Abstract

Masalah penelitian ini adalah bagaimana eksistensi Sanksi A’Massa sebagai delik pidana adat di kabupaten Gowa. bagaimana Eksistensi sanksi adat A’Massa pada delik pidana di Kabupaten Gowa(studi kasusu Kecamatan Tompobulu), bagaimana penerapan sanksi adat A’Massa pada delik pidana di tinjau berdasarkan hukum pidana adat. Jenis penelitian yaitu jenis penelitian hukum empiris, Ditemukan Eksistensi sanksi adat A’Massa masih diakui keberadaanya oleh masyarakat di kabupaten Gowa kususnya kecamatan Tompobulu,sanksi adat A’Massa ini merupakan perwujudan hukum pidana adat yang penerapanya terbukti dapat menekan angka kejahatan demikian Sanksi adat A’Massa ini jika di pandang dari hukum pidana Umum KUHP tetap saja melanggar dan di anggap sebagai perbuatan main hakim sendiri,Hukum Adat A’Massa dan KUHP merupakan dua hal belum ada titik temu, karna sanksi A’Massa ini masih di praktekkan namun di sisi lain KUHP atau hukum positif melarang karna di anggap perbuatan main hakim sendiri.

Abstract

Human Rights is an international private law that put the state as the parties; meaning that the state is obliged to comply with the legal subject of human rights law. As subjects of law, then any violation of human rights has always put the country as the culprit.  Violations  of  human  rights  occurred  when  the  state does not comply with the norms that bind, which is contained in the covenants and international conventions, in which the state has pledged to abide by the process of ratification. Basically, the human rights regime is the relationship between citizens and the State then continue to grow and become international human rights law after the Universal Declaration of 1948 that binds both parties through the base and the base charter agreement. While the criminal regime is a crime (act of crime) which put the individual as a subject of law, and perpetrators can be punished imprisonment. But not all types of crimes can be categorized as a crime of Human Rights, only the gross human rights violations the potential occurrence of crimes against human rights; the crime in question, namely: crimes against humanity, genocide, war crimes and the crime of aggression.

Abstract

Dengan bergulirnya desentralisasi dan bertambahnya jumlah daerah karena pemekaran, persoalan daerah-daerah kian kompleks. Sebagaimana dijuluki oleh Barnabas Suebu, banyak muncul “raja-raja kecil” yang sekaligus menegaskan posisi power mereka, seiring dengan mengalirnya alokasi dana atau anggaran yang lebih ke daerah-daerah. Pelembagaan politik justru dibangun dengan insentif uang dan dukungan massa (rakyat) dimobilisasi dengan tetesan dana. Pilkada dan pe- mekaran tidak jarang menimbulkan kericuhan dan konflik. Hak Asasi Manusia menjadi isu yang penting dalam pelaksanaan otonomi tersebut.

Abstract

The legal political study of law enforcement in the field of human rights is a government legal political policy under the Jokowi-JK government to determine the direction and steps to be applied in resolving cases of serious human rights violations that occurred in the past as promised in its 2014 political campaign. The discourse on the resolution of gross human rights violations is a plausible promise during the campaign period so that it was elected president and was installed on October 20, 2014. In practice, during the 4 years of Jokowi-JK's administration, the campaign promises to date have not been realized while his administration was 1 more years. In this regard, under the Jokowi-JK government, the problem of resolving gross human rights violations is limited to political jargon and has not become a legal slogan in the enforcement of law and human rights and weak political will to realize this promise. This research is descriptive-analytical with a normative juridical approach which is carried out through library and field research, especially criticism of public discourse by contextualizing the sociological-political reality.
