Abstract

Abstrak Kebijakan monopoli terhadap kegiatan usaha yang dilakukan BUMN seperti yang diamanahkan oleh konstitusi dan peraturan perundang-undangan Indonesia dilandasi dengan tujuan untuk mensejahterakan rakyat Indonesia secara adil dan merata. Sedangkan kebijakan demonopolisasi terhadap BUMN dilakukan oleh pemerintah atas dasar tuntutan globalisasi demi menciptakan kondisi pasar persaingan sempurna, efisiensi serta efektifitas dalam pengelolaan korporasi. Pilihan antara monopoli atau demonopolisasi terhadap BUMN merupakan kebijakan yang harus dapat diputuskan oleh pemerintah. Atas dasar untuk mencarikan konsep dan solusi kebijakan mengenai penyeimbang antara aspek tuntutan globalisasi dan kedaulatan negara maka dilakukanlah kajian tersebut dengan menggunakan metode penelitian yuridis normatif. Hasil penelitian berupa strategi antisipasi yang dapat dipertimbangkan oleh pemerintah dalam menentukan kebijakan yang merupakan gagasan pemikiran kebaruan dengan mengutamakan prinsip-prinsip perekonomian kerakyatan yang sesuai dengan Konstitusi Republik Indonesia. Penentuan pilihan untuk menetapkan suatu BUMN dapat menjalankan usaha secara monopoli atau justru menerapkan kebijakan demonopolisasi harus mampu diputuskan dengan dasar pertimbangan yang kuat. Hal terpenting adalah memastikan bahwa sistem ekonomi kerakyatan harus mampu diterapkan dalam pelaksanaan kinerja BUMN baik yang melakukan kegiatan usaha secara monopoli maupun demonopolisasi. Abstract The monopoly policy on business activities carried out by State Owned Enterprises (SOEs) as mandated by the Indonesian constitution and regulations, is based on the aim of prospering the people of Indonesia in a just and equitable manner. While the policy of demonopolization of SOEs is carried out by the government based on the demands of globalization in order to create market conditions of fair competition, efficiency and effectiveness in managing the corporation. The choice between monopoly or demonopolization of SOEs is a policy that should be decided by the government. This articles focus on finding policy solutions regarding balancing between the aspects of the demands of globalization and state sovereignty. The study was conducted using desk research (yuridis normative) methods. The results of the research are anticipatory strategies that can be considered by the government in determining policies that are ideas of novelty thinking by prioritizing the principles of popular economy in accordance with the Indonesian Constitution. Determination of the choice to establish an SOEs can run a business monopoly or even implement a policy of demonopolization must be able to be decided on careful and hard consideration. The most important thing is to ensure that the populist economic system must be able to be implemented in the performance of SOEs that conduct monopoly and demonopolization business activities.

Abstract

This research aims to find out the role of the Notary in the process of transferring subsidized home ownership credit (KPR in Indonesia) at the main branch of PT.BTN Palembang. This research is a type of normative research using library research material collection techniques. The background to this writing is that in practice there is often a transfer of subsidized home ownership credit (KPR) carried out by debtors who have been placed in subsidized housing for less than 5 (five) years. This is contrary to Article 29 paragraph (4) letter e Regulation of the Minister of Public Works and Public Housing of the Republic of Indonesia Number 35 Years 2021 concerning ease and assistance in obtaining housing for low-income people. The role of the Notary in this case is to make an authentic deed relating to the process of transferring subsidized home ownership credit (KPR) to the main branch of PT BTN Palembang. The deeds required in the credit transfer process are a statement of transfer of rights, a Deed of Sale and Purchase Agreement, a power of attorney to pay off the installments, and a power of attorney to take the house certificate. In this credit transfer process, in carrying out his position, the Notary must pay attention to the principle of balance.

Abstract

Quality standards for water health requirements for sanitation hygiene, swimming pools, solus per aqua (SPA), and malls monitor by the Public Health office. Still, the monitoring process has yet to publish. It has not provided legalization, such as labels or signs that consumers can recognize, even though information and legalization need as an effort to protect consumer rights, especially a guarantee of security and comfort when using or utilizing products from business actors. This article used an empirical study to describe the urgency of the publication and labeling of water quality standards for swimming pools, spas, and mall sanitation.  The data were by polling managers of five swimming pools, ten spas, five malls, and 100 consumers as respondents. The research results are described in a qualitative descriptive manner based on primary and secondary data through a statutory approach and a legal sociology approach by prioritizing the fulfillment of transparent consumer services. The addition of benefits resulting from the supervision of water quality standards on the website of the Public Health office is one solution to strengthen consumer protection and, at the same time, become evidence of enhancing the state's role as a supervisor.

Abstract

AbstractNotary as a public official is authorised to make a will deed by prioritising the principle of prudence. Supreme Court Decision Number 1968 K/Pdt/2018 stated that the notarial deed of will made based on the family meeting resume was cancelled. The purpose of this research is to know, understand, and analyse the position of the testamentary deed made based on the testator's family meeting resume and the notary's responsibility for the testamentary deed. This research is a normative research with statutory, conceptual and case approaches. The research legal material consists of primary and secondary, using library legal material collection techniques, qualitative research legal material analysis techniques, and inductive inference techniques. The results showed that the position of the deed of will made based on the resume of the testator's family meeting causes the deed to be null and void because it contains unlawful acts as Article 1365 of the Civil Code committed by the notary, namely violating the provisions of Articles 875, 944 of the Civil Code and 40 paragraph (2). Notaries can be held civilly, administratively and criminally liable for their negligence. Facts that show that notaries do not use the precautionary principle in carrying out their duties have an impact on the attendees and heirs. Strict action not only provides administrative sanctions but fines or compensation is an effort to minimise the negligence of notaries in carrying out their duties, in addition to providing protection and certainty of the fulfilment of the rights of the attendees or heirs.

Abstract

This article discusses the fulfillment of rights for corporate bondholders declared bankrupt by the Commercial Court. No regulation can provide a comprehensive and integrated benchmark to ensure the protection of the rights of bondholder creditors, making this article important to discuss. This research aims to analyze the status of corporate bondholders declared bankrupt by the Commercial Court as creditors in the liquidation process, evaluate the forms of legal protection applied during the process, and assess the future application of the law in providing certainty of protection for bondholders.  This research used normative legal research with statutory, historical, and futuristic approaches. The discussion results are carried out using an analysis perspective emphasizing deductive conclusions. Although corporate bondholders declared bankrupt by the Commercial Court have rights as creditors in the bankruptcy process, the legal protection is still ineffective. A regulatory gap results in uncertainty when implementing protection for bondholders. Revision of the Bankruptcy Law by including regulations regarding bondholders' creditors will provide certainty for the protection of creditors' rights, which can be derived in the Financial Services Authority (OJK) Regulation by enforcing supervision in the bankruptcy process in order to protect the interests of bondholders and ensure the stability of the economic development.
