Abstract

Tujuan penulisan secara umum pada jurnal ilmiah ini untuk mengetahui peran sanksi adat dalam penyelesaian delik adat Bali dan secara khusus untuk mengetahui dan menganalisa tentang kekuatan hukum upacara “madewa saksi” & “macoran” sebagai sarana pembuktian dalam mengungkap pelaku delik adat Bali. Metode penulisan yang digunakan yaitu penelitian hukum normatif yang bersifat deskriptif dengan menggunakan pendekatan perundang-undangan dan pendekatan kasus. Hasil penelitian yang pertama yaitu peran sanksi adat dalam penyelesaian delik adat Bali sangat kuat dan terkadang pelaksanaannya lebih berat daripada sanksi hukum nasional serta bertujuan untuk mengembalikan harmonisasi antara kehidupan dunia nyata (sakala) dan tidak nyata (niskala) sesuai filosofi tri hita karana. Hasil penelitian yang kedua yaitu kekuatan hukum pelaksanaan upacara “madewa saksi” & “macoran” sebagai sarana pembuktian dalam mengungkap pelaku delik adat Bali yang diartikan sebagai menggunakan alam semesta atau Tuhan Yang Maha Esa sebagai saksi atas dugaan adanya tindakan yang tidak benar sehingga dalam rangka membuat terang suatu perkara delik adat di Bali diperlukan upacara “madewa saksi” & “macoran” sehingga memberikan keyakinan bagi prajuru adat di Bali. The general aim of writing this scientific journal is to find out the role of customary sanctions in resolving violations of Balinese customs and specifically to find out and analyze the legal strength of the “madewa saksi” & “macoran” ceremony as a means of proof in exposing Balinese perpetrators of Balinese society. The writing method used is descriptive normative legal research using a statutory approach and a case approach. The first research result is that the role of customary sanctions in resolving Balinese customary offenses is very strong and sometimes their implementation is more severe than national legal sanctions and aims to restore harmonization between the real world (sakala) and the unreal (niskala) according to the tri hita karana philosophy. The second research result is the legal strength of carrying out the “madewa saksi” & “macoran” ceremony as a means of proof in exposing perpetrators of violations of Balinese customs which is defined as using the universe or God/Ida Sang Hyang Widhi Wasa as a witness for alleged wrongdoing, so that being able to explain a case of violation of customs in Bali requires a ceremony “madewa saksi” & “macoran” to give confidence to traditional warriors in Bali.

Abstract

Background: Bali Province is in first place with 11% of schizophrenia sufferers. Mental disorders in Bali are also often associated with possession by demons, evil spirits, or curses from ancestors. Bali is known to have various cultures and local wisdom that bind its people, one of which is Tat Twam Asi which means you are me and I am you. Objective: The aim of this activity is to reduce the stigma of people with mental disorders through the application of Tat Twam Asi. Method: This activity was carried out by providing health education about the application of Tat Twam Asi in Mental Health with a total of 180 participants. Before health education is carried out, participants complete a pre-test and a post-test is given after completing the education. There are five questions in the pre-test and post-test with the criteria for a good score of ³ 75%, a fair score of 56 – 74% and a poor score of <55%. Results: Based on the results of the pre-test carried out before the health education, the average participant score was <55% in the poor category. After providing health education about the application of Tat Twam Asi in mental health, the average participant score was  ³ 75% in the good category. Conclusion: Based on the results of community activities, it was found that there was an increase in public knowledge about the application of Tat Twam Asi in mental health, as an effort to reduce stigma towards people with mental disorders.

Abstract

The establishment of settlements in Bali is based on the Tri Hita Karana (THK) philosophy. However, the implementation of THK in residential spatial planning has now experienced a shift, especially in urban areas. Many settlements in the South Denpasar area do not use the THK concept. This study aims to analyze people's perceptions of the implementation of THK in residential spatial planning in South Denpasar. The research method used is qualitative research with data collection techniques namely observation, in-depth interviews and document studies. Data analysis was carried out in an interpretive descriptive manner. The results of the study show that in the South Denpasar region there are three models of residential environments, namely geria/puri/jero settlements, naturally developing settlements, and settlements built by developers. The geria/puri/jero settlements still maintain Balinese Traditional Architecture (ATB) according to THK, while the general population and settlements built by developers tend not to comply with THK. The Balinese Hindu community residents of settlements in South Denpasar have the perception that a place to live in must be in harmony with the local natural environment, and adhere to the concept of ATB and the THK philosophy. However, due to limited land, the community admits that they cannot fully apply the ATB concept. In conclusion, the implementation of the THK concept in residential spatial planning in South Denpasar cannot be fully implemented due to limited residential land.

Abstract

Bali has been a model of unique multicultural life, including inter-religious harmony. This study aimed to describe the social interaction of Muslim-Hindu in Kampung Loloan, Jembrana Bali. The type of study was qualitative research, where research data was obtained through literature review, observation, and interviews with Balinese cultural observers and community leaders of Kampung Loloan. The results showed that from the Dutch colonial era (17th century) until the post-reform era, social interaction between Muslims and Hindus in Kampung Loloan experienced ups and downs. In general, social interaction could be sorted into four patterns: (1) social interaction based on kinship (menyamebraya); (2) social interaction based on partnership; (3) social interaction based on the spirit of competition; (4) social interaction based on prejudice. The first, second, and third patterns of social interaction could support the Ajeg Bali movement and the multiculturalism development that strengthened the Unitary State of the Republic of Indonesia (NKRI). Meanwhile, the fourth pattern of social interaction was a latent danger that needed to be anticipated because it could ignite social conflict and reduce national integration.

Abstract

The general purpose of writing in this scientific journal is to find out the legal basis for marriage for Hindus in Bali and specifically to find out the legality of virtual Hindu marriages from the perspective of National Law in Indonesia. The writing method used is descriptive normative legal research using a statutory approach and a case approach. The first research result is the Legal Basis for Hindu Marriage in Bali, which refers to Article 28 paragraph (1) of the 1945 Constitution, Article 1 & Article 2 of Law Number 1 of 1974 concerning Marriage, Law Number 16 of 2019 concerning Amendments Based on Law Number 1 of 1974 concerning Marriage, Rigveda X. 85.23 & Rigveda VI.15.19. The second research result, namely the Legality of Virtual Hindu Marriages in the Perspective of Law Number 1 of 1974 concerning Marriage, is that national norms do not regulate virtual marriages so it can be said to be an empty norm. Viewed from custom, tradition and religion, there are no rules regarding virtual marriage because it can be seen that the conditions that must be met to make a Hindu marriage in Bali valid are one of the witnesses in the mabyakala (wiwaha) ceremony which involves 3 witnesses or Tri Upasaksi, namely the witness god, human witnesses, and bhuta witnesses.
