Abstract

Homade adalah sebuah industri catering yang berada di wilayah Pekalongan. Pada Homade saat ini sistem presensi karyawan masih dilakukan secara manual yaitu karyawan melakukan presensi dengan cara tanda tangan pada jurnal presensi yang telah disediakan. Dalam presensi karyawan yang masih manual akan memunculkan kendala seperti penyalahgunaan tanda tangan yang dilakukan oleh karyawan. Rekapitulasi presensi juga dilakukan secara manual dengan menghitung jumlah karyawan yang hadir, sakit, atau izin. Proses rekapitulasi tersebut membutuhkan ketelitian yang tinggi untuk menghindari kekeliruan dalam perhitungan jurnal presensi. Untuk dapat mengatasi permasalahan tersebut maka dibutuhkan sebuah sistem presensi karyawan pada Homade Pekalongan. Sebuah sistem presensi yang menggunakan QR code agar mengurangi kecurangan dalam proses presensi dan sebuah sistem yang juga memudahkan dalam laporan rekapitulasi presensi secara akurat dan otomatis. Dalam pengembangan sebuah sistem presensi digunakanlah metode waterfall. Dari hasil Desain dan pengembangan sistem maka sebuah sitem informasi presensi karyawan Homade Pekalongan menggunakan QR code berbasis android berhasil dibuat. Sistem informasi presensi yang mempunyai 2 hak akses yaitu karyawan dan admin atau owner. Hak akses karyawan hanya dapat melakukan presensi dengan QR code yang telah disediakan dan memberikan keterangan jika tidak masuk kerja. Karyawan juga dapat menyaksikan laporan dari kehadiran melalui sistem informasi presensi. Sedangkan hak akses admin dapat mengelola data karyawan dan melakukan rekapitulasi presensi karyawan, sehingga akan memudahkan admin pada Homade dalam menghitung jumlah karyawan dalam satu bulan dan juga mengurangi kesalahan dalam perhitungan jurnal presensi.

Abstract

The research was aimed at knowing the validity of the sales of paid apps by lending personal account (Apple ID) based on software lisence and the legal impact of selling paid apps by lending personal account (Apple ID). The research was a normative legal research. The approach used were statutory and conceptual approaches. Legal source used were primary, secondary, tertiary legal resources. Legal sources were collected by using literature study supplemented with interview. The collected legal sources were analyzed qualitatively. The research results indicate that the sales of paid apps by lending personal account (Apple ID) based on software lisence constitutes an illegal act because there is no right use transfer between Apple as the provider of apps that are available in App Store to the owner of Apple ID as the user of the application. The legal impact of the sales of paid apps by lending personal account constitutes branch of a contract which can be asked for liability based on Article 32 Law No 11 of 2008 concerning Information Electronic Transactions, Law No 28 of 2014 corcerning Copyright.
