Abstract

Temporary waqf is a restricted endowment for a specific duration. This paper examines Kuwait Law of Waqf and the contemporary implementation of temporary waqf in Kuwait. The research shows that Kuwait law of waqf allowed the application of all types of waqf as temporary, the duration of waqf should not exceed sixty years and no more than two layers of generations. This paper proposes to encourage other Islamic countries to implement this concept of temporary waqf as an alternative benefit.[Konsep wakaf sementara adalah wakaf yang dibatasi masa berlakunya selama periode waktu tertentu. Makalah ini mendiskusikan Undang-Undang Wakaf Kuwait dan implementasi wakaf sementara di Kuwait. Abstract

Muslim jurists differ in the declaration (ṣīghah) of waqf, specifically on whether an endowment can be temporary or it must be in perpetuity. In Malaysia most of the states impose waqf solely on perpetuity property based on the Shafi’i school of jurisprudence. The objective of this paper is to research whether temporary endowments have been enacted and applied in selected states in Malaysia, namely Selangor, Negeri Sembilan, Malacca and Johor. A qualitative methodology was used to analyze the data through inductive, deductive and comparative methods. The research shows that Johor is the only state of Malaysia that has allowed the application of temporary endowments, as stated in section 17 of the Rules of Waqf Johor 1983. It can be implied that fatwas which were issued by the Fatwa Committee regarding Endowments are required to be reassessed from time to time and not limited to the view of a single school of jurisprudence, especially in the field of waqf, without considering the best interests (maṣlaḥah) of contemporary society.DOI: 10.15408/sdi.v23i3.3592

Abstract

The problem of extremism and terrorism is one of the most serious and pressing issues facing contemporary society. It has become an urgent concern for those interested in the state of religion. This study will address the role of faith in confronting extremism and terrorism, based on the ideas of Sheikh Afif al-Din Mahajir in his booklet, which remains unpublished. The research aims to analyze the concepts of faith and security in this ideology, reveal the mechanisms that link them in confronting extremism, and evaluate the effectiveness of this vision in addressing this problem. To our knowledge, this topic has not been addressed in previous studies. The research relied on an inductive and analytical approach to analyze Sheikh Afif al-Din Mahjar's thought. The research concludes that Sheikh Afif al-Din Mahjar's thought presents an integrated vision of the concepts of faith and security, and that this vision contributes effectively to countering extremism and terrorism by strengthening the relationship between the three sisterhoods (brotherhood of faith, Islamic brotherhood, and human brotherhood), strengthening social ties, and developing proper religious awareness and good deeds. Sheikh Afif al-Din Mahajir's thought is characterized by moderation and balance, rejecting extremism in all its forms and manifestations.
