Abstract

The use of inherited rice fields in rotation is in accordance with customary inheritance law and article 189 KHI, namely using collective principles. This is not in accordance with the individual principle in Islamic inheritance law. One reason is that in the collective system there is a delay in the distribution of inherited assets. This has the potential to cause conflict. The formulation of the problem in this research is how to implement the use of heritage rice fields in rotation among the Mayapati Village community. The aim of the research is to examine through Islamic law and customary law the rotational use of inherited rice fields in the Mayapati Village community. The type of research is field research with data collection through interviews, observation and documentation. This research is also normative legal research with a qualitative approach, namely data obtained through library materials such as books, documents or statutory regulations related to the problems that occur. Descriptive in nature, that is, the problem is formulated according to the facts that occurred. According to customary law, inherited rice fields are used in rotation according to a collective system. According to the view of Islamic law, inheritance should be divided based on the parts regulated in the text. Referring to the Compilation of Islamic Law, the rotational use of inherited rice fields which is in accordance with Islamic Law is only inherited collectively, in accordance with property rights in Islamic law, namely ownership for the benefit only or haqqul intifa', while the rotational use of rice fields is not in accordance with work regulations. with muzara'ah.

Abstract

In modern times such as today the young generation prefers foreign culture rather tahan domestic culture that is one of, it also occurs in batic our nation’s culture that is offten considered the clothing of parents beside that, youngsters prefer the stylish clothes frequent ly claims from other nations to culture such as batic, it should not be claimed by other nations. The study using waterfall method where each stage must be completed first before passing to the next stage in orther to avoid the repetition of stages. From the results of research , it is easier to access Pekalongan batic motifs in addition visitors can also upload Pekalongan batic motifs by registering as a member. Batic is an Indonesion culture that has been recognized by unnesco so it is time for us as young people to preserve the culture of our nations. Keyword: batic, unnesco, pekalongan ABSTRAKSI Di zaman modern seperti saat ini banyak generasi muda yanng lebih menyukai budaya luar dari pada budaya milik sendiri, hal ini juga terjadi pada batik dimana batik yang merupakan budaya bangsa kita seringkali dianggap identik dengan pakaian orang tua sehingga anak muda lebih suka dengan pakaian yang bergaya stylist dan seringnya terjadi klaim bangsa lain terhadap budaya kita sehingga jangan sampai batik yang merupakan hasil karya nenek moyang bangsa kita diklaim oleh bangsa lain. Penelitian ini penulis mennggunakan metode waterfall dimana setiap tahapan harus diselesaikan terlebih dahulu sebelum diteruskan ke tahap berikutnya untuk menghindari terjadinya pengulangan tahapan. Dari hasil penelitian yang dilakukan masyarakat lebih mudah dalam mengakses motif batik pekalongan selain pengunjung juga dapat mengupload motif-motif batik Pekalongan dengan cara mendaftar sebagai member. Batik merupakan budaya Indonesia yang sudah diakui oleh unnesco sudah saatnya kita sebagai generasi muda untuk melestarikan budaya bangsa kita. Kata Kunci: batik, unnesco, pekaalongan
