Abstract

Zakat merupakan salah satu instrument yang dianggap mampu mengatasi krisis ekonomi masyarakat. Dalam implementasinya zakat tidak sebatas rukun Islam, melainkan mempunyai efek domino dalam kehidupan masyarakat, terutama dalam mengangkat garis kemiskinan. Aplikasi zakat dapat meningkatkanpertumbuhan ekonomi dan sosial masyarakat. Secara teoritis, alokasi zakat terhadap masyarakat kecil akan meningkatkan pendapatan dan komsumsi mereka. Ini akan berdampak pada peningkatan produksi dan investasi. Dengan demikian jika zakat benar-benar diberdayakan, sektor perekonomian akan berjalan lebih baik, kemiskinan akan berkurang dan pengangguran sebagai wabah dari krisis sosial dapat ditanggulangi. Apalagi jika didukung oleh pemerintahan yang bersih dan munculnya sifat qanaah, menahan diri, dan semangat berkarya dari semua elemen masyarakat.

Abstract

One of the contracts that is interesting to discuss is the ijarah (lease) contract, which is also a contract that is often used in every day life. It is also interesting to discuss, because in this contract there will be modifications and change due to human needs. One of the changes in the form of this lease agreement is the Ijarah Al-Muntahiyah Bi al-Tamlik (IMBT) contract or also known as Al-Ijarah Thumma Al-Ba’i –AITAB- (rent then buy) and hire and purchase. This contract uses two contract in separate ways, namely the lease contract (ijarah/leasing or renting), and the sale and purchase contract (ba’i/purchase). The IMBT contract is similar to the conventional lease agreement which is very popular lately it can be said that IMBT is sharia based leasing.

Abstract

Endowment practice in Indonesia has been accepted by the societies (customary law) since the first time of Islam comes to Archipelago. It is designated by the establishment of mosques being built on waqf land. Subsequent to Indonesia's liberty, the government issued several regulations regarding waqf, such as Government Regulation No. 28 of 1977 concerning Perwakafan Tanah Milik (Endowment of freehold estate), PMA No. 1 of 1978 concerning Implementing Regulation Government Regulation No. 28 of 1977 concerning waqf lands, Islamic Law Compilation (KHI), and other regulations. Devining to the enahncement of waqf law, it is necessary to review the historical overview deeply to recognize the development of waqf in the Indonesia
