Abstract

The advancement of digital technology has brought about a significant transformation in the banking sector, particularly through mobile banking (m-banking) services that facilitate various financial transactions. However, this convenience also poses a serious challenge in the form of increasing fraud and embezzlement crimes through the platform. This research aims to analyze the factors causing such crimes in Medan City and evaluate mitigation strategies that can be effectively implemented. The methods used are normative juridical and sociological juridical approaches, with data collection through literature study of laws and regulations, scientific literature, and observation of related social dynamics. The results show that low digital literacy, weak supervision of financial institutions, and the rapid development of technology without the support of an adequate security system are the main factors. In addition, the lack of public understanding of digital risks increases the potential for cybercrime. Therefore, a comprehensive mitigation strategy is needed, including the implementation of multi-factor authentication, strengthening artificial intelligence-based security systems, and continuous digital education. Collaboration between banking institutions, law enforcement officials, government, and the public is key in creating a safe and reliable digital ecosystem.Keywords: Fraud, embezzlement of funds, mobile banking, legal protection, Electronic Information and Transaction Law

Abstract

Abstrak : Penelitian ini bertujuan untuk menganalisis tindak kriminalitas pada anak dari perspektif kriminologi, dengan fokus pada faktor penyebab, bentuk tindak pidana yang dilakukan, serta pengalaman dan upaya pembinaan yang diterapkan di Lembaga Pembinaan Khusus Anak (LPKA) Kelas I Medan. Penelitian dilakukan dengan metode kualitatif melalui wawancara mendalam terhadap 10 anak binaan yang sedang menjalani masa pembinaan di LPKA Kelas I Medan. Hasil penelitian menunjukkan bahwa sebagian besar anak melakukan tindak pidana atas kemauan sendiri, namun dipengaruhi oleh lingkungan pergaulan yang negatif, faktor ekonomi, serta penyalahgunaan zat seperti minuman keras dan narkotika. Temuan ini sejalan dengan teori subkultur delinkuen yang dikemukakan oleh Albert K. Cohen dan teori Delinquency and Opportunity oleh Cloward dan Ohlin, yang menekankan peran lingkungan sosial dan ketimpangan akses terhadap kesempatan legal sebagai faktor pendorong perilaku kriminal anak. Selain itu, penelitian juga menemukan bahwa program pembinaan di LPKA, seperti pendidikan, kegiatan keagamaan, dan pelatihan keterampilan, memberikan dampak positif terhadap perubahan sikap dan perilaku anak binaan. Namun demikian, belum semua anak mendapatkan akses pendampingan hukum yang memadai. Secara keseluruhan, hasil penelitian ini menegaskan pentingnya pendekatan rehabilitatif dan restoratif dalam sistem peradilan anak serta perlunya dukungan berkelanjutan dari keluarga, masyarakat, dan negara dalam mencegah kriminalitas anak.Kata kunci: kriminalitas anak, LPKA Kelas I Medan, teori subkultur, pembinaan, peradilan anak.  Abstrac : This study aims to analyze criminal acts against children from a criminological perspective, focusing on the causal factors, the forms of crimes committed, and the experiences and efforts of guidance implemented at the Class I Medan Special Child Guidance Institution (LPKA). The study was conducted using a qualitative method through in-depth interviews with 10 foster children who were undergoing guidance at the Class I Medan LPKA. The results of the study showed that most children committed crimes of their own accord, but were influenced by negative social environments, economic factors, and substance abuse such as alcohol and narcotics. This finding is in line with the theory of delinquent subculture put forward by Albert K. Cohen and the Delinquency and Opportunity theory by Cloward and Ohlin, which emphasize the role of the social environment and inequality of access to legal opportunities as factors driving children's criminal behavior. In addition, the study also found that guidance programs at the LPKA, such as education, religious activities, and skills training, have a positive impact on changing the attitudes and behavior of foster children. However, not all children have access to adequate legal assistance. Overall, the results of this study emphasize the importance of rehabilitative and restorative approaches in the juvenile justice system and the need for ongoing support from families, communities, and the state in preventing juvenile crime.Keywords: child criminality, LPKA Class I Medan, subculture theory, guidance, juvenile justice.
