Abstract

This research aims to find out the effectiveness of the legal aid center in the Makassar District Court. The research method used by the author is a type of empirical legal research where the approach used is a sociolegal approach where this research connects the objectives and data obtained in the field and the research location at the Makassar Court Class IA Special as for the data sources used, namely primary, secondary and tertiary data sources. The data collection techniques are observation and interview studies, using research instruments and descriptive data analysis. The discussion is an explanation of the research location and discussion by researchers in conducting interviews with employees and the community. The conclusion of this research is that the application is still lacking, and the opportunity is to help the community more the challenges faced are still many people who lack understanding of legal aid.

Abstract

Tujuan penelitian ini adalah menganalisis rencana kerja Kementerian Sosial dalam melaksanakan perlindungan dan pembinaan anak jalanan di Kota Makassar, dan menganalisis faktor penghambat rencana kerja Kementerian Sosial. Pertanyaan penelitian ini adalah apakah implementasi rencana pembinaan dan perlindungan anak jalanan yang dilaksanakan oleh Kementerian Sosial telah memenuhi harapan/hasil, dan faktor-faktor yang menghambat Kementerian Sosial dalam melindungi dan membesarkan anak jalanan di Makassar. Berdasarkan hasil penelitian ini dapat disimpulkan bahwa sistem perlindungan dan pengasuhan bagi anak jalanan dilaksanakan sesuai dengan tugas dan fungsinya. Kalaupun sudah diterapkan, masih ada anak jalanan yang turun ke jalan lagi. Oleh karena itu, perlu diupayakan kerjasama pemerintah, dari satu pemerintah ke pemerintah lain, dan bekerja sama dengan masyarakat, lembaga swadaya masyarakat dan instansi terkait lainnya dalam perlindungan dan pengembangan anak jalanan.

Abstract

The Constitutional Court Decision No. 118/PUU-XX/2022 redefined the paradigm of the statute of limitations for document forgery offenses in Indonesia. Previously calculated from the date of the offense, it is now determined based on when the forged document is discovered, used, and causes loss. This article examines the legal implications of the court decision on the state of limitations to legal certainty and law enforcement practices, particularly those carried out by the Indonesian National Police. A conceptual and statutory approach is employed to analyze the amendments to Article 79(1) of the Indonesian Criminal Code and the Court’s legal reasoning. The findings indicate that this change enhances legal protection for victims and requires investigators to cumulatively evaluate the elements of “discovery,” “usage,” and “loss” to determine the statute of limitations. The decision has erga omnes effect and serves as a binding precedent and guideline for investigating document forgery cases in Indonesia.

Abstract

Asset forfeiture has developed into a global policy adopted by various countries as an instrument of corruption eradication. The United States and Australia already have asset forfeiture programs, as do countries in Asia. The direction is to strengthen the state to fight corrupt behaviors. This study analyzes the development of the contemporary criminalization of corruptors through a doctrinal comparative study of asset forfeiture policies in Iran and Malaysia. The results of the study showed that both countries adopted the policies of the United Nations Convention Against Corruption (UNCAC) and the recommendations of the Financial Action Task Force (FATF). Malaysia retains the influence of the British legal system with adjustments to customary law, while Iran implements a more revolutionary model through the practice of expanding sharia-based confiscation. In the Indonesian context, normative and institutional obstacles remain challenges, but implementation opportunities are open through the passage of the Asset Forfeiture Bill. This study recommends that the Bill regulate policies, mechanism models, proof, institutional, execution, and penal-non-penal practices, including the implementation of expanding confiscation. Thus, Indonesia can strengthen its anti-corruption regime through asset forfeiture instruments that are in line with international standards, the practices of other countries, and Indonesia's needs.

Abstract

A clear legal framework is the basis of an effective policy, including when dealing with the Covid-19 pandemic. However, inconsistencies in this legal framework lead to legal uncertainty and public confusion. This research aims to critique the Indonesian government's approach to dealing with the Covid-19 pandemic, which began in early 2020, particularly the legal framework's inconsistency in enforcing different and ineffective legal sanctions at the central government and local government level. Normative research methods are used together with a statutory approach, while the research results are explained in a descriptive-qualitative way. This research shows that the government considers the Covid-19 pandemic a non-natural disaster and does not implement lockdowns. Meanwhile, the legal framework used is the health quarantine law, which requires implementing responses to public health emergencies very similar to lockdowns. In addition, the Large-Scale Social Restriction (PSBB) policy has its legal basis in a health quarantine law, while the Covid-19 pandemic situation is considered a non-natural disaster subject to the disaster management law. Furthermore, other results also show ineffective enforcement of legal sanctions, such as criminal sanctions in regional head decisions that cannot be enforced because the PSBB policy only includes administrative sanctions. In conclusion, the inconsistency of the legal framework in dealing with the Covid-19 pandemic is very detrimental to the community due to its impact on human rights, which can lead to legal uncertainty and public distrust of the government.
