Abstract

Artikel ini fokus mendiskusikan tentang bagaimana implementasi nilai-nilai moderasi ditanamkan melalui kegiatan akademik di ranah perguruan tinggi melalui kegiatan KKN. Studi ini bertujuan untuk menunjukkan bahwa negara, selain menjadikan isu moderasi beragama sebagai arus utama dalam membangun karakteristik keberagaman, juga melakukan terobosan demi optimalisasinya. Penelitian deskriptif ini didominasi oleh data field research yaitu wawancara dengan peserta KKN Nusantara Moderasi Beragama yang berhasil melakukan kegiatan pengabdian masyarakat di  Mulyasari, Mowila, Kabupaten Konawe Selatan, Sulawesi Tenggara, juga diperkaya oleh data skunder berbentuk studi literatur. Hasil menunjukkan bahwa KKN Nusantara berbasis Moderasi Beragama yang dilakukan oleh peserta merupakan terobosan penyemaian nilai-nilai moderasi yang saat ini menjadi salah satu isu aktual di level Kementerian Agama di tengah maraknya isu intoleransi dan disintegrasi antar agama. Instrumen KKN sebagai media desseminasi nilai-nilai moderasi beragama memberi ruang baru bagi mahasiswa dalam memahami dinamika keberagamaan yang rawan dengan isu-isu intoleransi dewasa ini.

Abstract

In the context of modern society, an effective and efficient legal system is of paramount importance. This article delves extensively into the concept of community service orders as an alternative to imprisonment and fines in the new Indonesian Penal Code (KUHP). The objective is to expound upon the significance of this concept and provide recommendations concerning changes in the legal system. A descriptive methodology is employed in this study to explore various perspectives on this issue and offer profound insights into the concept. The findings indicate that community service orders hold the potential to enhance the effectiveness of the penal system and contribute to the goals of rehabilitation and justice in modern society. However, for the successful implementation of this concept, a robust understanding of the practical aspects is necessary, including the choice of locations, clear legal regulations, and learning from the experiences of other countries that have adopted community service orders. These experiences can serve as a source of inspiration to minimize potential obstacles in the implementation of community service orders in Indonesia.

Abstract

Progressive legal reasoning of Islamic judges, especially regarding Ex-Officio rights, is a significant issue in this research. This article discusses the development and actualization of the Ex-Officio rights of Islamic judges in the decisions of Islamic family law in the Religious Court of Tulungagung from 2014 to 2020. Through a literature analysis and empirical data, this research describes the changes and developments in the application of Ex-Officio rights by Islamic judges in the context of divorce cases. As a result, judges can use ex officio rights to make broader decisions than those presented in the application, such as determining maintenance for parties who did not file the application. This broadens the scope of court decisions and provides more effective legal protection to those affected by divorce. Additionally, ex officio rights serve as a legal protection tool for women in divorce cases. Judges can issue decisions to prevent women from facing economic or social losses after divorce and ensure the full respect of women's rights.

Abstract

Marriage is an important institution in human social life, both in terms of religion, culture, and law. However, in some cases, there are situations where couples who want to marry must request dispensation from the applicable law, as was the case in East Java in 2022, where there was an increase in the number of applications for marriage dispensation. This study aims to analyze social and legal factors with a sociological-jurisprudence approach. The research method used is a qualitative approach using literature study techniques and relevant skunder data related to the dynamics of the marriage dispensation. The results showed that factors influencing the decision to apply for marriage dispensation include economic, cultural, religious factors, also influenced by social changes and policies related to the minimum age of marriage. The polemic regarding the marriage dispensation needs to get deeper attention, so that the judiciary and the government can determine the right policy to deal with the phenomenon.

Abstract

This article examines the practice of secret marriage in Pekoren Village, Rembang District,  Pasuruan Regency, East Java, with a focus on the central role of the kyai (Islamic cleric) in legitimizing the practice. Using a qualitative approach and ethnographic methods, this study explores how local religious authority constructs, negotiates, and sustains social legitimacy for marriages that are not legally recognized by the state. The study finds that the authority of the kyai is neither singular nor absolute, but shaped through complex social, symbolic, and economic relationships. Secret marriage occurs in various contexts, including late-life marriages, suspended marriages due to age restrictions, and polygamous marriages without official permission. The kyai serves as a mediator between religious norms and state legal pressures, offering religious legitimacy when the formal legal system is perceived as inadequate. This article shows that state law and local norms intersect through a space of compromise maintained by cultural-religious authority. Drawing on Khaled Abou El Fadl’s theory of authority and Max Weber’s theory of social action, the article underscores the importance of understanding legal pluralism and social authority in grassroots family law practices in Indonesia.
