Abstract

This paper is a literature review with a comparative approach, meaning that the philosophy of Plato to study the concept of policy and law in the state of Athens, Ancient Greece. Then the authors analyze the advantages of the concept of Plato's political philosophy as a critical review of the political reform laws in Indonesia. The results of the literature review showed that from a conceptual perspective, philosophical, ideological, political jurisdiction of law in Indonesia aimed at the welfare of a just and prosperous society, in peace and prosperity, both physically and mentally, it is listed in Pancasila and the 1945 Constitution (UUD 1945). Political concept of Indonesian law is very relefan with political philosophy pioneered by Plato. But the political implications of the law of Indonesia dominant sourced on codification. The history of law in Indonesia experienced political dynamics. It was caused by political energy which dominate the role of law, so many national degradation: corruption, human rights, the financial crisis, removing P4 (as practice guidelines Pancasila). Therefore, learn to Plato, the ancient Greek philosopher. According to Plato the role of natural philosophy, philosophy of nature is very important to establish a governance structure. Relating this, the authors offer a return policy should apply P4, based on customary law and the need to establish a new state institutions, namely State Agency Professor (LTNP). LTNP of authority is a board of experts who contributed to the state policy. LTNP as a level to state institutions RI: executive; legislative and judicial).. Abstract

Pancasila budaya bangsa dipandang sebagai way of life dalam budaya lokal, maka peneliti melakukan penelitian bertujuan memunculkan keterkaitan Pancasila dengan budaya Manggarai melalui kajian filosofi wuat wai serta faktor pendukung acara wuat wai dari perspektif demokrasi Pancasila. Metode penelitian adalah kualitatif. Teknik analisis data: pengumpulan data (observasi, wawancara, dokumentasi), reduksi data, penyajian data, simpulan.dan kredibilitas data diuji melalui triangulasi data. Temuan penelitian: Filosofi budaya wuat wa’i bersifat imajinasi, realistis, diimplementasikan berupa sumbangan dana dan tenaga acara wuat wa’i dapat meringankan biaya pendidikan. Tradisi ini memenuhi amanah Pancasila dan tujuan nasional pada Pembukaan UUD 1945 alinea 4 menegaskan, mencerdaskan kehidupan bangsa

Abstract

Tujuan: Penelitian ini bertujuan untuk mengkaji relevansi praktik hukum adat waris Manggarai terhadap prinsip keadilan dan hak asasi manusia dalam sistem hukum nasional. Hipotesis penelitian berangkat dari asumsi bahwa meskipun hukum adat Manggarai bersifat patrilineal dan menempatkan anak laki-laki sebagai ahli waris utama, terdapat ruang transformatif yang memungkinkan adaptasi terhadap nilai kesetaraan. Metode Penelitian: Penelitian menggunakan metode hukum normatif dengan pendekatan kualitatif dengan desain etnografis dan analisis hermeneutik serta fenomenologis. Data dikumpulkan melalui wawancara mendalam dan observasi partisipatif di tiga wilayah kabupaten di Manggarai dengan melibatkan informan dari kalangan tokoh adat, masyarakat, dan keluarga pelaku praktik waris. Hasil dan Pembahasan: Hasil penelitian menunjukkan adanya pergeseran makna dalam praktik waris, di mana sebagian masyarakat mulai mengakui hak anak perempuan, baik secara langsung maupun melalui mekanisme pengangkatan kerabat laki-laki sebagai pewaris. Perubahan ini didorong oleh kesadaran internal masyarakat terhadap prinsip keadilan distributif dan nilai-nilai hak asasi manusia. Implikasi: Temuan ini menunjukkan bahwa hukum adat dapat bertransformasi secara progresif tanpa kehilangan identitas budaya lokalnya. Implikasi dari penelitian ini penting bagi penyusunan kebijakan hukum nasional yang menghormati hukum adat sekaligus menjamin prinsip keadilan substantif.

Abstract

This study aims to analyze legal protection for educators against the threat of criminalization in the implementation of student discipline. The main issue lies in the antinomy between laws protecting the teaching profession and child protection laws, which often creates legal uncertainty. The method used is normative legal research with a Systematic Literature Review (SLR) approach based on the PRISMA protocol applied to scientific literature. The results show that the criminalization of teachers is triggered by the failure to distinguish between educational disciplinary actions (animus corrigendi) and acts of violence (animus nocendi), as well as a law enforcement approach that tends to be overly legalistic without considering pedagogical dimensions. Weak implementation of norms and social pressures further exacerbate the situation. This study concludes that there is a need to reconstruct the legal paradigm by affirming protection for proportional disciplinary actions, as well as strengthening professional ethical mechanisms and justice-based approaches to prevent excessive criminalization of educators.
