Abstract

Development and spatial planning policies, especially physical infrastructure, are closely tied to the changes in land use. When these policies intersect with public living spaces, there is a possibility that they are leading to eviction. Although driven by public interest considerations—such as infrastructure development, post-disaster relocation and reconstruction, river flow normalization--evictions in Indonesia often coincide with conflicts, violence, lack of information, and inadequate compensation. These eviction practices are closely associated with alleged human rights violations. This article aims to critically examine the normative aspects of eviction policies and practices in Indonesia from a human rights perspective. It also raises the idea of human rights intervention in eviction policies and practices, aiming at establishing an ideal balance between spatial planning needs and human rights protection for displaced communities. By juxtaposing eviction policies and practices in Indonesia with human rights instruments related to evictions, this kind of intervention is necessary in within three time frames of eviction, namely before, during, and after evictions. Within these temporalities, the government should consider all alternatives outside evictions, provide clear information including eviction procedures, ensure protection for affected communities, and ensure reparative efforts for impacted communities.

Abstract

President Joko Widodo on November 2, 2020 signed Law No. 11 of 2020 concerning Job Creation, which is known to the public as the omnibus law. The omnibus law is a simplification mechanism for 79 (seventy nine) laws aimed at encouraging investment and job creation. Various aspirations and objections from the public, in terms of substance and formality were not taken seriously by the government and parliament, instead there were arrests, detentions and suggested a judicial review at the Constitutional Court. The presence of the omnibus law will increase regulatory obesity because it imposes a delegation of 450 (four hundred and fifty) arrangements and further emphasizes the dominance of executive power. The research method used is qualitative with descriptive presentation. Primary legal materials are collected through inquiries from members of parliament and academics/experts, while secondary legal materials are based on reports, journals, books and regulations. This research concludes that: (a) the acceleration of the discussion of the Job Creation Law is influenced by the power of the President as the leader of the coalition whose membership reaches 74% in parliament; (b) the formation process is still problematic in the formal aspect, especially with the lack of public participation and transparency, but the omnibus law has become a new tradition in the formation of the state administration system; and (c) the Job Creation Law becomes an indicator of the domination and integralism of executive power and a reduction in legislative authority in drafting laws.

Abstract

In the history of Indonesia, civil-military relations changed in the reformasi era with the separation of the military and the police, resulting in the removal of the dual-function doctrine and military reform. Despite so, two decades after reformasi has not formed a standard and ideal mechanism to govern civil-military relations within the framework of objective civilian control. This paper addresses issues regarding (a) how the dual-function concept and internal reform within the military; (b) regulatory issues that govern military operations other than war; (c) the ideal model of civil-military relations in Indonesia to ensure democratic life and an overview of the siyāsah sharʻiyyah aspects. Using descriptive qualitative method and conducting discussions with military and human rights experts, this paper demonstrates that military reform in Indonesia after the New Order has not yet been fruitful to accomplish the mission to form professional soldiers. The military is still involved in political and civilian life under the pretext that there is no military assistance law. As a consequence, the ideal model of civilian control that puts the military under the control of civilian authority according to siyāsah sharʻiyyah principle has not been fully successful and effective.

Abstract

Presiden Joko Widodo telah melantik Anggota Dewan Pengawas Komisi Pemberantasan Tindak Pidana Korupsi yang diberikan mandat pengawasan dan perijinan penyadapan. Pembentuan Dewan Pengawas ini didasarkan pada Undang-Undang Nomor 19 Tahun 2019 yang merupakan revisi Undang-Undang Nomor 30 Tahun 2002, yang dalam proses politiknya memantik penolakan publik dan demonstrasi yang berujung kekerasan. Penyadapan dalam aspek penegakan hukum menjadi hal krusial karena berkaitan pembatasan hak asasi manusia terutama kebebasan pribadi (privacy rights) dan bagaimana meletakan posisi Dewan Pengawas dalam sistem peradilan pidana di Indonesia. Berdasarkan hal tersebut, penelitian ini menjawab rumusan masalah: (1) bagaimana pengaturan pembatasan hak atas kebebasan pribadi (privacy right) dalam prespektif hak asasi manusia dan relasinya dalam penegakan hukum pidana; (2) bagaimana muatan materi dalam UU Nomor 19 tahun 2019 mengenai penyadapan dan perbandingan dengan konsep ideal penyadapan dalam kerangka penegakan hukum; (3) bagaimana tinjauan terhadap keberadaan Dewan Pengawas dalam sistem peradilan pidana di Indonesia. Metode penelitian yang dilakukan adalah kualitatif dengan penyajian deskriptif. Pengumpulan data primer dilakukan dengan permintaan keterangan ahli dan aparat penegak hukum, sedangkan data sekunder dari laporan, jurnal, buku dan peraturan perundang-undangan. Penelitian ini berkesimpulan bahwa hak kebebasan pribadi (privacy right) dalam penegakan hukum dapat dilakukan pembatasan melalui peraturan setingkat undang-undang, akan tetapi muatan materi dalam UU Nomor 19 tahun 2019 sangat tidak memadai dan berpotensi terjadi pelanggaran hak asasi manusia, serta perlunya evaluasi terhadap eksistensi Dewan Pengawas.

Abstract

Malaysia is considered one of the primary destinations for migrants in Southeast Asia, particularly those from Indonesia. There are approximately 2.7 million Indonesian migrant workers in Malaysia, with 1.6 million having followed official placement procedures. The presence of a large number of Indonesian migrant workers in Malaysia has led to legal complications concerning their employment relationships with employers, including issues related to work contracts, safety regulations, social security, and termination of employment. Additionally, there are socio-legal concerns regarding the social integration of migrant workers into their new environment, which may contribute to criminal activities such as extremism, drug trafficking, human trafficking, undocumented labor, theft, and domestic violence. The legal problems faced by migrant workers are influenced by two main factors: their level of legal understanding, both in terms of Indonesian law and Malaysian law, and their lack of familiarity with the cultural norms of the host country, leading to social tensions. Therefore, the main question addressed in this study is how the social environment influences migrant workers' attitudes and behaviors, particularly whether it contributes to criminal acts and legal repercussions. This socio-legal study of the social relationship of Indonesian Migrant Workers with their environment is empirical using a survey method involving Indonesian Migrant Workers and document review. All data and legal materials are processed and analyzed using statistical instruments of central-tendency analysis for quantitative data, and interactive models of qualitative data analysis for qualitative data, while the analysis of the substance uses analytical theory of legal-protection and legal-justice.
