.

Abstract

As the law state, Indonesia has the objective to create common prosperity for all Indonesian citizens without exception. To reach these goals it requires policy in the form of legislation product. The House of Representatives (DPR), the Regional Representatives Council (DPD), and the Government should involve community in the process of composing legislation, and similarly at the time of its implementation and monitoring. Therefore the goal of establishing legislation for common prosperity can be achieved. This study aims to reveal the aspirations of the people in the preparation of the National Legislation Program (Prolegnas), the role of community participation in the process of legislation, and to see how the state has involve community in the implementation and supervision of the law. The results showed that the DPR, DPD, and the Government have not considered the aspiration of the people in carrying out their legislative functions.

Abstract

The monitoring and review in the policy of implementing the Aceh Government as an evaluation of the peace agreement between the Government of the Republic of Indonesia and the Free Aceh Movement which has been running for 20 (twenty) years, on the implementation of special autonomy, from the conflict that has been torn apart for a long time for three decades to rise and rebuild after Aceh after the Tsunami in order to achieve progress and success. The policies in the implementation and implementation of the current development and services of the Aceh Government are considered to be unable to fully realize and answer the welfare of the community, justice, promotion, fulfillment and protection of human rights based on the principles of good governance. The current practice of government administration, it turns out that in its implementation it is faced with the problem of broad and special authority that cannot be implemented. The authority of the Government of Aceh leaves legal problems that must be adjusted to the provisions of the Government of the Republic of Indonesia related to national norms, standards, procedures and criteria so that they are not in line with the Special Autonomy that applies lex specialist in Aceh. For this reason, the Government of Aceh needs to strengthen the authority that has been handed over not with a heart, so it is necessary to carry out the implementation of monitoring and reviewing policies carried out by observing, recording, and assessing the implementation of the implementation of the Aceh Government, to know the achievement of the planned results, the impact caused, and its benefits for Aceh and the Unitary State of the Republic of Indonesia.
