Abstract

MK Decision No. 35 / PUU-X / 2012 concerning testing Law No. 41 of 1999 concerning Forestry, brought a breath of fresh air to indigenous and tribal peoples, in which in its decision the Constitutional Court has emphasized the existence of customary forests as private forests and is no longer part of state forests as well as serious recognition of the existence of indigenous and tribal peoples. Where in the Constitutional Court's decision No. 35 / PUU-X / 2012 regarding the review of Law Number 41 of 1999 concerning Forestry, the judge tried to provide an ideal decision based on the legal objectives and has been reflected in the ruling elements of justice (Gerechtigkeit), legal certainty (Rechtssicherheit) and expediency (Zweckmassigkeit). These three elements can be found when not only in the Constitutional Court's decision, but in an interrelated legal system. Which, the legal system does not only refer to the rules (codes of rules) and regulations (regulations), but includes a broad field, including the structure, institutions and processes (procedures) that fill it and related to the law that lives in society (living law ) and legal culture (legal structure). As the theory put forward by Laurence M. Friedman that the elements of the legal system consist of legal structure, legal substance and legal culture. Researchers hope that in the future indigenous and tribal peoples can be more affirmed their rights regarding their forest land rights, and regional governments are more responsive to the needs of indigenous and tribal peoples.

Abstract

This objective is to examine the original income of the region for sustainable regional development in Indonesia, using normative legal research. Regional government finance is a very decisive factor in the administration of regional government. The financial capacity of a region is determined by the existence of a source of regional income and its level of lucrative. The level of a local source of revenue is determined by the extent to which the basis for imposing taxes is responsive to inflation, population growth and economic growth. Generally in developed countries that implement decentralization policies tend to give greater authority to the regions to manage sources of revenue that are lucrative. On the other hand, in developing countries, financial resources are controlled by the central government. Local governments only manage financial resources that are less potential.

Abstract

Election implementation by Panwaslu cannot play an effective role in supervising every stage of the Provincial and Regency / City Pilkada. There are obstacles faced by the District / City Panwaslu and the District Panwaslu in carrying out their roles, namely by the regulation of authority that limits all forms of Panwaslu actions in the implementation of Pilkada. The Provincial Panwaslu to the level of the Field Supervisory Committee (PPL) in the exercise of its authority will make efforts to the community such as taking action to inform people about how to exercise the authority to supervise the implementation of the Provincial and Regency / City Pilkada, so as to create an honest, fair, and regional election democratic depends on the extent to which the General Election Supervisory Committee works well and ensures the smooth running of Regional Head Elections that take place in a democratic manner.

Abstract

The purpose of this study is to examine human rights over water after the abolition of Law Number 7 of 2004 concerning Water Resources by the Constitutional Court. The research method used is normative juridical. Later there was an opinion that if the state was unable to guarantee the fulfillment of human rights over water, then the water supply was carried out by a third party. The state must regulate the appropriateness of control over water sources, affordability of prices, guarantees for water health. For the realization of these things, a system of regulation must be made. An independent regulatory body can also be formed, public participation, and sanctions against violations. In essence, every regulation issued by the local government related to water use actually makes water as "Economic goods". Commercialization and privatization of water services is not an illegal thing as long as it can improve clean water services so that public access to water also increases. Local governments should be able to understand that commercialization of water resources by setting drinking water tariffs that exceed the capacity and reasonableness of the community actually results in reduced community access to water resources, especially clean water and drinking water. The poor and marginalized are the most vulnerable groups to the failure to fulfill the right to water by the State. To see the extent to which the fulfillment of the right to water by the state apart from the perspective of the executive authority, it is necessary to look at court decisions that can reflect the fulfillment of the right to water especially after the abolition of Law Number 7 of 2004 concerning Water Resources by the Constitutional Court and return to Law Number 11 of 1974 concerning Irrigation.

Abstract

Penelitian  ini  dilakukan  untuk  menganalisis  eksistensi fungsi dan peranan Dewan Perwakilan Rakyat Daerah (DPD) sebagai lembaga negara di sistem ketatanegaraan Indonesia .  Dalam  penelitin  ini  Penulis  menggunakan  pendekatan yuridis  normatif. Pendekatan yuridis  normatif  artinya  pendekatan yang dilakukan berdasarkan bahan hukum utama dengan cara menelaah teori-teori, konsep-konsep, asas-asas hukum serta peraturan perundang-undangan yang berhubungan dengan penelitian ini. Pendekatan ini dikenal pula dengan pendekatan kepustakaan, yakni dengan mempelajari buku-buku, peraturan perundang-undangan dan dokumen lain yang berhubungan dengan penelitian ini. Hasil  penelitian ini adalah terdapat beberapa masalah yang dihadapi oleh  DPD sebagai lembaga negara sehingga fungsi dan peranan Dewan Perwakilan Rakyat Daerah (DPD) sebagai lembaga negara di sistem ketatanegaraan Indonesiasaat ini tidak tampak, terutama dalam fungsi Legeslasi  seperti : Peran yang dibatasi, Kedudukan yang dibatas, Wewenang yang dibatasi dan Keterlibatan yang terbatas, terlihat  dalam Undang-Undang No. 22 Tahun 2022 mengenai susunan dan kedudukan MPR, DPR, DPD, dan DPRD. Ide pembentukan DPD pasca reformasi berhubungan dengan upaya merombak parlemen Indonesia agar menjadi dua kamar atau bicameralism.Gagasannya berdasarkan pada perubahan Ketiga UUD 1945 di mana ketentuan tentang DPR diatur dalam pasal 20 dan ketentuan tentang keberadaan DPD diatur dalam pasal 22C serta pasal 22D.  Kurangya eksistensi DPD disebabkan sistem dua kamar dalam parlemen Indonesia pada kenyataannya  mengadopsi gagasan soft bicameral di mana dalam sistem ini DPR dan DPD tidak memiliki kewenangan yang sama kuat. Dengan kata lain, ada satu kamar yang lebih kuat daripada kamar yang lainnya. DPR menjadi kamar yang lebih kuat dan DPD hanya menjadi tambahan yang eksistensinya hanya mengurusi hal-hal yang berhubungan langsung dengan kepentingan daerah.Kata Kunci: Eksistensi, DPD, Lembaga Negara, Sistem Ketatanegaraan.

Abstract

Abstract: This research aims to determine the handling of money politics crimes during regional head elections, carried out by regional head candidate participants, voters and campaign teams in regional head elections. The empirical legal research used is a documentation study method, then the data obtained is analyzed descriptively qualitatively so as to reveal the expected results and conclusions. The results of this research show that: the handling of violations of criminal acts of money politics by the Integrated Law Enforcement Center (Gakkumdu) is carried out with the provisions of the flow of handling election violations based on Perbawaslu No. 8 of 2020, there are factors that influence the Integrated Law Enforcement Center in handling criminal acts of money politics at the General Election Supervisory Body in general, there are 3 main problems, namely legal substance, legal structure, legal culture, it is hoped that the handling will be carried out by the Law Enforcement Center Integrated (Gakkumdu) Against Criminal Election Violations, especially Criminal Election Violations in Money Politics Cases, will increase public confidence in the organizers of the upcoming election. Abstract

Abstract: In the era of decentralization and regional autonomy, the performance of public organizations has an important role in providing public services to the community. Palupuh District is a public organization located in Agam Regency, West Sumatra Province. Palupuh District has the task of implementing the wheels of government and public services at the sub-district level. In achieving these goals, it is certainly influenced by the performance of the organization as a whole. This study aims to analyze how the Palupuh District organization performs in achieving its goals according to its vision and mission. To see the performance of Palupuh District, researchers look at various aspects, namely, productivity, responsiveness, service quality, cooperation, use of resources and punctuality. The second objective is to describe the inhibiting factors of Palupuh District organizational performance. This study is a qualitative descriptive study referring to the concept of performance indicators plus the conditions that exist at the research locus. Based on the results of the study, it can be explained that the performance of the organization has been running well, such as in the indicators of responsiveness, service quality, cooperation and punctuality. The indicators that still have obstacles are human resources and infrastructure. Therefore, researchers provide suggestions to improve human resource competency, optimize existing facilities and infrastructure to support activities and increase budget allocation and adjust according to budget targets.Keywords: Organizational Performance, Productivity, Use of Resources and Infrastructure.
