Abstract

This article analyzes the legal system in the all-you-can-eat ticket system of Tlogo argo-tourism in Central Java, Indonesia. This research is based on recent concerns over the system’s implementation, specifically regarding its lack of clarity (gharar). The study employs a qualitative approach, combining legal-empirical analysis with the legal system theory of Lawrence Friedman and the concept of maṣlaḥah al-mursalah (public interest). The findings show that the all-you-can-eat ticket system in Tlogo argo-tourism has three components required by Lawrence Friedman’s legal system theory: legal structure, legal substance, and legal culture. The legal culture component is crucial in implementing the all-you-can-eat ticket system internally and externally. Moreover, the system also fulfills the three elements of maṣlaḥah al-mursalah: maṣlaḥah ḍaruriyyah (primary public interest), maṣlaḥah ḥajiyyah (tertiary public interest), and maṣlaḥah tahsiniyah (tertiary public interest). Therefore, this study contributes to a wider and more comprehensive view of buying and selling practices from the legal system’s perspective and maṣlaḥah al-mursalah.

Abstract

Dalam pengertian hukum Indonesia taklik talak adalah sebuah perjanjian akad terkait suami menggantungkan perceraian ketika suami melanggar isi taklik talak yang sudah dibacakan setelah akad nikah. Dalam hal ini peneliti menggunakan penelitian hukum normatif yakni penelitian kepustakaan dengan metode tiga kriteria hukum seperti bahan hukum primer, sekunder dan tersier. Penulisan ini menggunakan pendekatan Maqasid al-Syari’ah dengan menjelaskan hakikat dan hikmah dari objek formalnya. Kesimpulan dari tulisan ini bahwa taklik talak keberadaanya sangat penting dalam aturan perkawinan. Dengan adanya taklik talak dalam perkawinan yang bisa dimaknai sebagai salah satu perjanjian perkawinan juga taklik talak merupakan suatu perlindungan hukum bagi seorang perempuan (isteri) untuk menjaga dan memperjuangkan hak-haknya terhadap laki-laki (suami) apabila suatu saat terjadi ketidak harmonisan dalam keluarga. Taklik talak sejalan dengan Maqasid al-Syari’ah, sebab isi taklik talak tidak ada yang bertentangan dengan hukum Islam sendiri yaitu melindungi hak-hak isteri sama halnya tujuan maqasid syari’ah yaitu hifd ad-din, hifd akl, hifd nafs, hifd nasb dan hifd maal.

Abstract

Abstract: The Role of Career Women In Creating A Sakīnah Family: From Mubādalah (Mutuality) Perspective. Career women have dual roles, first as a wife and second as a worker. This dual role, either directly or indirectly, will affect their ability to manage domestic life. This study tries to examine this phenomenon through the perspective of mubādalah (mutuality) from Faqihuddin Abdul Kodir. The aim is to find out the success/failure of how career women reconcile their roles as housewives as well as career women. This research is qualitative by using a socio-legal approach. Data were collected using in-depth interview techniques conducted with several female lecturers at IAIN Salatiga. This study finds the fact that the perspective of Mubādalah (Mutuality) theory, when drawn into the realm of family life of female lecturers at IAIN Salatiga, is in line because Mubādalah theory requires a balance of relations between husband and wife and the elimination of gender bias to create a harmonious and prosperous family life.
