Abstract

Indonesia's main land management agenda is agrarian reform, consolidating and distributing land for equity and social justice. In addition to strengthening existing institutions, Indonesia established a land bank whose main task is to provide land for investment and economic purposes. For some people, the goals of land banks interfere with land management practices in Indonesia because they are at odds with the goals of agrarian reform. So the research question that needs to be answered is what are the advantages and disadvantages of land bank practices in Indonesia? This research aims to identify the advantages and disadvantages of land bank practices in Indonesia. By identifying the advantages and disadvantages of land bank practices, the output of this study is expected to provide recommendations to improve the quality of land bank policies. This is a case study research with a qualitative approach using descriptive analysis. The data source comes from the secondary data. The study results show that establishing a land bank has one of the advantages in solving land, environmental, and spatial planning problems. Meanwhile, the weakness of the practice of land banks in Indonesia is the potential for being unconstitutional and over-authorized. Thus, from the findings of weaknesses in the practice of land banks, recommendations are made for the government to clarify the functions and objectives of land banks to improve the social and economic welfare of the Indonesian people.

Abstract

Abstrak: Agenda utama manajemen pertanahan Indonesia adalah reforma agraria yang mengkonsolidasikan dan mendistribusikan tanah untuk pemerataan dan keadilan sosial. Selain memperkuat institusi kelembagaan yang ada, Indonesia membentuk bank tanah yang salah satu tugas utamanya ialah menyediakan tanah untuk kepentingan investasi dan ekonomi. Bagi sebagian orang, tujuan bank tanah mengganggu praktik manajemen pertanahan di Indonesia karena berseberangan dengan tujuan reforma agraria. Sehingga pertanyaan penelitian yang perlu dijawab ialah apa saja kelebihan dan kelemahan praktek bank tanah di Indonesia? Untuk menjawab pertanyaan besar tersebut, tujuan penelitian ini yaitu untuk mengidentifikasi keuntingan dan kelemahan praktek bank tanah di Indonesia. Dengan mengidentifikasi keuntungan dan kelemahan praktek bank tanah, maka keluaran penelitian ini diharapkan memberikan rekomendasi sebagai upaya peningkatan kualitas kebijaakan bank tanah. Penelitian ini merupakan penelitian studi kasus dengan pendekatan kualitatif menggunakan analisis deskriptif. Sumber data berasal dari sekunder. Hasil penelitian menunjukkan bahwa dibentuknya bank tanah salah satu keuntungannya adalah menyelesaikan permasalahan lahan, lingkungan dan tata ruang. Sedangkan kelamahan praktek bank tanah di Indonesia adalah berpotensi inkonstitutional dan over kewenangan. Sehingga, dari temuan kelemahan praktek bank tanah, maka rekomendasi bagi pemerintah agar memperjelas fungsi dan tujuan bank tanah sebagai salah satu upaya meningkatkan kesejahteraan sosial dan ekonomi masyarakat Indonesia.Abstract: The major agenda of Indonesia's land management program is agrarian reform that consolidates and distributes land for social justice. However, instead of strengthening existing institutional institutions, Indonesia established a new institution called a land bank, which provides land to boost the investment climate and economy. For some people, the purpose of establishing a land bank is to exacerbate land use management practices in Indonesia because it is at odds with the goals of agrarian reform. Thus, a big question arises that needs to be answered, what are the advantages and disadvantages of land bank practice in Indonesia? To answer this big question, this research aims to identify the advantages and disadvantages of land bank practice in Indonesia. By identifying the advantages and disadvantages of land bank entities, the output of this study is expected to provide recommendations to improve the quality of land bank practices. This research is a case study with a qualitative approach using descriptive analysis. Secondary data sources include scientific publication data, mass media articles, online seminars, interviews, and focus group discussions. The study results show that the advantage of establishing a land bank is solving various land, spatial and environmental problems, while the disadvantage of land bank is that it can potentially exacerbate land-grabbing practices. Thus, from the findings of land bank losses, the government should clarify the functions and objectives of land banks to improve the socio-economic welfare of the Indonesian people.
