Abstract

Perjanjian sewa menyewa diatur di dalam Pasal 1548 KUH Perdata yang menjelaskan bahwa, sewa menyewa merupakan suatu persetujuan di mana satu pihak mengikatkan diri untuk memberikan kenikmatan suatu barang kepada pihak lain selama waktu tertentu dengan pembayaran harga yang disanggupi. Hal ini berarti bahwa penyewa rumah kost berkewajiban menepati 2 hal utama. Pertama, memakai barang sewa sebagai kepala rumah tangga yang baik, sesuai dengan tujuan barang itu menurut persetujuan sewa atau tidak ada persetujuan mengenai hal itu, sesuai dengan tujuan barang itu menurut penyelesaian yang menyangkut keadaan. Kedua, membayar uang sewa pada waktu yang telah ditentukan. Oleh karena itu dapat dikatakan bahwa penyewa memiliki tanggung jawab terhadap hal apa yang terjadi atas barang yang di sewakan jika hal tersebut menyimpang dari apa yang diperjanjikan dimana hal tersebut menimbulkan akibat hukum yang disebut wanprestasi. Namun permasalahan yang timbul adalah para pengusaha rumah kost yang berada di Kelurahan Rimba Jaya, RT. 09 sampai RT. 14 Belum memahami tata cara dan prosedur penyusunan kontrak perjanjian persewaan rumah kost yang baik dan benar sesuai dengan ketentuan hukum yang berlaku. Oleh karena itu solusi yang ditawarkan adalah dengan memberikan pendampingan dan pelatihan tentang pentingnya membuat kontrak perjanjian sewa menyewa rumah kost termasuk kepastian hukum dan akibat hukumnya menurut KUH Perdata dan Peraturan Pemerintah No. 44 Tahun 1994 tentang Penghunian Rumah Oleh Bukan Pemilik yang memberikan jaminan perlindungan hukum, baik bagi pemilik maupun penyewa rumah. The Assistance and Training on Drafting Rental Contracts for Boarding House Entrepreneurs in Rimba Jaya VillageAbstract: The leasing agreement is regulated in Article 1548 of the Civil Code which explains that, leasing is an agreement in which one party binds itself to provide the enjoyment of an item to another party for a certain time by paying an agreed price. This means that boarding house tenants are obliged to fulfill 2 main things. First, use the object of rent as a good head of the household, in accordance with the purpose of the item according to the lease agreement or there is no agreement regarding it, in accordance with the purpose of the item according to prejudice regarding the circumstances. Second, pay the rent at a predetermined time. Therefore it can be said that the lessee has responsibility for what happens to the item being leased if it deviates from what was agreed upon where it causes legal consequences called default. However, the problem that arises is the boarding house entrepreneurs who are in the Rimba Jaya Village, RT. 09 to RT. 14 do not understand the procedures and procedures for preparing a boarding house rental agreement contract that is good and correct in accordance with applicable legal provisions. Therefore the solution offered is to provide assistance and training on the importance of making boarding house rental agreement contracts including legal certainty and legal consequences according to the Civil Code and Government Regulation No. 44 of 1994 concerning Occupation of Houses by Non-Owners which guarantees legal protection, both for house owners and tenants.

Abstract

From a legal perspective, this study examines the extent to which existing regulations, both at the national and local levels, support and accommodate the application of restorative justice in the context of land disputes. The analysis will include an in-depth study of Law Number 11 of 2012 concerning the State Administrative Court, Government Regulation Number 24 of 1997 concerning Land Registration, and relevant regional regulations. In addition, this study will also identify legal obstacles that hinder the application of restorative justice. The research method used is a qualitative method with a case study approach. Data collection was carried out through in-depth interviews with the disputing parties, community leaders, customary leaders, and law enforcement officers. In addition, this study will also analyze relevant legal documents and regulations. The results of this study are expected to contribute to the development of a more comprehensive understanding of the application of the principle of restorative justice in the context of overlapping land disputes in Merauke. The findings of this study are also expected to be the basis for the preparation of more effective policy recommendations in resolving land disputes in the future, while still respecting the rights of indigenous peoples and the principles of restorative justice.

Abstract

  In the era of globalization, social media has become the main communication tool that affects people's lives, especially teenagers. The community service activity entitled "Wise at the Fingertips: The Importance of Understanding Rights and Obligations in Using Social Media" was implemented at SMA 1 Yapis Merauke to improve digital legal literacy among students. Through interactive lecture methods, group discussions, and case study simulations, this activity aims to provide an understanding of the ITE Law and legal issues related to the use of social media. Although attended by only 9 students, this activity succeeded in creating an atmosphere of in-depth discussion and increasing students' awareness of the legal risks that may arise from their online activities. Evaluation results showed a significant increase in understanding of digital ethics and social media responsibility. This activity emphasizes the importance of communicative and relevant legal education to form a wise and responsible young generation in using social media. Recommendations for the development of similar programs include expanding the range of participants and collaborating with more schools.

Abstract

Narcotics abuse is one of the serious challenges faced by the young generation, including the young generation of churches in Merauke Regency. Its devastating impact not only on individuals, but also families and communities, requires special attention. This service describes the implementation of a legal education program with a focus on the dangers of narcotics and steps to handle them aimed at the young generation of the church in Merauke Regency.  Therefore, the solution offered is to conduct legal education on the dangers of narcotics and how to deal with them for the young generation of the church in Merauke Regency. This will increase knowledge and have great potential in preventing narcotics crimes among young people, especially the younger generation of the church. This activity aims to increase understanding of the law, build awareness of the bad effects of narcotics, and encourage the active role of the younger generation in prevention and rehabilitation. Counseling methods include exposure to legal material based on Law Number 35 of 2009 concerning Narcotics, interactive discussions, and case simulations.  The output of this activity is a journal. This includes providing material and legal rules governing narcotics crimes from resource persons and case studies.  The results of the activity showed an increase in participants' understanding of the dangers of narcotics, related legal mechanisms, and handling strategies. It is hoped that this counseling will become a model of service that can be applied in other areas to empower the younger generation of the church to face the threat of narcotics more effectively.
