Abstract

Waqf is the release of the property that is represented from the ownerby withholding his principal treasures and giving charity for the sakeof social interest for the common good. In changing the status of waqfproperty, the turn of the object and the purpose of the waqf are verystrict in Syafi'i's Imam, however, on the basis of an emergency and theprinciple of maslahat, among jurists like Imam Hanafi, the change canbe made, So that the benefits of endowments that continue to continueas shadaqoh fingers, not mubadzir because it is damaged, does notwork anymore and so forth. With that change, the status of the objectas a waqf property is essentially undamaged.This research is basically aimed to know the view of Imam Syafi'i andImam Hanafi regarding the change of wakaf's property status, itcan be understood that regarding the change of wakaf wealth statusaccording to Imam Syafi'i it is said that the wakaf property that isnot working anymore still can not be sold, Exchanged, replaced andtransferred, except in a state of necessity the wakaf property can beexchanged or sold. Whereas Madzhab Hanafi is of the opinion that thewaqf objects that have been or are not functioning anymore whichis no longer in accordance with the allocation, it may sell, change,replace or move the wakaf objects, in order to function or bringmaslahat in accordance with the purpose of waqf, or to obtain moremaslahat Great for the public interest, especially the Muslims.

Abstract

Although Islamic law and Javanese customary law basically havesimilarities, especially in the type and status of inheritance, there aredifferences in the use and distribution of inheritance, the heirs, andthe children. In this paper will explain about how the implementationof the division of inheritance in Java society.In terms of time of Javanese community heritage there is a system thatis not in line with Islamic inheritance law. Islamic law is the processof transferring property from the heir to the heirs after the deceasedis declared dead. And what happens to the Javanese community is theheir to distribute his inheritance before the heir died. Meanwhile, interms of heirs as well as its part, the pattern of division of Javaneseheritage that is with the system of peace or kinship.

Abstract

Menjalani kehidupan rumah tangga merupakan suatu sunnah yang dilaksanakan oleh seorang muslim. Salah satu tujuan dalam menjalani kehidupan rumah tangga adalah mewujudkan keluarga yang sakinah, mawaddah dan rahmah, yaitu keluarga yang tentram dan penuh kasih sayang. Untuk menuju kehidupan keluarga yang bahagia tersebut salah satunya adalah dengan terpenuhinya kebutuhan keluarga mulai dari pendidikan sampai dengan sandang, pangan dan papan. Pada dasarnya tugas perempuan dalam keluarga adalah berbakti kepada suami dengan melayaninya, menjaga anak-anaknya, membimbing dan mengajarinya dengan pendidikan yang baik, serta menjaga kehormatannya dan menjaga harta suaminya ketika suami masih bekerja atau keluar kota. Namun pada kenyataanya, saat ini perempuan tidak lagi menjadi perempuan yang lemah lembut yang mengerjakan segala pekerjaan rumah saja, tapi dapat menjadi perempuan dengan segala ketangguhannya untuk menjadi garda terdepan dalam meningkatkan kesejahteraan keluarganya. Dalam keluarga, tentu saja perempuan memiliki peran yang sangat dominan, tidak hanya mengurus keluarga dan aktivitas rumah tangga juga dalam meningkatkan ekonomi keluarga. Hal itulah yang dilakukan agar tercapainya keluarga yang sejahtera di tengah-tengah pandemi covid-19 yang belum segera usai.

Abstract

This research aims to find the factors of marriage of indentured servant students carried out at the BaitulMustakim Islamic Boarding School, the contribution of the Kyai Caretaker of the Islamic Boarding School given to his indentured servant students, and the legal certainty of marriages carried out by indentured abdindalem. The method used in this research is field research, using a qualitative descriptive approach. Data collection uses the interview method. With the research location at the BaitulMustakim Islamic Boarding School, Punggur District, Central Lampung Regency, Lampung Province. Those examined were Islamic boarding school caretaker kyai, Ustad-Ustadzah, abdindalem students who held weddings at the Islamic boarding school. The findings of this study are that the marriage of santriabdindalem carried out at the Boarding School is due to several factors including; the offer from the Kyai Caretaker of the Islamic Boarding School, the desire of the parents of Santriabdindalem, the desire of santri to carry out marriages at the Boarding School. The contribution given by the Kyai Caretaker of the Islamic Boarding Schoolto the santriabdindalem towards the implementation of marriages held at the Boarding School is to provide assistance in the marriage registration process, money or 5 grams of gold, consumption. That the marriage carried out by the santriabdindalem is legally valid according to religion and the state.

Abstract

The development of Micro, Small, and Medium-Sized Enterprises (MSMEs), particularly those run by housewives, has enormous potential in Totokon Village, Punggur District, Central Lampung Regency. However, one of the biggest challenges to improving product attractiveness and digital marketing is the lack of expertise in promotional design. Through design instruction via the user-friendly and accessible Canva app, this business seeks to empower housewives. Intensive training, a participative approach with socialization stages, and help with promotional graphics that meet MSMEs' needs are some of the techniques employed. Digital marketing and community empowerment theory serve as the foundation for this program. The findings demonstrated that participants' abilities to produce eye-catching and expert promotional designs, like logos, flyers, and product catalogs, had improved. Additionally, the participants' confidence in their ability to use social media increased.

Abstract

Setelah wafatnya Nabi Muhammad SAW, umat Islam dihadapkan pada berbagai tantangan dalam memahami serta menerapkan ajaran Islam, terutama dalam aspek sosial, politik dan hukum. Tidak adanya Nabi sebagai rujukan utama menyebabkan para sahabat dan ulama melakukan ijtihad, yang kemudian memunculkan beragam aliran pemikiran dalam Islam. Penelitian ini bertujuan untuk mengkaji munculnya aliran-aliran tersebut dalam Upaya pencarian kebenaran dalam aspek hukum dan teologi Islam. Dengan memakai pendekatan deskriptif kualitatif, kajian ini menelusuri perkenmabngan pemikiran Islam sejak masa Khulafaur Rasyidin hingga zaman dinasti Islam. Temuan penelitian menunjukkan bahwa akar perpecahan dalam Islam berasal dari persoalan politik, khususnya terkait masalah kepemimpinan, yang selanjutnya meluas ke ranah teologis dan hukum. Aliran-aliran seperti Khawarij, Qadariyah, Jabariyah, Mu’tazilah, dan Asy’ariyah memainkan peran penting dalam pembentukan hukum Islam hingga kini. Studi ini menyoroti pentingnya pendekatan yang moderat dalam menyikapi keragaman pemikiran Islam agar tidak memperdalam perpecahan di tengah umat.

Abstract

This article examines the problematic social practices related to the appointment of Wali al-Nikāḥ (marriage guardians) in Kotagajah Subdistrict, Central Lampung Regency, Indonesia. The focus lies on conflicts surrounding the rejection of Wali al-Nasab (lineal guardians) by the bride's family, disputes among multiple guardians within the hierarchical structure, and unauthorized delegation of wali. This study explores the tension between the normative framework of Islamic law regarding Wali al-Nikāḥ and the lived realities of marriage practice at the community level. To address this issue, a qualitative fieldwork approach was employed using a socio-legal lens. Data were collected through interviews with penghulu (marriage registrars), religious leaders, and families who have experienced guardianship disputes, supported by administrative documents from the Office of Religious Affairs (KUA) and references from classical fiqh texts and Indonesian marriage law. The findings reveal various forms of conflict in marriage proceedings, including the moral disqualification of biological fathers, internal family disputes over rightful guardianship, and administrative manipulations such as "declaring the guardian deceased" to secure the appointment of a Wali al-Ḥākim (judicial guardian). These phenomena indicate a disjunction between fiqh-based legal norms and social dynamics, often leading to compromise. This study highlights the need to critically reassess the wali hierarchy's structure in Islamic law and develop more responsive legal mechanisms that better reflect social realities.
