Abstract

On April 17, 2019, Indonesia conducted a simultaneous general election involving five ballots for various political offices. The objective was to reduce election costs and improve efficiency. Despite a well-established electoral system, certain political elites contested the results using calls for 'people power.' This research aims to examine the legal implications of such calls and their compatibility with the law. Using a normative approach and legal behavior case studies, this study utilizes primary data from laws and secondary sources, such as books on democracy and freedom of expression. The theoretical contribution lies in clarifying that freedom of expression should not be considered seditious, as sedition entails efforts to overthrow the government. However, if demonstrators violate regulations, particularly Article 6 of the Freedom of Expression Law, it may be considered sedition. It is recommended to handle the results of the presidential and vice-presidential elections maturely by entrusting them to the competent authority, the Constitutional Court.

Abstract

Urgensi pemahaman mengenai akibat tindakan hukum terhadap harta bersama yang sering dilakukan secara sepihak di masyarakat, khususnya di lingkungan Kantor Kepala Desa Cihuni, Kecamatan Pagedangan, kabupaten Tangerang, kami Tim PKM S1 Ilmu hukum Universitas Pamulang yang merupakan implikasi dari progaram tridarma perguruan tinggi melakukan penyuluhan hukum yang berhubungan dengan harta bersama. Metode pelaksanaan pengabdian ini dilakukan dalam beberapa kegiatan yaitu tahap pertama survei yaitu sosialisasi dilakukan dengan menyusun berbagai hal yang akan disampaikan pada saat kegiatan pengabdian. Pemahaman mengenai akibat hukum terhadap harta persama yang dilakukan secara sepihak. Tujuan utama dari Tim PKM S1 Ilmu Hukum Universitas Pamulang yakni: (1) Untuk mengetahui keabsahan terhadap tindakan hukum harta bersama yang dilakukan secara sepihak.(2) Untuk mengetahui akibat hukum terhadap harta bersama yang dilakukan secara sepihak. Pasal 35 ayat (1) UU No. 16 tahun 2019 tentang perubahan UU No. 1 Tahun 1974 Tentang Perkawinan menyatakan bahwa harta bersama adalah harta yang diperoleh selama perkawinan berlangsung antara suami istri. Dalam Pasal tersebut tidak disebutkan secara jelas tentang atas jerih payah atau hasil kerja siapa harta bersama itu diperoleh, apakah hasil kerja suami atau istri. Harta bersama adalah harta yang ada selama perkawinan, di mana dalam melakukan tindakan hukum terhadap harta tersebut harus dilakukan oleh persetujuan kedua belah pihak. Tindakan hukum terhadap harta bersama tanpa adanya persejuan kedua belah pihak, maka perjanjian tersebut adalah dapat dibatalkan dan batal demi hukum.

Abstract

This study examines the phenomenon of female trafficking in Indramayu within the framework of interactions between local culture and economic compulsion. Indramayu is known as one of the regions with a high rate of female migrant worker deployment, some of whom become entangled in human trafficking practices. The aim of this research is to understand how cultural values, economic pressures, and weak legal protections contribute to this cycle of exploitation. Using a qualitative approach and case study method, data were collected through field observations and document analysis. The findings reveal that female trafficking in Indramayu is driven not solely by economic factors, but also by social norms that tolerate or even support the migration of women abroad for livelihood reasons. Within a context of limited options and deeply rooted gender inequality, women often lack full agency over their migration decisions. This study highlights the importance of policy interventions that go beyond economic aspects, advocating instead for cultural transformation and the strengthening of protections for women's rights.
