Abstract

As the organizer of the realization of social welfare, the state has not been able to optimally overcome social changes, which have an impact on increasing the number and complexity of social welfare problems. With the arguments of humanity and the principle of mutual cooperation, some parties help the government, then are called social workers. To ensure their existence, social worker organizations in Indonesia initiated the formation of the Law on the Social Worker Profession. Law Number 14 of 2019 concerning Social Workers was formed. After the birth of this Law, some questions emerged whether the Law provided solutions to the problems faced by social workers in assisting social welfare, or with this Law, the state would be out of hand and emphasize the resolution of social problems to social workers. This study described the legal political conditions for forming this Law. This study answered the politics of the formation of Law Number 14 of 2019 and the challenges for Social Workers in Indonesia after the birth of the Law. Answering those problems, this study used—statute approach, historical approach, and conceptual approach, strengthened by some literature related to Law and social workers. Besides that, this study also used protection theory to assess the Law. This study also compared some regulations in some countries regarding social workers in some cases. In short, this study found that the strong historical background, the long existence of social workers in Indonesia, and the need for legal protection and certainty have become the reason for establishing Law No. 14, 2019. However, after the birth of the Law, challenges arose for social workers where their actualization was not easy and limited according to their profession and education. In addition, it is alleged that the Law could lead to malpractice because there are no sanctions. While in Australia, and USA, social worker laws give more space for social worker.

Abstract

This article explains the legal system existing in the Pesantren, particularly in the term of takzir called perceived as non-human punishment contradictory with human rights. This research took place in Pondok Pesantren Edi Mancoro (PPEM) Salatiga with inclusive and tolerant characters, and voicing religious moderation. PPEM has had alumni becoming national figures. This study employed Lawrence Friedman’s legal system theory requiring the functioning of law in three components: legal structure, legal substance, and legal culture. This research employed qualitative method with data source obtained from field work study with depth interview technique and descriptive interpretive analysis. The result of research showed that Pesantren Edi Mancoro has legal system component as required by Friedman. In the context of takzir, there is a shift in the takzir (punishment) application method to evidently undisciplined students or those committing crime. Takzir contributes to creating personality (noble character) of santri in undertaking life post-pesantren. Takzir actually has educative values not contradictory with human rights. So, takzir in pesantren fulfills all components of legal system suggested by Friedman. Out of the three components, legal culture is the basic components of takzir functioning in pesantren, either internal or external legal culture.

Abstract

Sexual violence was prevalent in many settings, including in religious educational institutions. This article analyzed cases of sexual violence at an Islamic higher education institution in West Java, Indonesia, using the maqasid al-shariah and Foucault's theory of sexuality as the theoretical frameworks. This mixed-method research used Google form's surveys, in-depth interviews, and observations as the data collection methods. The data were analyzed using a flow model, which comprised selection, display, analysis or discussion, and conclusion. This study showed that verbal and non-verbal sexual violence was rampant. It occurred between student and student, lecturer and staff, staff and staff, and lecturer and student. Four models of sexual violence were found based on the typology designed by Dzeich and Weiner, who categorized thirteen forms of sexual violence. The maqasid al-shariah analysis outlined that sexual violence was against the fundamental values and objectives of sharia and human rights. Additionally, Foucault's theory identified patriarchal and cultural hegemony aspects in sexual violence. This study's intriguing part was the findings that combined in-depth interviews, observations, and surveys, intended to understand the intensity of existing cases. On the other hand, the power of analysis was centered on normative fiqh and sociological aspects. According to the literature reviews, these two approaches had not been administered by previous researchers.

Abstract

This article analyzes the legal system in the all-you-can-eat ticket system of Tlogo argo-tourism in Central Java, Indonesia. This research is based on recent concerns over the system’s implementation, specifically regarding its lack of clarity (gharar). The study employs a qualitative approach, combining legal-empirical analysis with the legal system theory of Lawrence Friedman and the concept of maṣlaḥah al-mursalah (public interest). The findings show that the all-you-can-eat ticket system in Tlogo argo-tourism has three components required by Lawrence Friedman’s legal system theory: legal structure, legal substance, and legal culture. The legal culture component is crucial in implementing the all-you-can-eat ticket system internally and externally. Moreover, the system also fulfills the three elements of maṣlaḥah al-mursalah: maṣlaḥah ḍaruriyyah (primary public interest), maṣlaḥah ḥajiyyah (tertiary public interest), and maṣlaḥah tahsiniyah (tertiary public interest). Therefore, this study contributes to a wider and more comprehensive view of buying and selling practices from the legal system’s perspective and maṣlaḥah al-mursalah.

Abstract

This study aims to: (1) identify students' needs for classical guidance services based on Social and Emotional Learning (SEL) in improving intrapersonal learning, (2) design the development of classical guidance services based on SEL, (3) test the effectiveness of these services in improving students' intrapersonal learning aspects at MAN 1 Tegal City. This study uses a research and development method with the ADDIE model from Dick and Carey. Data collection techniques include questionnaires, observations, validation sheets, interviews, literature studies, and documentation. The study population consisted of 482 class XI students of MAN 1 Tegal City, which were divided into control classes and experimental classes. Data analysis was carried out through normality tests, validity, reliability, t-tests, and media feasibility and effectiveness tests. The results of the study indicate that the classical guidance service module based on SEL has a significant effect on improving students' intrapersonal skills. Analysis of teacher and student needs includes media selection, format, compilation of questions and answers, and design of media applications. Validation from three experts showed that the material aspect scored 90.62%, while the media aspect reached 93.75%. The effectiveness of the module was proven by the increase in student learning outcomes, where the pre-test score of the experimental class increased from 13.89% to 83.34% in the post-test. These results confirm that the SEL-based classical guidance service module has a positive impact on students' intrapersonal skills in learning.

Abstract

In the development of society increasingly complex and increasingly heterogeneous society's will to get the best service in the bureaucracy, then the apparatus required to always provide a quality service, so that people are satisfied with the services provided by officials in the bureaucracy.To provide a quality service, which works in the bureaucratic apparatus, the apparatus must be professional, because only apparatus that professionals who truly understand the wishes of the people, and which is able to provide excellent service to the community. In this case, the role of the professional apparatus in order to realize the excellent service in the bureaucracy is very important, so that future bureaucracy in Indonesian become a bureaucracy that really provide the best service to the community. In this article, we try to give explanations regarding the role of the professional personnel in order to realize the excellent service in the bureaucracy, what excellent service, and although how to provide excellent service to the community.

Abstract

Dalam adat Lampung Saibatin, anak laki-laki disebut Pesesekh Nyawa, di mana ia adalah segalanya dan berperan penting dalam keluarga. Bila seseorang tidak memiliki anak laki-laki maka kurang sempurna hidupnya. Jadi, anak laki-laki sangat diutamakan didalam Adat Lampung Saibatin, karena mereka akan menjadi peyambung silsilah keluarga, ahli waris harta pusaka dan memelihara hukum adat. Penelitian ini bertujuan mengetahui pergeseran peran anak laki-laki tertua di Pekon Negeri Ratu Ngambur Kecamatan Ngambur Kabupaten Pesisir Barat menurut hukum keluarga Islam. Penelitian ini merupakan penelitian lapangan dan bersifat deskriptif. Pengumpulan data menggunakan metode wawancara dan observasi serta dianalisis dengan metode induktif. Hasil penelitian menunjukkan bahwa bentuk-bentuk pergeseran peran anak laki-laki tertua dalam Adat Lampung Saibatin, yaitu: Pertama, sebagai penerus gelar adat, anak laki-laki tidak lagi menginginkan menjadi penerus gelar adat dan tugas adat. Kedua, pergeseran peran sebagai ahli waris yang mana pembagiannya menggunakan hukum Islam dan musyawarah. Ketiga, pergeseran peran sebagai pemimpin dan pengayom keluarga, dikarenakan tanggungjawab keluarga tidak dipusatkan kepada anak laki-laki tertua dan fokus terhadap kehidupan keluarga masing-masing. Keempat, pergeseran sebagai wali nikah jika telah memenuhi syarat sebagai wali nikah dan senasab. Jika dianalisis menggunakan urf, maka hal tersebut diperbolehkan karena termasuk kedalam urf shahih, karena telah memenuhi syarat sebagai urf  (hukum kebiasaan)

Abstract

This study aims to discuss the message of da’wah that is contained in the Jinkrak Sundang Dance by using a qualitative descriptive approach and using the technique of semiotic analysis. Semiotics seeks to find the signs with meaning and know the sign systems such as language, movement, music, and pictures. As for the objects of the material to be analyzed is the movement of dance performed by the Jingkrak Sundang Dance artist, located in Magelang. A semiotic analysis on the Jingkrak Sundang Dance is performed on each stage or round: Mlayu, Nebah Bumi, Laku Telu Dadung Ngawuk, Pati, Mendem, and Nawur. Jingkrak Sundang Dance depicts the anger of the animals whose habitat was marred by the man’s hand, who was not responsible. The da’wah messages were found in denotation and connotation that many charged theological and anthropological. Theologically, the da’wah message explains the belief in the power of God as creators and regulators of whole natural life. In contrast, the da’wah message emphasizes the anthropocentric, seen many messages that urge to keep, love, and affection among fellow creatures. This study shows the conveyed to society to preserve nature and survival of all living beings. In addition, human behavior with good acts, help, and practice at once be an example for human beings and caring for the sustainability of the nature of the other.

Abstract

This study examines the role of mass media in constructing the image of Muslims in Indonesia, particularly through coverage of the bloody conflicts in Poso and Maluku. Suf Kasman, the author of the reviewed book, analyzes news framing in the newspapers Kompas and Republika using framing analysis. The findings reveal that both media tended to be emotional, provocative, and not entirely objective in their reporting, thereby influencing public perception. The article also highlights the importance of media methodology for religious scholars to understand contemporary social dynamics. Penelitian ini mengkaji peran media massa dalam mengkonstruksi citra umat Islam di Indonesia, khususnya melalui pemberitaan konflik berdarah di Poso dan Maluku. Suf Kasman, penulis buku yang ditinjau, menganalisis framing pemberitaan di harian Kompas dan Republika dengan menggunakan metode analisis framing. Hasil penelitian menunjukkan bahwa kedua media cenderung emosional, provokatif, dan tidak sepenuhnya objektif dalam memberitakan konflik, sehingga memengaruhi persepsi publik. Artikel ini juga menyoroti pentingnya pendekatan metodologi media bagi ilmuwan agama untuk memahami dinamika sosial kontemporer.

Abstract

Penelitian ini bertujuan untuk mengkaji implementasi manajemen Kurikulum Merdeka dalam membangun kemandirian belajar peserta didik di SMAN 1 Kedungwaru. Kurikulum Merdeka hadir sebagai solusi atas keterbatasan kurikulum sebelumnya dengan memberikan fleksibilitas dalam proses pembelajaran, baik bagi pendidik maupun peserta didik. Melalui pendekatan kualitatif dengan metode studi kasus, data diperoleh dari wawancara, observasi, dan dokumentasi yang kemudian dianalisis secara deskriptif. Hasil penelitian menunjukkan bahwa perencanaan kurikulum yang kontekstual, pelaksanaan pembelajaran yang fleksibel, serta pengembangan Projek Penguatan Profil Pelajar Pancasila (P5) mampu mendorong peserta didik untuk lebih mandiri dalam mengelola proses belajar. Peserta didik terlatih untuk menentukan tujuan, strategi, serta evaluasi pembelajaran mereka sendiri. Selain itu, evaluasi kurikulum berbasis Merdeka juga berperan penting dalam menilai perkembangan kemandirian belajar, bukan hanya pencapaian akademis semata. Secara keseluruhan, penerapan Kurikulum Merdeka di SMAN 1 Kedungwaru berdampak positif terhadap peningkatan kemandirian belajar siswa. Kurikulum ini tidak hanya berorientasi pada penguasaan materi, tetapi juga pada pembentukan karakter, kemandirian, dan kemampuan adaptif dalam menghadapi tantangan masa depan. Penelitian ini merekomendasikan perlunya dukungan berkelanjutan dari pihak sekolah, guru, dan pemangku kebijakan untuk mengoptimalkan penerapan Kurikulum Merdeka dalam membangun generasi pembelajar sepanjang hayat
