Abstract

Indonesia is the biggest archipelago in the world with area of 5.9 million km2 with 6.4 million tons of fisheries resources. But with this potential there are still many crimes at sea, one of them is illegal fishing. To overcome various crimes at sea, the government provides the Shipping Court and the Fisheries Court which are expected to fulfill the legal needs of the sea, but in their implementation the two institutions are less than optimal. In the industrial revolution era 4.0, need a means to optimize public services in the justice system, especially in the maritime area. Based on the problem, we established the floating court based on e-floating court which is judicial institution to synergize the performance of shipping court and fisheries court in enforcement of marine law in Indonesia. In this study the authors used a juridical-normative research method.

Abstract

The Covid-19 pandemic that occurred in almost all countries has caused an economic crisis for various countries, including Indonesia. To maintain the level of consumption and minimize the increase in poverty due to the pandemic, the government provides social assistance for people who are affected economically. However, social assistance which is supposed to be a means of stabilizing the people’s economy is misused. Various problems occurred in the distribution of social assistance, starting from the unqualified recipient chosen, the reduced value of the cash, corruption, and embezzlement. The author designed Si Pansos as an electronic-based information system website containing information management, distribution, and reports regarding to the social assistance. Si Pansos is an application employing the principles of accountability and transparency in public services. The method used in this paper is a normative juridical approach to legislation, a case approach, and a conceptual approach.

Abstract

Salah satu kewenangan Pengadilan sebagai lembaga penegakan hukum adalah memeriksa, mengadili dan menyelesaikan perkara permohonan perubahan nama pada akta pencatatan sipil. Seringkali masyarakat menempuh jalur Pengadilan untuk me-nyelesaikan kesalahan penulisan redaksional dalam akta pencatatan sipil seperti kutipan akta perkawinan yang semestinya bukan menjadi kewenangan Pengadilan. Hal ini disebabkan karena adanya kerancuan dan disparitas pemahaman terhadap peraturan perundang-undangan terkait, sehingga dalam praktik menimbulkan polemik serta tumpang tindih kewenangan antara Pengadilan dengan Instansi pelaksana. Oleh karena itu, dalam penelitian yuridis normatif ini bertujuan untuk menganalisa batas kewenangan Pengadilan dan Instansi pelaksana dalam permohonan perubahan atau pembetulan nama pada kutipan akta perkawinan. Berdasarkan hasil penelitian bahwa pasca diberlakukannya Peraturan Menteri Agama Nomor 20 Tahun 2019, tidak ada lagi ketentuan yang mensyaratkan pencatatan perubahan atau pembetulan nama pada kutipan akta perkawinan berdasarkan penetapan Pengadilan, akan tetapi hal ini menjadi kewenangan Instansi pelaksana.
