Abstract

Pengurangan masa tahanan menjadi hal yang wajib dicantumkan dalam suatu putusan pemidanaan, baik itu putusan pemidanaan biasa maupun pemidanaan bersyarat. Menurut ketentuan dalam pasal 1 angka 12 KUHAP bahwa upaya hukum adalah hak terdakwa atau penuntut umum untuk tidak menerima putusan pengadilan yang berupa perlawanan atau banding atau kasasi atau hak terpidana untuk mengajukan permohonan peninjauan kembali dalam hal serta menurut cara yang diatur dalam undang – undang ini. Perlawanan juga sering disebut verzet. Perlawanan merupakan upaya hukum berdasarkan undang – undang dalam hal – hal yang telah ditentukan yang umumnya bersifat insidentil yang tidak dimaksudkan terhadap putusan akhir dari pengadilan negeri.

Abstract

Detention is one of the forced efforts to enforce the law known in the criminal justice system, also, to arrest, search, confiscation, and wiretapping. The absolute authority possessed by law enforcement officials to detain a person suspected of committing a criminal act with the threat of a certain penalty makes detention very easy. Even though detention can be carried out, it must be carried out solely to examine the criminal case itself. Detention itself is an addition to an examination of a criminal case. The detention "can" be carried out against any suspect so that it is not an obligation to be carried out even if the criminal act suspected meets the requirements for detention. The protection of a person's civil liberties, especially concerning the legal process, will greatly depend on the clarity and detail of pretrial detention policies. Guarantee and protection of human rights in criminal procedural law rules have a very important meaning because most of the processes in this criminal procedural law lead to human rights restrictions such as arrest, detention, confiscation, search, and punishment which in essence are restrictions. Abstract

Currently, the Corruption Eradication Commission (KPK) is regulated by law, which is considered to have an inferior institutional status and affect the performance of corruption eradication in Indonesia. This institutional inferiority can be judged on the basis of authority and institutions. This paper specifically discusses the institutional status of the Corruption Eradication Commission which is considered inferior and builds discourse through efforts to include the Corruption Eradication Commission as a state institution regulated in the 1945 Constitution. The analysis of this institution as a non-state institution that is not directly outlined in the 1945 Constitution influences its power in efforts to eradicate corruption.
