Abstract

The purpose of marriage includes the desire to have offspring; however, not all married couples achieve this, often due to primary health issues. Expert doctors, armed with knowledge and technology, have discovered a method in the process of reproduction known as in-vitro fertilization (IVF). This discovery serves as a solution for married couples facing health problems. IVF is a process where egg fertilization by sperm occurs outside the female body, utilizing a fertilization tube. The resulting valid fertilization is then implanted in the wife's womb, from where the egg originated. The legal regulations for IVF are based on Law Number 36 of 2009 concerning health. Assisted pregnancy efforts can only be undertaken by legally married couples, meeting specific criteria such as fertilization materials originating from the husband and wife, with the implantation performed by authorized healthcare professionals at designated facilities. If these conditions are met, the offspring resulting from IVF is considered the biological child of the married couple. However, new challenges arise when the IVF process is conducted after the husband's demise, particularly in determining the lineage and civil rights status of the child or baby born through this process. To address these new challenges, this research aims to understand the legal status of posthumous IVF implementation and the lineage and civil rights status of children born through this process. The research is conducted through a literature review, utilizing a normative approach, with data collection from primary and secondary sources. The research findings indicate that the lineage and civil rights of a child born through posthumous IVF can be established with evidence from the biological father, demonstrated through scientific and technological means or other legal evidence establishing a blood relationship, as highlighted in Constitutional Court Decision No. 46/PUU VIII/2010.Keywords: In-Vitro Fertilization (Bayi Tabung), Legal Certainty, Civil Rights.

Abstract

ABSTRAK: Pengecekan sertipikat hak atas tanah pada umumnya diajukan oleh Pejabat Pembuat Akta Tanah dengan tujuan adanya kepastian hukum dalam melakukan perbuatan hukum, terutama untuk peralihan hak atas tanah. Pengecekan dilakukan untuk mencocokkan data fisik dan data yuridis yang tersimpan dalam peta pendaftaran, daftar tanah, dokumen ukur dan buku tanah dan mutlak diperlukan untuk mencegah terjadinya sengketa tanah. Berdasarkan Pasal 97 Permen ATR/KaBPN Nomor 16 Tahun 2021 sebelum melakukan perbuatan hukum mengenai peralihan hak atas tanah atau Hak Milik atas Satuan Rumah Susun, Pejabat Pembuat Akta Tanah wajib menjamin kesesuaian data fisik dan yuridis atas Sertipikat dengan data elektronik dan tidak dalam sengketa. Namun dalam hal pelaksanaan pengecekan terdapat beberapa kendala yaitu sejak terbitnya Petunjuk Teknis Nomor 3 Tahun 2022 Tentang Layanan Pengecekan Sertipikat dan Surat Keterangan Pendaftaran Tanah (SKPT) secara elektronik, yang pada dasarnya permasalahan dan kendala tersebut sebagian besar terkait dengan sistem Teknologi Informasi dan server layanan pengecekan Sertipikat. Pengguna harus selalu dapat melakukan konfirmasi dengan layanan pengecekan Sertipikat serta harus memahami dan terampil dalam menggunakan semua alat yang diperlukan untuk dapat menyelesaikan proses pengecekan Sertipikat hingga hasil pengecekan Sertipikat secara elektronik diterbitkan.

Abstract

In healthy business or economic activities, a balance of legal protection is needed for consumers and business actors, this is because many consumers are harmed by the fraudulent actions of business actors. The problem formulation is: How is the validity of online transactions via Instagram viewed from Article 1320 of the Civil Code and what form of legal protection is provided for consumers due to losses by online shop business actors on Instagram. Normative juridical research method with a qualitative approach. The legal basis for online transactions is the same as transactions in general, referring to the basic provisions of Article 1320 of the Civil Code as a condition for the validity of the agreement, whereas online sales and purchase agreements remain as valid as conventional sales and purchase agreements, if they still comply with Article 1320 of the Civil Code. If the consumer's rights are not fulfilled, the consumer can take legal action as regulated in Article 38 and Article 39 paragraph (2) of the ITE Law and Article 47 and Article 48 of the Consumer Protection Law. Suggestions that can be given in the future need to be made legal regulations that specifically regulate e-commerce so that consumer rights in electronic transactions, especially using Instagram media, which is not used for selling purposes like other e-commerce which is specifically designed for online shopping, can be better guaranteed.
