Abstract

Politics of banking law (banking law) as the activity of choosing and the method to be used to achieve a particular goal and law, or a legal policy to be applied or carried out includes the consistent implementation of existing legal provisions, the process of updating and making law, which leads to a critical attitude towards law with an ius constitutum dimension and creates a law with an ius constituendum dimension, and the importance of affirming the function of institutions and the development of law enforcers. The problems are 1. How is the cessie in resolving bad loans on housing ownership as bank guarantees from a political and legal perspective? 2. What is the legal power of the auction as a result of creditor guarantee cessie seen from the legal political aspect? and provide answers to these problems. The method used is a type of normative legal research (doctrinaire) with data used secondary data, in the form of primary, secondary and tertiary legal materials. With the conclusion that in the settlement of bad credit, one method can be used with cessie, namely the transfer of rights over intangible goods receivables on behalf of third parties, carried out by selling receivables on behalf of an authentic deed or private deed. And in providing legal protection to cessionaris, they can use retro cessie, which is a means for cessionists whose receivables are not paid by cessus to sue the cedent to ask for the money back.

Abstract

Cessie merupakan salah satu cara yang dapat dipakai oleh Bank dalam penyelesaian kredit macet terhadap Kredit Pemilikan Rumah (KPR) bersubsidi yang tidak dipasang Hak Tanggungan. Konsep Cessie dalam penyelesaian utang piutang diatur dalam Buku III Kitab Undang-Undang Hukum Perdata, merupakan pengalihan hak atas kebendaan bergerak tak berwujud (intangible goods) yang secara normative diatur Pasal 613, disebutkan bahwa penyerahan akan piutang-piutang atas nama dan kebendaan tak bertubuh lainnya, dilakukan dengan jalan membuat sebuah akta otentik atau akta di bawah tangan, dengan mana hak-hak atas kebendaan itu dilimpahkan kepada orang lain. Metode penelitian yang digunakan dalam artikel ini adalah metode penelitian yuridis normative dengan memakai data sekunder. Tujuan penelitian adalah penerapan Cessie untuk mengatasi kesulitan Bank dalam rangaka penyelesai kredit macet KPR bersubsi. Oleh karena itu, tindak lanjut dari pengadopsian prinsip konsep Cessie adalah memberikan perlindungan hukum terhadap penerima Cessie. Dalam mengatasi penyelesain kredit macet yang biasanya memerlu waktu yang lama, memerlukan biaya yang besar sehingga dengan penggunaan cessie dapat lebih efesian, biaya rendah dan terjaganya kesetabilan bagi perbankan.

Abstract

All of the principles of Good Corporate Governance can support the realization of Good Corporate Governance in order to prevent the misuse of shareholder power considering that the Piercing the Corporate Veil principle can be used to prevent illegal acts committed by shareholders, commissioners or directors. Shareholders, commissioners or directors are possible to commit acts against the law and utilize existing facilities for their personal interests by manipulating their actions or the misuse of company assets. The research method used in this article is the normative juridical research method. The final goal of applying the Piercing the Corporate Veil principle above is the existence of Good Corporate Governance, namely good corporate governance. Therefore, the follow-up to the adoption of the Piercing the Corporate Veil principle is its implementation in Good Corporate Governance, which is a good and correct management system.

Abstract

House buying and selling is very vulnerable and problems often occur to cause disputes, This research was conducted in an empirical juridical way, the nature of descriptive analysis was by qualitative data analysis, The absence of consumer understanding of the buying and selling process in a contract carried out with the developer and there are still those who do not understand the contents of a contract and there are still developers with consumers making agreements under the hand that are not in accordance with the Laws and Regulations, Housing developers must be responsible for losses suffered by consumers, The legal effort that can be made by consumers is by taking a solution in a way outside the court of non-litigation and litigation through the general court, Consumer dispute resolution is first resolved by means of consensus agreement or peacefully if there is no further settlement, it can be done through a way of settlement outside the court (non litigation) or through a public court (litigation) either civil or criminal.

Abstract

This paper aims to determine control as freedom of contract in the system and the company's position in the engagement. The method uses normative juridical with primary and secondary data. Agreements or commonly called contracts in Indonesia, there are two types of classification when distinguished by name, namely name or name agreements and nameless agreements or named names. The two groups have their own definitions, requirements, elements and legal basis. Unnamed agreements generally grow and develop in society and in practice there are still those that do not have clear arrangements because anonymous agreements are legally recognized by law for their existence as a consequence of the form of agreements in Indonesia which are written and unwritten. The terms of the validity of the agreement, both subjective terms and objective terms, are generally applicable for nameless agreements and nameless agreements. Article 1338 of the Civil Code is the main pillar of the principle of freedom of contract, although in practice it is not free in the true sense, but free with limitations. The agreement made by the parties can be in the form of a private deed or an authentic deed, namely in the form of a Notary Deed and a private deed. The existence of an obligation to the public that certain contracts must follow the rules that have been determined by both the official who made it is one of the efforts for the state to have uniformity and ease of supervision or implementation. The role of a notary in making an anonymous deed agreement in a notarized deed is very useful and has perfect evidentiary power, both formal and material. A notary is a public official who frames the agreement of both parties or more, to make a deed agreement in the form of a notarial deed. The notary must pay attention to the clauses that are prohibited by law and must comply with the things that have been regulated by law.

Abstract

Online loans are a common thing that occurs among the wider community today, one of which is legal and illegal online loans. The easy conditions for applying for a loan make many people tempted to apply for a loan, where with just a photo of their KTP and filling in their data, everyone can easily get funds quickly. OJK is an independent organization, free from interference from other parties, whose function is to provide an integrated regulatory and supervisory system for all activities in the financial services sector as well as providing legal defense as regulated in OJK Law no. 21/2011 Articles 28, 29, and 30. As well as in POJK No. 31/2020 and POJK No. 6/2022. The method in this research uses a normative and qualitative approach. The main data in this research is secondary data obtained from library materials or literature that is related to the research object. The research results obtained: 1. Legal protection for consumers using online loans based on financial technology in the laws and regulations that can be implemented, namely: preventive and repressive legal protection. 2. Legal/licensed online loans are under the supervision of the OJK and regulated by POJK Number 10/POJK.05/2022 concerning Information Technology-Based Joint Funding Services (POJK 10/2022).
