Abstract

Hukum Acara merupakan salah satu mata kuliah yang mendukung kemahiran calon sarjana hukum dalam tata cara beracara. Sebagai mata kuliah pembuka yang kemudian akan dilanjutkan dengan Praktek Latihan Kemahiran Hukum atau PLKH mahasiswa dapat memahami bagaimana teori serta praktik beracara. Timbul suatu persoalan yang mana dalam suatu teori beracara yang panjang tetapi tidak dapat memiliki suatu visualisasi yang baik. Untuk itu dirasa perlu memberikan gambaran bagaimana jalannya persidangan, dengan pemberian media berlajar dalam bentuk Video. Melakukan perekaman pada jalannya persidangan diperbolehkan sebagaimana pada Surat Edaran Mahkamah Agung Nomor 4 Tahun 2012 tentang Perekaman Proses Persidangan. Sesungguhnya memperoleh Video Persidangan tidaklah sukar di zaman sekarang, kemudahan akses internet dan media sosial “youtube” telah memberikan akses secara gratis, akan tetapi hal ini tidak akan menambah khazanah keotentikan hak cipta, serta tidak dapat memberikan kesempatan calon sarjana hukum UM Pontianak menambah dan mengasah kemampuan kemahiran dibidang beracara dimuka pengadilan.

Abstract

Persoalan tanah terlantar bukanlah menjadi hal baru di Indonesia, sudah banyak aturan terdahulu yang dapat dijadikan dasar pelarangan bagi seseorang atau badan hukum untuk tidak memanfaatkan lahan / tanah yang dimiliki sesuai dengan peruntukan hak yang diberikan oleh negara. Tanah – tanah yang terindikasi sebagai tanah terlantar dapat ditemukan dengan ciri-ciri fisik lokasi tanah tidak dirawat, ditumbuhi dengan tanaman liar dan tidak jarang menjadi lokasi pembuangan sampah oleh masyarakat. Untuk mendapatkan gambaran data penelitian tentang lokasi tanah terindikasi terlantar saat ini dapat memanfaatkan pesawat tanpa awak (drone) karna dapat menghasilkan gambar yang baik serta efisien. Penelitian ini menggunakan metode penelitian empiris. Melihat kejadian sebenarnya yang dialami dilokasi penelitian secara realtime.  Dari hasil penelitian ini menunjukkan bahwa pemanfaatan pesawat tanpa awak (drone) dapat menjadi salah satu pilihan untuk mempercepat proses pengumpulan data, efisiensi waktu serta anggaran

Abstract

ABSTRACT The purpose of this research is to find out whether the utilization of land that is indicated neglected if it is utilized can be a preventive measure to suppress the increasing area of land fires in the city of Pontianak. This study uses a normative research method, by conducting a study of Government Regulation No. 11/2010 concerning Control and Utilization of Abandoned Land. To support this research, direct monitoring was also carried out at the locations where land fires had occurred in the city of Pontianak. From the activities that have been carried out, the application of land use indicates that neglect has not fully occurred considering that there are still many lands that have not been utilized, either as locations for planting or used for other uses, such as residential development. In order for synergy in preventing forest and land fires in the city of Pontianak, there needs to be synergy between the government, universities and the community so that the use of abandoned land / non-productive land can have an impact on improving the economy of the people of Pontianak city so that it has an impact on Regional Original Income (PAD) in Pontianak CityKeywords: Indicated Derelict Land, forest fires, Pontianak City. ABSTRAKTujuan dari penelitian ini ialah untuk mengetahui apakah pemanfaatan tanah yang terindikasi terlantar apabila dimanfaatkan dapat menjadi Langkah pencegahan untuk menekan bertambahnya luas area kebakaran lahan di kota Pontianak. Penelitian ini menggunakan metode penelitian normative, dengan melakukan kajian terhadap Peraturan Pemerintah Nomor 11 Tahun 2010 tentang Penertiban dan Pendayagunaan Tanah Terlantar. Untuk mendukung penelitian ini dilakukan pula pemantauan langsung pada lokasi-lokasi bekas terjadinya kebakaran lahan di kota Pontianak. Dari kegiatan yang telah dilakukan penerapan penggunaan tanah terindikasi terlantar belum sepenuhnya terjadi mengingat masih banyak lahan-lahan yang belum digunakan sebagai lokasi bercocok tanam maupun dipakai pada peruntukan lainnya seperti pembangunan pemukiman penduduk. Agar terjadinya sinergisitas dalam pencegahan kebakaran hutan dan lahan di kota Pontianak, perlu adanya sinergisitas antara pemerintah, perguruan tinggi dan masyarakat agar pemanfatan tanah terindikasi terlantar / lahan non produktif dapat memberikan dampak bagi peningkatan perekonomian masyarkat kota pontianak sehingga berdampak pada Pedapatan Asli Daerah (PAD) Kota Pontianak.Kata Kunci: Tanah Terindikasi Terlantar, Kebakaran Hutan dan Lahan, Karhutla, Kota Pontianak

Abstract

This research aims to provide an overview of the relationship between business and human rights and discuss how investment activities carried out by corporations must respect and fulfill the rights of local communities in their business areas and how the government should balance investment interests and the rights of local communities. By prioritizing secondary data, which was then analyzed qualitatively to draw conclusions and provide prescriptions, it was found that businesses have a responsibility to respect, protect, and fulfill human rights in all their activities. The government has a key role in maintaining a balance between investment interests and the rights of local communities. They must regulate and supervise investments to ensure that they contribute to sustainable development and protect the rights of local communities.Keywords: Investment, Local Communities, Human Rights.

Abstract

This research aims to analyze the level of legal awareness and the obstacles faced by Micro and Small Enterprises (UMK) in the trademark registration process in Tanah Pinoh District, Melawi Regency. In an increasingly competitive global market, protecting intellectual property, particularly trademarks, is crucial to ensuring product identity and market competitiveness. However, many UMK actors are unaware of the legal importance of trademark registration, resulting in a lack of protection for their business assets. The study employs a juridical-empirical approach, with primary data obtained through interviews with UMK actors and related agencies, and secondary data from literature reviews. The findings reveal that low legal literacy, limited government outreach, and the perception that trademark registration is complicated and costly are major obstacles. Even when free registration programs are available, participation rates remain low.Trademarks serve not only as unique identifiers but also as legal safeguards that ensure business continuity and prevent infringement or duplication. Registration enhances product credibility and consumer trust. Therefore, more effective strategies are needed to raise awareness among UMK actors through sustained legal education, simplified administrative processes, and stronger regional government support. This research aims to inform policymakers in designing fairer and more inclusive intellectual property protection strategies for small-scale businesses.

Abstract

This study aims to determine how the process of determining the Village Medium-Term Development Plan in Sandai Kanan Village and Muara Jekak Village. In addition, this study also aims to determine the process of determining the Village Medium-Term Development Plan and the Implementation of Village Development in Sandai Kanan Village and Muara Jekak Village, Ketapang Regency. This research uses descriptive qualitative research, with data collection techniques through observation and interviews. The primary data sources in this study are the informant respondents Uti Fahrul, the secretary of the right sandai village and Andri Suandi, the secretary of the Muara Jekak village and supported by primary, secondary and tertiary legal materials. The results showed that in Sandai Kanan Village and Muara Jekak Village in the process of determining the RPJMDes 2017-2022 as stipulated in Law No. 6 of 2014 has been carried out quite well, this is confirmed by supporting data, namely PerDes on RPJMDes in both villages. Regarding the process of implementing development in Sandai Kanan Village, in particular, it does not run as it should, this is confirmed by the data obtained, namely the RPJMDes data in development is not implemented. As for Muara Jekak Village, the implementation process has been carried out in accordance with the data that has been obtained and corroborated by the results of interviews and observations by going directly to the field.

Abstract

Abstract Fintech companies introduced the Paylater feature, a payment technology with the concept of paying in installments without using a credit card. Paylater is an alternative payment method with an online installment system that does not require a credit card. Paylater from the Traveloka application is one of the financial services supervised by the Financial Services Authority. This research uses a normative law writing method. The data collection used in this study is library research. The data sources used are primary law, secondary law and tertiary law, as well as data collection techniques using legal materials collection techniques such as laws and regulations, doctrines from experts, and online data searches. The results of the study refer to the impact of the delay in completing Paylater on the Traveloka application. The conclusion obtained is that the impact and settlement of the delay that has been approved the terms and conditions are the fines received by the account owner, the loan cost score has decreased, and will be collected by Traveloka. Paying late fines and fees, restricting access using PayLater, getting a declining credit score that can make it difficult for account owners to get loans at banks or other funding companies, these settlements are useful for a deterrent effect for account owners. Abstract

This study is motivated by the increasing number of fraud crimes involving the modus operandi of promising guaranteed acceptance into the Indonesian National Armed Forces (TNI) recruitment process, as exemplified in Court Decision No. 37-K/PM.I-05/AD/VIII/2024. The purpose of this research is to conduct a juridical analysis of such fraud and to examine the judge’s legal considerations in adjudicating the case. The research employs a descriptive-analytical method aimed at systematically presenting the legal facts in the decision and analyzing them based on applicable legal norms. A normative legal research type is used, focusing on the provisions of Article 378 of the Indonesian Criminal Code (KUHP) in conjunction with Article 55 paragraph (1) KUHP, while also reviewing the application of these criminal elements in the military court’s ruling. Data were analyzed qualitatively by describing the application of criminal elements, assessing the judge’s legal reasoning, and connecting them with principles of justice and relevant legal theories. The findings indicate that fraud by promising acceptance into the TNI fulfills the elements of Article 378 KUHP. The panel of judges considered key aspects such as malicious intent, the financial loss suffered by the victim, and the broader social impact of the defendants’ actions, although the ruling is still subject to discussion regarding its reflection of substantive justice.
